2297 Mechanisms for Strategic Adoption of Innovation Procurement

Abstract:
In order to determine how innovation procurement can strengthen public efficiency and foster the modernization of public services, while at the same time promoting the opening of new private markets, this paper aims to present the two key instruments for the practice of innovation procurement at a European, national, and regional level – Pre-Commercial Procurement (PCP), and Public Procurement of Innovative Solutions (PPI). Thus, it starts with a theoretical framework on the emergence of this topic in the European Innovation Policy (Section 2), then continues with the identification and systematization of the main mechanisms for its effective adoption, both on the demand and supply side of the market (Section 3), as well as to expose and describe methods and tools for positioning innovation at the heart of public entities. The innovative projects best distinguished by the European Commission for their good practices in innovation procurement are identified, and the main methodology for the development and management of innovation procurement – Forward Commitment Procurement (FCP) – is applied to them in a pioneering way (Section 4). Abstract:
Application of piezoelectric sensors to detect structural damage due to seismic action on building structures is investigated. Plate-type piezoelectric sensor was developed and proposed for this task. A film-type piezoelectric sheet was attached on a steel plate and covered by a layer of glass. A special glue is used to fix the glass. This glue is a silicone that requires the application of ultraviolet rays for its hardening. Then, the steel plate was set up at a steel column-beam joint of a test specimen that was subjected to bending moment when test specimen is subjected to monotonic load and cyclic load. The structural behavior of test specimen during cyclic loading was verified using a finite element model, and it was found good agreement between both results on load-displacement characteristics. The cross section of steel elements (beam and column) is a box section of 100 mm×100 mm with a thin of 6 mm. This steel section is specified by the Japanese Industrial Standards as carbon steel square tube for general structure (STKR400). The column and beam elements are jointed perpendicularly using a fillet welding. The resulting test specimen has a T shape. When large deformation occurs the glass plate of the sensor device cracks and at that instant, the piezoelectric material emits a voltage signal which would be the indicator of a certain level of deformation or damage. Applicability of this piezoelectric sensor to detect structural damages was verified; however, additional analysis and experimental tests are required to establish standard parameters of the sensor system.Keywords: piezoelectric sensor, static cyclic test, steel structure, seismic damages

Abstract:
The composite shear walls (CSW) with steel encased profiles can be used as lateral-load resisting systems for buildings that require considerable large lateral-load capacity. The aim of this work is to propose the experimental work conducted on CSW having L section folded plate (L shape steel made-up sections) as longitudinal reinforcement in boundary regions. The study in this paper present the experimental test conducted on CSW having L section folded plate as longitudinal reinforcement in boundary regions. The tested 1/3 geometric scaled CSW has aspect ratio of 3.2. L-shape structural steel materials with 2L-19x57x7mm dimensions were placed in shear wall boundary zones. The seismic behavior of CSW test specimen was investigated by evaluating and interpreting the hysteresis curves, envelope curves, rigidity and consumed energy graphs of this tested element. Abstract:
Hollow section for bridge columns has some advantages. However, current seismic design codes do not provide design regulations for hollow bridge piers. There have been many experimental studied for hollow reinforced concrete piers in the world. But, Study for hollow section for bridge piers in Korea has been begun with approximately 2000s. There has been conducted experimental study for hollow piers of flexural controlled sections by Yeungnam University, Sung kyunkwan University, Korea Expressway Corporation in 2009. This study concluded that flexural controlled sections for hollow piers showed the similar behavior to solid sections. And there have been conducted experimental study for hollow piers of compression controlled sections by Yeungnam University, Korea Institute of Construction Technology in 2012. This study concluded that compression controlled sections for hollow piers showed compression fracture of concrete in inside wall face. Samsung C&T Engineering & Construction Group has been conducted study with Yeungnam University for reduce the quantity of reinforcement details about hollow piers. Reduce the quantity of reinforcement details are triangular cross tie. Abstract:
The concept of this paper builds on connecting between two important notions, fuzzy ideals of BCK-algebras and derivation of BCI-algebras. The result we got is a new concept called derivation fuzzy ideals of BCI-algebras. Followed by various results and important theorems on different types of ideals. In chapter 1: We presented the basic and fundamental concepts of BCK\ BCI- algebras as follows: BCK/BCI-algebras, BCK sub-algebras, bounded BCK-algebras, positive implicative BCK-algebras, commutative BCK-algebras, implicative BCK- algebras. Moreover, we discussed ideals of BCK-algebras, positive implicative ideals, implicative ideals and commutative ideals. In the last section of chapter 1 we proposed the notion of derivation of BCI-algebras, regular derivation of BCI-algebras and basic definitions and properties. In chapter 2: It includes 3 sections as follows: Section 1 contains elementary concepts of fuzzy sets and fuzzy set operations. Section 2 shows O. G. Xi idea, where he applies fuzzy sets concept to BCK-algebras and we studied fuzzy sub-algebras as well. Section 3 contains fuzzy ideals of BCK-algebras basic definitions, closed fuzzy ideals, fuzzy commutative ideals, fuzzy positive implicative ideals, fuzzy implicative ideals, fuzzy H-ideals and fuzzy p-ideals. Moreover, we investigated their concepts in diverse theorems and propositions. In chapter 3: The main concept of our thesis on derivation fuzzy ideals of BCI- algebras is introduced. Chapter 3 splits into 4 sections. We start with General definitions and important theorems on derivation fuzzy ideal theory in section 1. Section 2 and 3 contain derivations fuzzy p-ideals and derivations fuzzy H-ideals of BCI- algebras, several important theorems and propositions were introduced. The last section studied derivations fuzzy implicative ideals of BCI-algebras and it includes new theorems and results. Furthermore, we presented a new theorem that associate derivations fuzzy implicative ideals, derivations fuzzy positive implicative ideals and derivations fuzzy commutative ideals. Abstract:
The increasing trend of cesarean sections, especially those performed on self-request without medical indications, presents complex dilemmas related to medical aspects, professionalism, and bioethics. This study aims to investigate the medical, professional, and bioethical considerations surrounding anesthesia in cesarean sections performed on self-request without medical indications. We report the case of a 27-year-old woman, G1P0A0 gravid 38 weeks, admitted to the hospital for a planned cesarean section on request for the reason that she could not tolerate pain and requested on a date that corresponded to the date and month of her mother's birth. Cesarean section on patient request fulfills the principle of autonomy, which states that patients have the right to themselves. However, this medical procedure is still considered no safer and riskier even though medical technology has developed rapidly. Furthermore, anesthesia during cesarean section at self-request without medical indications is a dilemma for anesthesiologists considering the risks and complications of anesthesia for both the fetus and the mother. The trend in increasing the number of cesarean sections is influenced by patient reasons such as not being able to tolerate pain, trust factors, and worry about damage to the birth canal.Keywords: anesthesia, bioethics, cesarean section, self-request, professionalism

Abstract:
A seismic refraction and resistivity survey was conducted in Ini Local Government Area, South-South Nigeria, to evaluate the structural setting and groundwater potential. The study involved 20 Vertical Electrical Soundings (VES) using an ABEM Terrameter with a Schlumberger array and a 400-meter electrode spread, analyzed with WinResist software. Concurrently, 20 seismic refraction surveys were performed with a Geometric ES 3000 12-Channel seismograph, employing a 60-meter slant interval. The survey identified three distinct geological layers: top, middle, and lower. Seismic velocities (Vp) ranged from 209 to 500 m/s in the top layer, 221 to 1210 m/s in the middle layer, and 510 to 1700 m/s in the lower layer. Secondary seismic velocities (Vs) ranged from 170 to 410 m/s in the topsoil, 205 to 880 m/s in the middle layer, and 480 to 1120 m/s in the lower layer. Poisson’s ratios varied from -0.029 to -7.709 for the top layer, -0.027 to -6.963 for the middle layer, and -0.144 to -6.324 for the lower layer. The depths of these layers were approximately 1.0 to 3.0 meters for the top layer, 4.0 to 12.0 meters for the middle layer, and 8.0 to 14.5 meters for the lower layer. The topsoil consists of a surficial layer overlaid by reddish/clayey laterite and fine to medium coarse-grained sandy material, identified as the auriferous zone. Resistivity values were 1300 to 3215 Ωm for the topsoil, 720 to 1600 Ωm for the laterite, and 100 to 1350 Ωm for the sandy zone. Aquifer thickness and depth varied, with shallow aquifers ranging from 4.5 to 15.2 meters, medium-depth aquifers from 15.5 to 70.0 meters, and deep aquifers from 4.0 to 70.0 meters. Locations 1, 15, and 13 exhibited favorable water potential with shallow formations, while locations 5, 11, 9, and 14 showed less potential due to the lack of fractured or weathered zones. The auriferous sandy zone indicated significant potential for industrial development. Abstract:
An experimental and analytical research on shear buckling of a comparably large polymer composite I-section is presented. It is known that shear buckling load of a large span composite beam is difficult to determine experimentally. In order to sensitively detect shear buckling of the tested I-section, twenty strain rosettes and eight displacement sensors were applied and attached on the web and flange surfaces. The tested specimen was a pultruded composite beam made of vinylester resin, E-glass, carbon fibers and micro-fillers. Various coupon tests were performed before the shear buckling test to obtain fundamental material properties of the I-section. An asymmetric four-point bending loading scheme was utilized for the shear test. The loading scheme resulted a high shear and almost zeros moment condition at the center of the web panel. The shear buckling load was successfully determined after analyzing the obtained test data from strain rosettes and displacement sensors. Abstract:
This article analyzes the international relations of sub-State governments (IRSSG) in Mexico. It aims to answer five questions: 1) What explains the recent and dramatic increase in their international activities? 2) What is the impact of federalism on the foreign affairs of the federal units? 3) What are the levels or degrees of IRSSG and how have they changed over the last years? 4) How do Mexican federal units institutionalize their international activities? 5) What are the perceptions and capacities of the federal units in their internationalization process? The first section argues that the growth in the IRSSG is generated by growing interdependence and globalization in the international system, and democratization, decentralization and structural reform in the national arena. The second section sustains that the renewed Mexican federalism has generated the incentives for SSG to participate more intensively in international affairs. The third section defends that there is a wide variation in their degree of international participation, which is measured in three moments in time (2004 2009 and 2014), and explains how this activity has changed in the last decade. The fourth section studies the institutionalization of the IRSSG in Mexico through the analysis of Inter-Institutional Agreements (IIA). Recently, damages due to typhoons and strong wind are on the rise. Considering this issue, we evaluated the performance of soundproofing walls based on the strong wind fragility by means of numerical analysis. Among the components of the soundproof wall, aluminum frame was the most vulnerable member, thus we have considered different section of aluminum frame in the determination of wind fragility. Wind load was randomly generated using Monte Carlo Simulation method. Moreover, limit state was based on the test standard of road construction soundproofing wall. In this study, the strong wind fragility was determined by considering the influence factors of wind exposure category, soundproof wall’s installation position, and shape of aluminum frame section. Abstract:
This paper describes an underactuated robot hand operated by low-power actuators. It can grasp objects of various shapes using easy operations. This hand is suitable for use as a lightweight prosthetic hand that can grasp various objects using few input channels. To realize operations using a low-power actuator, a cross section deformation spring is proposed. The design procedure of the underactuated robot finger is proposed to realize an adaptive grasping movement. The validity of this mechanism and design procedure are confirmed through an object grasping experiment. Results demonstrate the effectiveness of a cross section deformation spring in reducing the actuator power. The thrust of this paper is to examine how entrepreneurship can assist in the attainment of the first goal among the MDGs – eradication of extreme poverty and hunger in Nigeria. The paper discusses how national development can be driven through employment creation and wealth generation that can lead to reduction in widespread poverty so as to attain one crucial target, in fewer years. The task before Nigeria is certainly a herculean one; it is, in fact a race against time. However, in view of the clear and present danger that the increasing rate of poverty portends for our democracy and our nation, is a race we must; for it is a time bomb on our hands. The paper has been structured into sections; with the introduction as section one. Section two discusses the concept of entrepreneurship; Section three examines the link between entrepreneurship and economic development, while section four examines the challenges facing entrepreneurship in Nigeria. In section five, measures and recommendations to boost entrepreneurship that can drive economic development that translates into poverty reduction and employment creation in Nigeria are suggested. This work is a literature review with some understanding of current trends and situations. It outlines some of the difficulties facing entrepreneurship in Nigeria as the operating environment, inadequate understanding and skewed incentive. This research paper is a comparative study of the belt truss in the Regular RC frame structure at the different positions of the floor. The method used in this research is the response spectrum method with the help of the ETABS Software, there are six models in this paper with belt truss. The Indian standard code used in this work are IS 456:2000, IS 800:2007, IS 875 part-1, IS 875 part-1, and IS 1893 Part-1:2016. The cross-section of the belt truss is the I-section, a grade of steel that is made up of Mild Steel. The basic model in this research paper is the same, only position of the belt truss is going to change, and the dimension of the belt truss is remain constant for all models. The plan area of all models is 24.5 meters x 28 meters, and the model has G+20, where the height of the ground floor is 3.5 meters, and all floor height is 3.0 meters remains constant. Abstract:
Radiological properties of gel dosimeters and phantom materials are often evaluated in terms of effective atomic number, electron density, photon mass attenuation coefficient, photon mass energy absorption coefficient and total stopping power of electrons. To evaluate the water equivalence of such materials for fast neutron attenuation 19 different types of gel dosimeters and phantom materials were considered. Macroscopic removal cross-sections for fast neutrons (ΣR cm-1) have been calculated for a range of ferrous-sulphate and polymeric gel dosimeters using Nxcom Program. The study showed that the value of ΣR/ρ (cm2.g-1) for all polymer gels were in close agreement (1.5- 2.8%) with that of water. As such, the slight differences in ΣR/ρ between water and gels are small and may be considered negligible. Also, the removal cross-section of the studied phantom materials were very close (~ ±1.5%) to that of water except bone (cortical) which had about 38% variation. Recent seismic events have underscored the significant influence of masonry infill walls on the resilience of structures. The irregular positioning of these walls exacerbates their adverse effects, resulting in substantial material and human losses. Research and post-earthquake evaluations emphasize the necessity of considering infill walls in both the design and assessment phases. This study delves into the presence of soft stories in reinforced concrete structures with infill walls. Employing an approximate method relying on pushover analysis results, fiber-section-based macro-modeling is utilized to simulate the behavior of infill walls. The findings shed light on the presence of soft first stories, revealing a notable 240% enhancement in resistance for weak column—strong beam-designed frames due to infill walls. Conversely, the effect is more moderate at 38% for strong column—weak beam-designed frames. Interestingly, the uniform distribution of infill walls throughout the structure's height does not influence soft-story emergence in the same seismic zone, irrespective of column-beam strength. In regions with low seismic intensity, infill walls dissipate energy, resulting in consistent seismic behavior regardless of column configuration. Despite column strength, structures with open-ground stories remain vulnerable to soft first-story emergence, underscoring the crucial role of infill walls in reinforced concrete structural design.Keywords: masonry infill walls, soft Storey, pushover analysis, fiber section, macro-modeling

Abstract:
The seismic behavior of portal frames is mainly based on the shape of their joints. In these structures, vertical and inclined connections are the two general forms of connections. The shapes of connections can make differences in seismic responses of portal frames. Hence, in this paper, for the first step, the non-linear performance of portal frames with vertical and inclined connections has been investigated by monotonic analysis. Also, the effect of section sizes is considered in this analysis. For comparison, hysteresis curves have been evaluated for two model frames with different forms of connections. Each model has three various sizes of the column and beam. Other geometrical parameters have been considered constant. In the second step, for every model, an appropriate size of sections has been selected from the previous step. Next, the seismic behavior of each model has been analyzed by the time history method under three near-fault earthquake records. Finite element ABAQUS software is used for simulation and analysis of samples. Outputs show that connections form can impact on reaction forces of portal frames under earthquake loads. Abstract:
Pultruded materials made of fiber-reinforced polymer (FRP) come in a broad range of shapes, such as bars, I-sections, C-sections, and other structural sections. These FRP materials are starting to compete with steel as structural materials because of their great resistance, low self-weight, and cheap maintenance costs-especially in corrosive conditions. This study aimed to evaluate the effectiveness of Glass Fiber Reinforced Polymer (GFRP) of the hybrid columns built by combining (GFRP) profiles with concrete columns because of their low cost and high structural efficiency. To achieve the aims of this study, nine circular columns with a diameter of (150 mm) and a height of (1000mm) were cast using normal concrete with compression strength equal to (35 MPa). The research involved three different types of reinforcement: hybrid circular columns type (IG) with GFRP I-section and 1% of the reinforcement ratio of steel bars, hybrid circular columns type (IS) with steel I-section and 1% of the reinforcement ratio of steel bars, (where the cross-section area of I-section for GFRP and steel was the same), compared with reference column (R) without I-section. To investigate the ultimate capacity, axial and lateral deformation, strain in longitudinal and transverse reinforcement, and failure mode of the circular column under different loading conditions (concentric and eccentric) with eccentricities of 25 mm and 50 mm, respectively. Fin field effect transistors (FinFETs) deliver superior levels of scalability than the classical structure of MOSFETs by offering the elimination of short channel effects. Modern FinFETs are 3D structures that rise above the planar substrate, but some of these structures have inclined surfaces, which results in trapezoidal cross sections instead of rectangular sections usually used. Fin cross section shape of FinFETs results in some device issues, like potential distribution performance. This work analyzes that impact with three-dimensional numeric simulation of several triple-gate FinFETs with various top and bottom widths of fin. Abstract:
During the temperature changes in reactor core, the nuclide cross section in reactor can vary with temperature, which eventually causes the changes of reactivity. To simulate the interaction between incident neutron and various materials at different temperatures on the nose, it is necessary to generate all the relevant reaction temperature-dependent cross section. Traditionally, the real time cross section generation method is used to avoid storing huge data but contains severe problems of low efficiency and adaptability for narrow energy region. Focused on the research on multi-temperature cross sections generation in real time during in neutron transport, this paper investigated the on-the-fly cross section generation method for resolved resonance region, thermal region and unresolved resonance region, and proposed the real time multi-temperature cross sections generation method based on double-exponential formula for resolved resonance region, as well as the Neville interpolation for thermal and unresolved resonance region. To prove the correctness and validity of multi-temperature cross sections generation based on wide energy region of incident neutron, the proposed method was applied in critical safety benchmark tests, which showed the capability for application in reactor multi-physical coupling simulation.Keywords: cross section, neutron transport, numerical simulation, on-the-fly

Abstract:
DOA technique is a localization technique used in the communication field. Various algorithms have been developed for direction of arrival estimation like MUSIC, ROOT MUSIC, etc. These algorithms depend on various parameters like antenna array elements, number of snapshots and various others. Basically the MUSIC spectrum is evaluated and peaks obtained are considered as the angle of arrivals. The angles evaluated using this process depends on the scanning interval chosen. The accuracy of the results obtained depends on the coarseness of the interval chosen. In this paper, golden section search is applied to the MUSIC algorithm and therefore, more accurate results are achieved. Initially the coarse DOA estimations is done using the MUSIC algorithm in the range -90 to 90 degree at the interval of 10 degree. After the peaks obtained then fine DOA estimation is done using golden section search. Also, the partitioning method is applied to estimate the number of signals incident on the antenna array. Dependency of the algorithm on the number of snapshots is also being explained. In the light of these challenges, modern ideas must contribute to counter these challenges and exploit opportunities. Perhaps this paper will be one of these contributions. This paper discusses the impact of the quality cost on revenue sharing as a most important incentive to configure business networks. No doubt that the costs directly affect the size of income generated by a business network, so this paper investigates the impact of quality costs on business networks revenue, and their impact on the decision to participate the revenue among the companies in the supply chain. This paper develops the quality cost approach to align with the modern era, the developed model includes five categories besides the well-known four categories (namely prevention costs, appraisal costs, internal failure costs, and external failure costs), a new category has been developed in this research as a new vision of the relationship between quality costs and innovations of industry. This new category is Recycle Cost. This paper is organized into six sections, Section I shows quality costs overview in the supply chain. Section II discusses revenue sharing between the parties in supply chain. Section III investigates the impact of quality costs in revenue sharing decision between partners in supply chain. The fourth section includes survey study and presents statistical results. Section V discusses the results and shows future opportunities for research. This paper presents the design application and reinforcement detailing of 15 storied reinforced concrete shear wall-frame structure based on linear static analysis. Databases are generated for section sizes based on automated structural optimization method utilizing Active-set Algorithm in MATLAB platform. The design constraints of allowable section sizes, capacity criteria and seismic provisions for static loads, combination of gravity and lateral loads are checked and determined based on ASCE 7-10 documents and ACI 318-14 design provision. Abstract:
The tremendous loss of life that resulted in the aftermath of recent earthquakes in developing countries is mostly due to the collapse of non-engineered and semi-engineered building structures. Such structures are used as houses, schools, primary healthcare centres and government offices. These building are classified structurally into two categories viz. non-engineered and semi-engineered. Non-engineered structures include: adobe, Unreinforced Masonry (URM) and wood buildings. Semi-engineered buildings are mostly low-rise (up to 3 story) light concrete frame structures or masonry bearing walls with reinforced concrete slab. This paper presents an overview of the typical damage observed in non-engineered structures and their most likely causes in the past earthquakes with specific emphasis on the performance of such structures in the 2005 Kashmir earthquake. It is demonstrated that seismic performance of these structures can be improved from life-safety viewpoint by adopting simple low-cost modifications to the existing construction practices. Incorporation of some of these practices in the reconstruction efforts after the 2005 Kashmir earthquake are examined in the last section for mitigating seismic risk hazard.Keywords: Kashmir earthquake, non-engineered buildings, seismic hazard, structural details, structural strengthening

Abstract:
Photon induced average reaction cross section of ¹¹¹Cd (γ, γ`) ¹¹¹ᵐCd reaction was experimentally determined for the bremsstrahlung energy spectrum of 6 MeV by utilizing the activation and offline γ-ray spectrometric techniques. The 6 MeV electron accelerator Racetrack Microtron of Savitribai Phule Pune University, Pune was used for the experimental work. The bremsstrahlung spectrum generated by bombarding 6 MeV electrons on lead target was theoretically estimated by FLUKA code. Bremsstrahlung radiation can have energies exceeding the threshold of the particle emission, which is normally above 6 MeV. Photons of energies below the particle emission threshold undergo absorption into discrete energy levels, with possibility of exciting nuclei to excited state including metastable state. The ¹¹¹Cd (γ, γ`) ¹¹¹ᵐCd reaction cross sections were calculated at different energies of bombarding Photon by using the TALYS 1.8 computer code with a default parameter. The focus of the present work was to study the (γ,γ’) reaction for exciting ¹¹¹Cd nuclei to metastable states which have threshold energy below 3 MeV. The flux weighted average cross section was obtained from the theoretical values of TALYS 1.8 and TENDL 2017 and is found to be in good agreement with the present experimental cross section.Keywords: bremsstrahlung, cross section, FLUKA, TALYS-1.8

Abstract:
This paper presents experimental investigation and finite element analysis on buckling behavior of irregular section cold-formed steel columns under axially concentric loading. For the experimental study, four different sections of columns were tested to investigate effect of stiffening and width-to-thickness ratio on buckling behavior. For each of the section, three lengths of 230, 950 and 1900 mm. were studied representing short, intermediate long and long columns, respectively. Then, nonlinear finite element analyses of the tested columns were performed. The comparisons in terms of load-deformation response and buckling mode show good agreement and hence the FEM models were validated. Parametric study of stiffening element and thickness of 1.0, 1.15, 1.2, 1.5, 1.6 and 2.0 mm. were analyzed. The test results showed that stiffening effect pays a large contribution to prevent distortional mode. The increase in wall thickness enhanced buckling stress beyond the yielding strength in short and intermediate columns, but not for the long columns.Keywords: buckling behavior, irregular section, cold-formed steel, concentric loading

The high precision measurements and experiments play more and more important roles in particle physics and atomic physics. To analyse the precise experimental data sets, the corresponding precise and reliable theoretical calculations are necessary. Until now, the form factors of elemental constituents such as pion and proton are still attractive issues in current Quantum Chromodynamics (QCD). In this work, the two-photon-exchange (TPE) effects in ep→enπ⁺ at small -t are discussed within a hadronic model. Under the pion dominance approximation and the limit mₑ→0, the TPE contribution to the amplitude can be described by a scalar function. We calculate TPE contributions to the amplitude, and the unpolarized differential cross section with the only elastic intermediate state is considered. The results show that the TPE corrections to the unpolarized differential cross section are about from -4% to -20% at Q²=1-1.6 GeV². After considering the TPE corrections to the experimental data sets of unpolarized differential cross section, we analyze the TPE corrections to the separated cross sections σ(L,T,LT,TT). We find that the TPE corrections (at Q²=1-1.6 GeV²) to σL are about from -10% to -30%, to σT are about 20%, and to σ(LT,TT) are much larger. By these analyses, we conclude that the TPE contributions in ep→enπ⁺ at small -t are important to extract the separated cross sections σ(L,T,LT,TT) and the electromagnetic form factor of π⁺ in the experimental analysis.Keywords: differential cross section, form factor, hadronic, two-photon

Abstract:
Section 106(1)(h) of the South African Criminal Procedure Act 51 of 1977 provides that an accused may enter a special plea that the prosecutor does not have title to prosecute. In a seminal matter (S v Mousa 2021 2 SACR 378 (GJ)) regarding section 106(1)(h), certain interesting legal aspects emerged. The first aspect concerned the meaning of the term “prosecutor”. More specifically, the question arose whether the term included a prosecutor who was previously involved with the matter, as well as the relevant Deputy Director of Public Prosecutions (DDPP) who instituted the prosecution and oversaw the prosecution on behalf of the state. The meaning of the term “title”, and with regard to the conduct of the “prosecutor”, the term “abuse of process,” were also raised and decided. In the paper, the facts, and the arguments in, and the decisions of the court, are discussed critically. The author argue that the intended objection in section 106(1)(h) is not to cure the abuse inflicted by a previous prosecutor or by the DDPP. I point out that the term “title” includes a lack of authority, non-compliance with jurisdictional requirements or absence of locus standi. I also point out that an abuse of process takes place if the process is used for an improper, ulterior or collateral purpose. I also argue that the accused should, instead of relying on section 106(1)(h), have relied on the prior agreement and applied for a permanent stay of prosecution.Keywords: special plea, prosecutor, title, abuse of process
