1715 The Potential of Dinar (Gold) Currency as the Main Object Transaction in Indonesia

Abstract:
In this article, we have elaborated a study over the nature of Islamic financial transaction by comparing between Dinar and IDR currency in Indonesia. We have found the interesting issue among scholars and practitioners in which Dinar would be a single currency ASEAN Economic Community (AEC), then becoming motivation and added value research. The assessment among dinar volatility analysis for three years ago and IDR fluctuation as well as outlook qualitative test regarding dinar are components of analysis that weak Indonesian currency should be altered to be better coinage. The value of dinar more stable than IDR and also eligible as a currency e.g. limited quantities, easy to carry, durable, easy to saved, and has the same quality. On the other hand, the existing of IDR has defeated by inflation. The EViews program explained that Dinar at current level still fluctuate, but in the first different have fixed variant. The result of analysis describing that dinar has potential as the medium exchange, because the material of dinar is relevant and feasible since 14 century until present. Abstract:
Due to growing environmental awareness in Pakistan, the researchers are increasingly turning to assess and analyze properties of industrial waste and finding solutions on using industrial waste as secondary material. Due to industrialization, enormous by-products are produced and to utilize these by-products is the main challenge faced in Pakistan. Induction furnace slag is one of the industrial by-products from the iron and steel making industries. This paper highlights the true utilization of induction furnace slag as partial replacement of fine aggregate. For the experimental investigation, mixes were prepared with fine aggregate replacement using 0 percent, 5 percent, 10 percent, 15 percent, 20 percent, 25 percent, 30 percent, 35 percent and 40 percent induction furnace slag to evaluate the workability, compaction factor, compressive strength, flexural strength, modulus of elasticity.Keywords: compressive strength, deflection, induction furnace slag, workability

Abstract:
The use of ethanol blended with diesel is receiving more attention by many researchers in the recent time. It was shown that ethanol–diesel blends were technically acceptable for existing diesel engines. Ethanol, as an attractive alternative fuel, is a renewable bio-based resource and it is oxygenated, thereby providing the potential to reduce particulate emissions in compression–ignition engines. In this review, the properties and specifications of ethanol blended with diesel fuel are discussed. Special emphasis is placed on the factors critical to the potential commercial use of these blends. These factors include blend properties such as stability, viscosity and lubricity, safety and materials compatibility. The effect of the fuel on engine performance, durability and emissions is also considered. The formulation of additives to correct certain key properties and maintain blend stability is suggested as a critical factor in ensuring fuel compatibility with engines. However, maintaining vehicle safety with these blends may require special materials and modification of the fuel tank design. Further work is required in specifying acceptable fuel characteristics, confirming the long-term effects on engine durability, and ensuring safety in handling and storing ethanol–diesel blends.Keywords: ethanol, renewable, blend, bio-fuel, diesel engines

Abstract:
Flooding is an event of ponding on the flat area around the river as a result of the overflow of river water was not able to be accommodated by the river and may cause damage to the infrastructure of a region. This study aimed to analyze the data of Digital Elevation Model (DEM) for information that plays a role in the mapping of zones prone to flooding, mapping the distribution of zones prone to flooding that occurred in the Citarum upstream using secondary data and software (ArcGIS, MapInfo), this assessment was made distribution map of flooding, there were 13 counties / districts dam flood-prone areas in Bandung, and the most vulnerable districts are areas Baleendah-Dayeuhkolot-Bojongsoang-Banjaran. The area has a low slope and the same limits with boundary rivers and areas that have excessive land use, so the water catchment area is reduced.Keywords: mitigation, flood, citarum, DEM

The Nigerian economy has faced numerous obstacles over the past few years, including the energy crisis, the death and winding up of many small and medium enterprises, high unemployment rates, and escalating inflation, amongst others. Entrepreneurial innovation has emerged as a potential catalyst for revitalizing the troubled economy and driving sustainable growth. Entrepreneurial innovation can revitalize key industries and foster job creation. This paper proposes significant options as key drivers to entrepreneurial innovation that can take the troubled Nigerian economy out of the woods. It also discusses the significance of government assistance and regulatory actions in fostering entrepreneurial creativity. It argues that initiatives such as funding support, infrastructure development, and regulatory reforms are necessary for fostering a vibrant entrepreneurial ecosystem in Nigeria in order to unlock the full potential of innovative entrepreneurs. Finally, the paper emphasizes the transformative power of entrepreneurial innovation in revamping the troubled Nigerian economy and calls for concerted efforts by all stakeholders to harness its potential for sustainable growth and development. Abstract:
This study aims to examine and analyze the influence of organizational culture, organizational commitment, and transformational leadership style on employee performance. This study used descriptive survey method with quantitative approach, and questionnaires as a tool used for basic data collection. The sampling technique used is proportionate stratified random sampling technique; all respondents in this study were 70 respondents. The analytical method used in this research is multiple linear regressions. The result of determination coefficient of 52.3% indicates that organizational culture, organizational commitment, and transformational leadership style simultaneously have a significant influence on the performance of employees, while the remaining 47.7% is explained by other factors outside the research variables. Partially, organization culture has strong and positive influence on employee performance, organizational commitment has a moderate and positive effect on employee performance, while the transformational leadership style has a strong and positive influence on employee performance and this is also the variable that has the most impact on employee performance.Keywords: organizational culture, organizational commitment, transformational leadership style, employee performance

Abstract:
In the present study, eighty-three wild Oreochromis aureus of different body size ranging 5.3-14.6 cm in total length were collected from the River Chenab, District Muzzafer Garh, Pakistan to investigate the parameters of length –weight, length-length relationships and condition factor in relation to size. Each fish was measured and weighed on arrival at laboratory. Log transformed regressions were used to test the allometric growth. Length-weight relationship was found highly significant (r = 0.964; P < 0.01). The values of exponent “ b” in Length–weight regression (W=aL^b), deviated from 3, showing isometric growth (b = 2.75). Results for LLRs indicated that these are highly correlated (P < 0.001). Condition factor (K) found constant with increasing body weight, however, showed negative influence with increasing total length.Keywords: lenght-weight, Oreochromis aureus, morphometric study

Abstract:
The potential role of higher education institutes in sustainable development cannot be undermined. In this regard, it is important to investigate the established concept of sustainability in such institutes to explore the room for further improvement. In this paper, a case study of the University of Melbourne is conducted, and the institute’s commitments towards sustainability are examined by a detailed qualitative review of its policy and design standard documents. These documents are reviewed as through these; the institute portrays its vision of building environment facilities, which it aspires to procure and use. From detailed review, it is realized that these documents are updated at different times, creating the potential for mismatch between them. The occurrence of different goals and objectives in different documents is highlighted, and the interrelationships between different goals and operational objectives are explored. The role of the university aspired goals/objectives in terms of built environment sustainability is discussed, and the gaps in the articulation of goals and operational objectives are highlighted. Abstract:
Kabul city is experiencing urban land expansion in an unprecedented scale, especially since the last decade. With massive population expansion and fast economic development, urban land has increasingly expanded and encroached upon agriculture land during the urbanization history of the city. This paper evaluates the integrated urban land expansion impact on agriculture land in Kabul city since the formation of the basic structure of the city between 1962-1964. The paper studies the temporal and spatial characteristic of agriculture land and agriculture land loss in Kabul city using geographic information system (GIS) and remote sensing till 2008. Many temporal Landsat Thematic Mapper (TM) imageries were interpreted to detect the temporal and spatial characteristics of agriculture land loss. Different interval study periods, however, had vast difference in the agriculture land loss which is due to the urban land expansion trends in the city. the high number of Agriculture land adjacent to the city center and urban fringe have been converted into urban land during the study period in the city, as the agriculture land is highly correlated with the urban land.Keywords: agriculture land, agriculture land loss, Kabul city, urban land expansion, urbanization

Abstract:
This paper studies the technical efficiency of Saudi banking sector using stochastic frontier model. A sample of 12 banks over the period 2000-2011 is selected to investigate their technical efficiencies in mobilizing deposits, producing investment and generating income. The banks are categorized as Saudi-owned banks, Saudi-foreign-owned banks and Islamic banks. The findings show some consistent pattern of these bank types; and there exist significant disparities among the banks in term of technical efficiency. The Banque Saudi Fransi stands out as a benchmark bank for the industry, and it is a Saudi-foreign owned bank type. The Saudi owned bank types have shown fluctuating performance during the period; and the Islamic bank types are no significantly different from Saudi-owned bank types.Keywords: technical efficiency, production frontier model, Islamic banking

Abstract:
When electrical electrodes are mounted on the skin surface of the muscle, a signal is detected when a skeletal muscle undergoes contraction; the signal is known as surface electromyographic signal (EMG). This signal has a noise-like interference pattern resulting from the temporal and spatial summation of action potentials (AP) of all active motor units (MU) near electrode detection. By appropriate processing (Decomposition), the surface EMG signal may be used to give an estimate of motor unit action potential. In this work, a denoising technique is applied to the MUAP signals extracted from the spatial filter (IB2). A set of signals from a non-invasive two-dimensional grid of 16 electrodes from different types of subjects, muscles, and sex are recorded. These signals will acquire noise during recording and detection. A digital fourth order band- pass Butterworth filter is used for denoising, with a tuned band-pass frequency of suitable choice of cutoff frequencies is investigated, with the aim of obtaining a suitable band pass frequency. Results show an improvement of (1-3 dB) in the signal to noise ratio (SNR) have been achieved, relative to the raw spatial filter output signals for all cases that were under investigation. An quantitative survey based approach was adopted in this constructive study. A questionnaire-based survey was conducted for the assessment of construction Quality perception and expectations in the context of quality improvement technique. The survey feedback of professionals of the leading construction organizations/companies of Pakistan construction industry were analyzed. The financial capacity, organizational structure, and construction experience of the construction firms formed basis for their selection. The quality perception was found to be project-scope-oriented and considered as an excess cost for a construction project. Any quality improvement technique was expected to maximize the profit for the employer, by improving the productivity in a construction project. Abstract:
GaAs (gallium arsenide) solar cells have gained significant attention for their use in space applications. These solar cells have the potential for efficient energy conversion and are being explored as potential power sources for electronic devices, satellites, and telecommunication equipment. In this study, the aim is to investigate the effect of adding a window layer and a back surface field (BSF) layer made of InₓGa₍₁₋ₓ₎P material to a GaAs single junction solar cell. In this paper, we first obtain the important electrical parameters of a single-junction GaAs solar cell by utilizing a two-dimensional simulator software for virtual investigation of the solar cell; then, we analyze the impact of adding a window layer and a back surface field layer made of InₓGa₍₁₋ₓ₎P on the solar cell. The Department of Archaeology at King Saud University conduct a long Term excavations since 2004 at the archaeological site of (Qurh) in Al-Ula area. The history of the site goes back to the eighth century AD. The main aim of the excavations is the training of the students on the archaeological field work associated with the scientific skills of exploring, surveying, classifying, documentations and other necessary in the field archaeology. During the 12th Season of Excavations, an area of 20 × 40 m2 of the site was excavated. The depth of the excavating the site was reached to 2-3 m. Many of the architectural features of a residential area in the northern part of the site were excavated this season. Circular walls made of mud-brick and a brick column drums and tiles made of clay were revealed this season. Additionally, lots of findings such as Gemstones, jars, ceramic plates, metal, glass, and fabric, as well as some jewelers and coins were discovered. Abstract:
This study focused on exploring the students’ views about the science education in intermediate stage in State of Kuwait. This study used Social-Culture Theory (SCT) as a theoretical framework to understand the science curriculum reform process through the socio-cultural context and to discuss and explain the study findings. This study used a multi-method design, with both quantitative and qualitative methods to collect the data: students’ questionnaires and interviews. The study sample was selected randomly. First, the questionnaire was conducted with 647 students. Then 30 students (5 in each of 6 focus groups) were chosen to conduct the in-depth interviews. The findings of this study indicated the generally negative views of most of the students about the new science curriculum. The findings showed that most of the students have a negative attitude toward science, they have difficulty understanding most of the lessons, and they do not enjoy studying the science subject. This study recommends reviewing the new science curriculum (now currently in use) and taking into account the perspectives of the students about this curriculum. Developing and adapting the new science curriculum took place without taking into consideration the socio-culture and Islamic religion of Kuwaiti students. The MoE should deal with the relationship between science and culture and between science and religion, integrating more relevant science into the curriculum.Keywords: science education, students views, science curriculum, curriculum development

The study had shown that Sungai Penchala (urban) was experiencing localized rainfall and hazardous air pollution due to urbanization. The high rainfall that partly added by localized rain had been seen as a threat of causing the flash floods and water quality deterioration in the area. The air pollution that consisted of mainly particulate matter (PM10), carbon monoxide (CO), nitrogen dioxide (NO2), sulfur dioxide (SO2), and ozone (O3) gave an alarming air pollution index (API) to the surrounding area. Comparison among urban area (Sungai Penchala), sub-urban (Gombak), and green areas (Jerantut plus Temerloh) with respect to the rainfall parameters and air pollutants, it was found that the degree of intensities of the parameters was positively related with the urbanization. The air pollutants especially NO2, SO2, and CO were in tandem with the increase of the rainfall. Specifically, if the water catchment area is physically near to the urban area, then the authorities need to look into related urban development program by considering the management of emitted pollutants with respect to the ecological setting of the urban area.Keywords: urbanization, green area localized rainfall, air pollution, sub-urban area

Gulzar Mahal is a heritage site located in the city of Bahawalpur, Pakistan. The site is under a process of degradation, as cracks are appearing on the walls, roofs, and floor around the building due to differential settlement. To preserve the integrity of the structure, a geotechnical distress evaluation was carried out to evaluate the causal factors and recommend remediation measures. The research involved the characterization of the problematic soil and analysis of the observed distress with respect to the geotechnical properties. Both conventional lab and field tests were used in conjunction with the unconventional techniques like; Electrical Resistivity Tomography (ERT) and FEA. The temporal, geophysical and geotechnical evaluations have concluded that the foundation soil over the past was subjected to variations in the land use, poor drainage patterns, overloading and fluctuations in groundwater table all contributing to the differential settlements manifesting in the form of the visible shear crack across the length and breadth of the building.Keywords: differential settlement, distress evaluation, finite element analysis, Gulzar Mahal

This paper presents the effects of suction/injection of transient/steady natural convection flow of reactive viscous fluid in a vertical porous pipe. The mathematical model capturing the time dependent flow of viscous reactive fluid is solved using implicit finite difference method while the corresponding steady state model is solved using regular perturbation technique. Results of analytical and numerical solutions are reported for various parametric conditions to illustrate special features of the solutions. The coefficient of skin friction and rate of heat transfer are obtained and illustrated graphically. The numerical solution is shown to be in excellent agreement with the closed form analytical solution. Cocoa bean is the raw material for products such as cocoa powder and chocolate. Cocoa bean contains polyphenol which has been shown in several clinical studies to confer beneficial health effects. However studies showed that cocoa polyphenol absorption in the human intestinal tracts are very low. Therefore nanoemulsion may be one way to increase the bioavailability of cocoa polyphenol. This study aim to characterize nanoemulsion incorporating crude cocoa polyphenol produced using high energy technique. Cocoa polyphenol was extracted from fresh freeze-dried cocoa beans from Malaysia. The particle distribution, particle size, and zeta potential were determined. The emulsion was also analysed using transmission electron microscope to visualize the particles. Solubilization study was conducted by titrating the nanoemulsion into distilled water or 1% surfactant solution. Result showed that the nanoemulsion contains particle which have narrow size distribution. The particles size average at 112nm with zeta potential of -45mV. Cyber exercises used to assess the preparedness of a community against cyber crises, technology failures and critical information infrastructure (CII) incidents. The cyber exercises also called cyber crisis exercise or cyber drill, involved partnerships or collaboration of public and private agencies from several sectors. This study investigates organisation cyber resilience (OCR) of participation sectors in cyber exercise called X Maya in Malaysia. This study used a principal based cyber resilience survey called C-Suite Executive checklist developed by World Economic Forum in 2012. To ensure suitability of the survey to investigate the OCR, the reliability test was conducted on C-Suite Executive checklist items. The research further investigates the differences of OCR in ten Critical National Infrastructure Information (CNII) sectors participated in the cyber exercise. Analyses of mineral elements were carried out on some coarse grains used as staple food in Kano. The levels of Magnesium, Calcium, Manganese, Iron, Copper and Zinc were determined using atomic absorption spectrophotometer (AAS), and that of Sodium and Potassium were obtained using flame photometer (FES). The result of the study shows that the mean results of the mineral elements ranged from 62.50±0.55 - 84.82±0.74mg/kg sodium, 73.33±0.35 - 317±0.10mg/kg magnesium, 89.22±0.26 - 193.33±0.19mg/kg potassium, 70.00±0.52 - 186.67±0.29mg/kg calcium, 1.00±0.11 - 20.50±1.30mg/kg manganese, 25.00±0.11 - 80.50±0.36mg/kg iron. 4.00±0.08 - 13.00±0.24mg/kg copper and 15.00±0.34 - 50.50±0.24 zinc. There was significant difference (p < 0.05) in levels of sodium, potassium and calcium whereas no significant difference (p > 0.05) occurs in levels of magnesium, manganese, copper and zinc. In comparison with Recommended Daily Allowances of essential and trace metals set by international standard organizations, the coarse grains analysed in this work contribute little to the provision of essential and trace elements requirements.Keywords: mineral elements, coarse grains, staple food, Kano, Nigeria

Abstract:
This study was conducted to investigate foetal loss among slaughtered livestock species at the Maiduguri abattoir from 2009 to 2013. Record of animals slaughtered monthly and fetuses recovered were collected from the management of the Maiduguri abattoir. Data was subjected to Analysis of Variance using the General Linear Model of SPSS 13.0 with Season, Species and their interaction as fixed factors. Average yearly slaughter at the Maiduguri abattoir was 63,225 animals with cattle, camel, goat and sheep accounting for 19737, 7374, 19281 and 17540 of the total. The corresponding number of those pregnant were 3117, 839, 2281 and 2432 out of a total of 8522 animals. Thus, cattle, camel, goat and sheep accounted for 30.87, 11.53, 30.16 and 27.44%, respectively of the animals slaughtered at the Abattoir and 35.96, 9.68, 26.31 and 28.05% of the foetal loss. The effect of season and species on foetal loss was significant (P < 0.05). The number of pregnant animals slaughtered and foetal loss were higher during wet than dry season. Similarly, foetal loss at the abattoir was higher in the month of May in respect of camel, goat and sheep, and August for cattle. Camel was the least slaughtered animal and had the least number of pregnant females. Foetal loss (%) was higher (P < 0.05) for cattle compared to other species. The interaction showed that camel was the least slaughtered species in both seasons and cattle in the wet season had the highest foetal loss.Keywords: abattoir, foetal loss, season, species

Abstract:
Malaysia is becoming a developed country by the year 2020, the problem is that little is known about the perceptions and curricular values of Malaysian high school students who have taken Living Skills as a subject in the regular public school. How these students perceive technology in their daily lives, in the country’s development and in global context, is not known. The study involved form 4 students from four public schools in Petaling District. The study found that the Petaling District students’ knowledge of technology were good, where 76.6 % of them scored 50% marks and above during the achievement test. In addition, it was also found that only excellent and squatter students perceived technology education as important as a school subject, compared to those students from the urban area. It was found that students preferred business and entrepreneurship topics rather than the other Living Skills curriculum. The study suggests that students should be exposed to technology education from the early years of schooling (preschool to secondary). In addition, the acquisition of skills, the evaluation, revision and modification of the instruction as well as the curriculum should be enforced.Keywords: technology education, living skills, curricular values, public schools

Abstract:
The current study determined the effect of fortification using Moringa (Moringa oleifera) Leaves Extract (MLE) at different inclusion levels (0, 6, 8, and 10% v/v) on physicochemical and sensory properties of fullfat (FFY) and lowfat (LFY) yoghurt. The results revealed significantly higher protein (p<0.01), fat (p<0.001) and pH in FFY compared to LFY. The MLE inclusion significantly (p<0.001) increased fat contents of the yoghurt types. The pH of LFY produced with 6% MLE was significantly the lowest (p<0.001). The concentration of Mg (21.0 mg/100g), Na (63.0 mg/100g), Ca (173.0 mg/100g), P (416.7 mg/100g), Cu (0.59 mg/100g), Co (0.30 mg/100g), Fe (1.13 mg/100g), and Mn (0.059 mg/100g) were significantly (p<0.001) higher in 10% MLE inclusion level for both FFY and LFY. Also, Mg, Na, Cu and Fe showed significant (p<0.001) negative correlation in fullfat and positive in lowfat yoghurt. The sensory assessment revealed that taste, flavour, colour, texture, and overall acceptability of yoghurt produced with 6% MLE (rated as liked very much) was significantly (p<0.001) better than that produced with 8 and 10% (rated liked slightly). It was concluded that fortification of FFY and LFY with 6% MLE produced acceptable yoghurt that has high nutritional value.Keywords: moringa, fortification, yoghurt, bioactive compounds

Abstract:
The main objective of this study is to develop an independent reliability based code for reinforced concrete (R/C) structural components and elements solely for the State of Kuwait and its neighboring countries. The proposed code will take into account the harsh Kuwait’s harsh environment, loading conditions and material strengths. The method for developing such a code is based on structural reliability theory that takes into accounts the specific geographical and the various prescribed societal environment of the Kuwait region. These methods were developed according to the following four components: (1) loads, (2) structural strength, (3) reliability analysis, and (4) achieving target reliability levels (reliability index ’s ). The final product from this study will be a design code for R/C structural elements that include beams and columns, and some other structural members. This reliability-based LRFD design code will provide appropriate, easy, fast, and economical approach for designing R/C structural elements such as, beams and columns, for both houses and bridges, and other concrete structures. In addition, this reliability-based codified design of R/C beams, columns, and, possibly, concrete slabs will improve the design and serviceability of R/C bridge and building systems in Kuwait and neighboring GCC countries. Also, it has the potential to reduce the cost of new concrete structures, as fewer materials are used with more design efficiency.Keywords: live laod, design, evaluation, structural building

Abstract:
The study was aimed to define the percentage of detection of high-oncogenic risk types of HPV and their genotyping in archival tissue specimens that ranged from apparently healthy tissue to invasive breast cancer by using one of the recent versions of In Situ Hybridization(ISH) 0.2. To find out rational significance of such genotypes as well as over expressed products of mutants P53 and RB genes on the severity of underlying breast cancers. The DNA of HPV was detected in 46.5 % of tissues from breast cancers while HPV DNA in the tissues from benign breast tumours was detected in 12.5%. No HPV positive–ISH reaction was detected in healthy breast tissues of the control group. HPV DNA of genotypes (16, 18, 31 and 33) was detected in malignant group in frequency of 25.6%, 27.1%, 30.2% and 12.4%, respectively. Over expression of p53 was detected by IHC in 51.2% breast cancer cases and in 50% benign breast tumour group, while none of control group showed P53- over expression. Retinoblastoma protein was detected by IHC test in 49.7% of malignant breast tumours, 54.2% of benign breast tumours but no signal was reported in the tissues of control group. The significance prevalence of expression of mutated p53 & Rb genes as well as detection of high-oncogenic HPV genotypes in patients with breast cancer supports the hypothesis of an etiologic role for the virus in breast cancer development.Keywords: human papilloma virus, P53, RB, breast cancer

Abstract:
Brexit nudged the British executive towards overriding parliamentary sovereignty in the UK. In 2019, Prime Minister Boris Johnson sought to prorogue parliament to prevent it from debating withdrawal from the UK. In 2022, Pakistan's Prime Minister also tried to nullify the ability of parliament to vote on the constitutional mechanism of a no-confidence vote. In both cases, the apex courts intervened and restored the supremacy of Parliament, averting constitutional crises. This paper examines the legitimacy and power of said courts to intervene in sensitive political and constitutional questions. The research focuses on the administrative law area of judicial review. It examines how in UK and Pakistan practice of judicial review helps mediate constitutional deadlocks between institutions comparatively. The recalcitrance of pathogenic bacteria indicates that millions of people who are at risk of infection arising from chronic diseases, surgery, organ transplant, diabetes, and several other debilitating diseases present an aura of potentially untreatable illness due to resistance development. Antimicrobial resistance has successfully become a global health menace, and resistances are often acquired by bacteria through health-care-related incidence (HRI) orchestrated by multi-drug resistant (MDR) and extended drug-resistant pathogens (EDRP). To understand the mechanisms S. Typhimurium uses to resist CDB, we study the abundance of LPS modification, Ergosterols, Mysristic palmitic resistance, Oleic acid resistance of susceptible and resistant S. Typhimurium. Using qPCR, we also analyzed the expression of selected genes known for enabling resistance in S. Typhimurium. We found high abundance of LPS, Ergosterols, Mysristic palmitic resistance, Oleic acid resistance of and high expression of resistant genes in S. Typhimurium compared to the susceptible strain. Abstract:
In recent years, alternative dispute resolution methods have attracted the attention of many country’s legislators. Instead of solving the disputes by litigation, putting the end to a dispute by parties themselves is more important for the preservation of social peace. Therefore, alternative dispute resolution methods (ADR) have been discussed more intensively in Turkey as well as the whole world. After these discussions, Mediation Act was adopted on 07.06.2012 and entered into force on 21.06.2013. According to the Mediation Act, it is only possible to mediate issues arising from the private law. Also, it is not compulsory to go to mediation in Turkish law, it is optional. Therefore, the parties are completely free to choose mediation method in dispute resolution. Mediators need to be a lawyer with experience in five years. Therefore, it is not possible to be a mediator who is not lawyers. Beyond five years of experience, getting education and success in exams about especially body language and psychology is also very important to be a mediator. If the parties compromise as a result of mediation, a document is issued. This document will also have the ability to exercising availability under certain circumstances. Thus, the parties will not need to apply to the court again. On the contrary, they will find the opportunity to execute this document, so they can regain their debts. However, the Mediation Act has entered into force in a period of nearly two years of history; it is possible to say that the interest in mediation is not at the expected level. Therefore, making mediation mandatory for some disputes has been discussed recently. At this point, once the mediation becomes mandatory and good results follows it, this institution will be able to find a serious interest in Turkey.
