2822 The Formulation of the Mecelle and Other Codified Laws in the Ottoman Empire: Transformation Overturning the Sharia Principles
Authors: Tianqi Yin
Abstract:
The sharia had been the legislative basis in the Ottoman Empire since its emergence. The authority of sharia was superlative in the Islamic society compared to the power of the sulta, the nominal ruler of the nation, regulating essentially every aspect of people’s lives according to an ethical code. In modernity, however, as European sovereignty employed forces to re-engineer the Islamic world to make it more like their own, a society ruled by a state, the Ottoman legislation system encountered a great challenge of adopting codified laws to replace sharia with the formulation of the Mecelle being a prominent case. Interpretations of this transformation have been contentious, with the key debate revolving around whether these codified laws are authentic representations of sharia or alien legal formulations authorized by the modern nation-state under heavy European colonial influence. Because of the difference in methodology of the diverse theories, challenges toward having a universal conclusion on this issue remain. This paper argues that the formulation of the Mecelle and other codified laws is a discontinuity of sharia due to European modernity’s influence and that the emphasis on elements of Islamic laws is a tactic employed to promote this process. These codified laws signals a complete social transformation from the Islamic society ruled by the sharia to a replication of the European society that is ruled by a comprehensive ruling system of the modern state. In addition to advancing the discussion on the characterization of the codification movement in the Ottoman Empire in modernity, the research also promotes the determination of the nature of the modern codification movement globally. Keywords: codification, mecelle, modernity, sharia, ottoman empire

Authors: Rihab Ben Lamine, Raoudha Ben Jemaa, Ikram Amous Ben Amor
Abstract:
This paper proposes a graph planning technique for semantic adaptable Web Services composition. First, we use an ontology based context model for extending Web Services descriptions with information about the most suitable context for its use. Then, we transform the composition problem into a semantic context aware graph planning problem to build the optimal service composition based on user's context. The construction of the planning graph is based on semantic context aware Web Service discovery that allows for each step to add most suitable Web Services in terms of semantic compatibility between the services parameters and their context similarity with the user's context. In the backward search step, semantic and contextual similarity scores are used to find best composed Web Services list. Finally, in the ranking step, a score is calculated for each best solution and a set of ranked solutions is returned to the user. Keywords: semantic web service, web service composition, adaptation, context, graph planning

Authors: Taknaz Banihashemi, Jiangang Fei, Peggy Shu-Ling Chen
Abstract:
Reverse logistics (RL) is a part of the logistics of companies and its aim is to reclaim value from the returned products in an environmentally friendly manner. In recent years, RL has attracted significant attention among both practitioners and academics due to environmental directives and governmental legislation, consumer concerns and social responsibilities for environment, awareness of the limits of natural resources and economic potential. Sustainability development is considered as a critical goal for organisations due to its impact on competitive advantage. With growing environmental concerns and legal regulations related to green and sustainability issues, product disposition through RL can be considered as an environmental, economic and social sound way to achieve sustainable development. When employed properly, RL can help firms to improve their sustainability performance. The aim of this paper is to investigate the sustainability issues in the context of RL in the perspective of the triple-bottom-line approach. Content analysis was used to collect the information. The findings show that there is a research gap to investigate the relationship between RL and sustainability performance. Most of the studies have focused on performance evaluation of RL by considering the factors related to economic and environmental performance. RL can have significant effects on social issues along with economic and environmental issues. The inclusion of the social aspect in the sustainability performance will provide a complete and holistic picture of how RL may impact on the sustainability performance of firms. Generally, there is a lack of research on investigating the relationship between RL and sustainability by integrating the three pillars of triple-bottom-line sustainability performance. This paper provides academics and researchers a broad view of the correlations between RL and sustainability performance. Keywords: verse Logistics, review, sustainability, sustainability performance
Procedia PDF Downloads 1542819 Ten Patterns of Organizational Misconduct and a Descriptive Model of Interactions
Authors: Ali Abbas
Abstract:
This paper presents a descriptive model of organizational misconduct based on observed patterns that occur before and after an ethical collapse. The patterns were classified by categorizing media articles in both "for-profit" and "not-for-profit" organizations. Based on the model parameters, the paper provides a descriptive model of various organizational deflection strategies under numerous scenarios, including situations where ethical complaints build-up, situations under which whistleblowers become more prevalent, situations where large scandals that relate to leadership occur, and strategies by which organizations deflect blame when pressure builds up or when media finds out. The model parameters start with the premise of a tolerance to double standards in unethical acts when conducted by leadership or by members of corporate governance. Following this premise, the model explains how organizations engage in discursive strategies to cover up the potential conflicts that arise, including secret agreements and weakening stakeholders who may oppose the organizational acts. Deflection strategies include "preemptive" and "post-complaint" secret agreements, absence of (or vague) documented procedures, engaging in blame and scapegoating, remaining silent on complaints until the media finds out, as well as being slow (if at all) to acknowledge misconduct and fast to cover it up. The results of this paper may be used to guide organizational leaders into the implications of such shortsighted strategies toward unethical acts, even if they are deemed legal. Validation of the model assumptions through numerous media articles is provided. Keywords: ethical decision making, prediction, scandals, organizational strategies

Authors: Francesco Arese Visconti
Abstract:
The purpose of this paper is to question the methodological challenges that practice-based research on recent Italian migrants in Switzerland can pose. The entire development of the work has moved from the theorization to the production and back in a continuous exchange which is at the base of failures and successful results. The theoretical background leads to reflect on practical solutions to produce photographic portraits in the attempt to depict the cultural identity of a specific population. Thus, a series of key points of this challenging, visual, and intimate journey are discussed and developed. While analyzing, in the first stance, the psychological challenges resulting from the encounter of the photographer, the sitter, and the spectator, the challenges of the representation of a group of people with individual photographic portraits will secondly be highlighted. The paper underlines how previous work can be precursory of subsequent research and why the inclusion of the landscape versus maintaining a neutral background has links with paintings from the Italian Renaissance. Keywords: photography, migration, Italians, Switzerland

Authors: Hafsat Iyabo Sa'adu
Abstract:
A salient feature of the Nigerian Tax Law is the right of the taxpayer to demand for a refund where excess tax is paid. Section 23 of the Federal Inland Revenue Service (Establishment) Act, 2007 vests Federal Inland Revenue Services with the power to make tax refund as well as set guidelines and requirements for refund process from time to time. In addition, Section 61 of the Federal Inland Revenue Service (Establishment) Act, 2007, empowers the Federal Inland Revenue Services to issue information circular to acquaint stakeholders with the policy on the refund process. A Circular was issued to that effect to correct the position that until after the annual audit of the Service before such excess can be paid to the claimant/taxpayer. But it is amazing that such circular issuance does not feature under the states’ laws. Hence, there is an inconsistencies in the tax paying system in Nigeria. This study, therefore, sets an objective, to examine the trending concept of tax refund in Nigeria. In order to achieve this set objective, a doctrinal study went under way, wherein both federal and states laws were consulted including journals and textbooks. At the end of the research, it was revealed that the law should be specific as to the time frame within which to make the refund. It further revealed that it is essential to put up a legal framework for the tax system to recognize excess payment as debt due from the state. This would provide a foundational framework for the relationship between taxpayers and Federal Inland Revenue Service as well as promote effective tax administration in all the states of the federation. Several Recommendations were made especially relating to legislative passage of ‘’Refund Circular Bill at the states levels’ pursuant to the Federal Inland Revenue Service (Establishment) Act, 2007.Keywords: claim, Nigeria, refund, right

Authors: N. Webb, A. Buchanan
Abstract:
Digital and virtual heritage is often associated with the recreation of lost artefacts and architecture; however, we can also investigate works that were not completed, using digital tools and techniques. Here we explore physical evidence of a fourteenth-century Gothic vault located in the north transept of St Mary’s church in Nantwich, Cheshire, using existing springer stones that are built into the walls as a starting point. Digital surveying tools are used to document the architecture, followed by an analysis process to hypothesise and simulate possible design solutions, had the vault been completed. A number of options, both two-dimensionally and three-dimensionally, are discussed based on comparison with examples of other contemporary vaults, thus adding another specimen to the corpus of vault designs. Dissemination methods such as digital models and 3D prints are also explored as possible resources for demonstrating what the finished vault might have looked like for heritage interpretation and other purposes. Keywords: digital simulation, heritage interpretation, medieval vaults, virtual heritage, 3d scanning

Authors: Oznur Ispir, S. Duygulu
Abstract:
Health institutions are the places where fast and efficient decisions are required and mistakes and uncertainties are not tolerated due to the urgency of the services provided within the body of these institutions. Thus, in those institutions where patient care services are targeted to be provided quality and safety, the nurses attending the decisions, creating the solutions for problems, taking initiative and bearing the responsibility of results in brief having the control over practices are needed. Control over nursing practices is defined as affecting the employment and work environment at the unit level of the institution, perceived freedom for organizing and evaluating nursing practices, the ability to make independent decisions about patient care and accountability for the results of such decisions. This study scrutinizes the concept of control over nursing practices (organizational autonomy), which is frequently confused with other concepts (autonomy) in the literature, by reviewing the literature and making suggestions to improve nurses’ control over nursing practices. Keywords: control over nursing practice, nurse, nursing, organizational autonomy
Procedia PDF Downloads 2662808 Co-payment Strategies for Chronic Medications: A Qualitative and Comparative Analysis at European Level
Authors: Pedro M. Abreu, Bruno R. Mendes
Abstract:
The management of pharmacotherapy and the process of dispensing medicines is becoming critical in clinical pharmacy due to the increase of incidence and prevalence of chronic diseases, the complexity and customization of therapeutic regimens, the introduction of innovative and more expensive medicines, the unbalanced relation between expenditure and revenue as well as due to the lack of rationalization associated with medication use. For these reasons, co-payments emerged in Europe in the 70s and have been applied over the past few years in healthcare. Co-payments lead to a rationing and rationalization of user’s access under healthcare services and products, and simultaneously, to a qualification and improvement of the services and products for the end-user. This analysis, under hospital practices particularly and co-payment strategies in general, was carried out on all the European regions and identified four reference countries, that apply repeatedly this tool and with different approaches. The structure, content and adaptation of European co-payments were analyzed through 7 qualitative attributes and 19 performance indicators, and the results expressed in a scorecard, allowing to conclude that the German models (total score of 68,2% and 63,6% in both elected co-payments) can collect more compliance and effectiveness, the English models (total score of 50%) can be more accessible, and the French models (total score of 50%) can be more adequate to the socio-economic and legal framework. Other European models did not show the same quality and/or performance, so were not taken as a standard in the future design of co-payments strategies. In this sense, we can see in the co-payments a strategy not only to moderate the consumption of healthcare products and services, but especially to improve them, as well as a strategy to increment the value that the end-user assigns to these services and products, such as medicines. Keywords: clinical pharmacy, co-payments, healthcare, medicines

Authors: Tonderai Muchenje, Xolani Mkhwanazi
Abstract:
Precision agriculture uses a number of technologies, devices, protocols, and computing paradigms to optimize agricultural processes. Big data, artificial intelligence, cloud computing, and edge computing are all used to handle the huge amounts of data generated by precision agriculture. However, precision agriculture is still emerging and has a low level of security features. Furthermore, future solutions will demand data availability and accuracy as key points to help farmers, and security is important to build robust and efficient systems. Since precision agriculture comprises a wide variety and quantity of resources, security addresses issues such as compatibility, constrained resources, and massive data. Moreover, conventional protection schemes used in the traditional internet may not be useful for agricultural systems, creating extra demands and opportunities. Therefore, this paper aims at reviewing state of the art of precision agriculture security, particularly in open field agriculture, discussing its architecture, describing security issues, and presenting the major challenges and future directions. Keywords: precision agriculture, security, IoT, EIDE

Authors: Rurui Liu
Abstract:
Universities have been one of the most important institutions in society. They shoulder the responsibility to do research and teach further generations. Therefore, the governance of universities has been a heated topic and has been learned for years. Recently, it witnessed great changes, for example, the massification of Higher Education, marketization, and privatization. As a result, more stakeholders are involved in the governance of Higher Education, among which students’ participation in HE becomes more important. However, the research about students’ participation in HE governance in China is not sufficient, and the situation requires improvement. The paper aims to not only fill in the research gap but also put forward practical suggestions to follow the world’s trend of HE governance. The methodology of this paper is literature analysis with comparative studies between China and western countries. The research points out that the current situation of students’ participation in HE governance is unideal due to problems in three fields, values and concepts, mechanisms and systems, as well as student unions. Then, the policy implications are based on these reasons: universities should highlight students’ status, respect their subjectivity and adhere to the service awareness; the government requires to build a sound legal system while universities should establish complete mechanisms and systems; student unions should be encouraged by universities to take part in HE governance affairs with sufficient funds, and autonomy. On the one hand, this paper is a further application of four rationales (consumerism, political-realism, communitarian, democracy, and consequentialism) created by Luescher‐Mamashela for the inevitable trend of students’ participation in HE governance. On the other hand, the suggestions it made benefit the students, universities, and society in practical ways. Keywords: students’ participation, higher education governance, Chinese higher education, university power

Abstract:
Broccoli is considered as being a rich source of AOX like flavonoids, polyphenols, anthocyanins etc. and of major interest especially in the organic sector. However, AOX is environment dependent and often varies between cultivars. Aim of the study was to investigate the impact of cultivar and harvest date on AOX in broccoli. Activity of the AOX was determined using a Photochem®-Analyzer and a kit of reagent solutions for analysis. Results of the study showed that the lipid (ACL) and water-soluble antioxidant potential (AWC) of broccoli heads varied significantly between the four harvesting dates, but not among the different cultivars. The highest concentration of ACL was measured in broccoli heads harvested in September 2011, followed by heads harvested at the beginning of July in 2012. ACW was highest in heads harvested in October 2011. Lowest concentrations of ACW were measured in heads harvested in June 2012. Overall, the study indicated that the harvest date and thus growing conditions seem to be of high importance for final antioxidant capacity of broccoli. Keywords: broccoli, open-pollinating, harvest date, epidemiological studies

Authors: Yasaman Tabari-Saadi, Kaiwen Sun, Jialiang Huang, Martin Green, Xiaojing Hao
Abstract:
Optical and electrical properties of p-type AgBiS₂ absorber material have been improved by copper doping on silver sites. X-Ray diffraction (XRD) and X-ray photoelectron spectroscopy (XPS) analysis suggest that complete solid solutions of Ag₁₋ₓCuₓBiS₂ thin film have been formed. The carrier concentration of pure AgBiS₂ thin film deposited by the chemical process is 4.5*E+14 cm⁻³, and copper doping leads to the improved carrier concentration despite the semiconductor AgBiS₂ remains p-type semiconductor. Copper doping directly changed the absorption coefficient and increased the optical band gap (~1.5eV), which makes it a promising absorber for thin-film solar cell applications. Keywords: copper doped, AgBiS₂, thin-film solar cell, carrier concentration, p-type semiconductor

Authors: Umweni Osahon Joshua, Anton Ianakiev
Abstract:
Deployable structures have been used in various scenarios from moving roofs in stadia, space antennae or booms. There has been a lot of literature relating deployable structures but with main focus on space applications. The complexities in the design of deployable structures may be the reason only few have been constructed for earth based solutions. This paper intends to explore the possibilities of integrating sustainable design concepts in deployable structures. Key aspects of sustainable design of structures as applicable to deployable structures have not been explored. Sustainable design of structures have mainly been concerned with static structures in the built environment. However, very little literature, concepts or framework has been drafted as it relates to deployable structures or their integration to static structures as a model for sustainable design. This article seeks to address this flaw in sustainable design for structural engineering and to provide a framework for designing structures in a sustainable manner. This framework will apply to deployable structures for earth-based environments as a form of disaster relief measures and also as part of static structures in the built environment. Keywords: deployable structures, sustainable design, framework, earth-based environments

Authors: Akram Alfantazi, Tirdad Nickchi
Abstract:
Magnesium galvanic corrosion plays an important role in the commercialization of Mg alloys in the automobile industry. This study aims at visualizing the electrochemical activity of the magnesium surface being coupled with pure iron in sulfate-chloride solutions. Scanning electrochemical microscopy was used to monitor the chemical activity of the surface and the data was compared with the conventional corrosion results such as potentiodynamic polarization, linear polarization, and immersion tests. The SECM results showed that the chemical reactivity of Mg is higher than phosphate-permanganate-coated Mg. Regions in the vicinity of the galvanic couple boundary are very active in the magnesium phase and fully protected in the iron phase. Scanning electrochemical microscopy results showed that the conversion coating provided good corrosion resistance for magnesium in the short-term but fails at long-term testing. Keywords: corrosion, galvanic corrosion, magnesium, scanning electrochemical microscopy

With the new consequences and challenges our world today, such as global climate change, the use of non-renewable resources, environmental pollution, the decreasing of urban health, the urban areas’ aging, the highly increasing migrations into urban areas linked to many consequences such as highly infrastructure density, social segregation. All of that required new forms of governance, new urban policies, and more efficient efforts and urban applications. Based on the fact that cities are the core of life and it is a fundamental life axis, their development can increase or decrease the life quality of their inhabitants. Architects and planners see themselves today in the need to create new approaches and new sustainable policies to develop urban areas to correspond with the physical and non-physical transformations that cities are nowadays experiencing. To enhance people's lives and provide for their needs in this present without compromising the needs and lives of future generations. The application of sustainability has become an inescapable part of the development and projections of cities' planning. Yet its definition has been indefinable due to the plurality and difference of its applications. As the conceptualizations of technology are arising and have dominated all life aspects today, from smart citizens and smart life rhythms to smart production and smart structures to smart frameworks, it has influenced the sustainability applications as well in the planning and urbanization of cities. The term "smart city" emerged from this influence as one of the possible key solutions to sustainability. The term “smart city” has various perspectives of applications and definitions in the literature and in urban applications. However, after the observation of smart city applications in current cities, this paper defined the smart city as an urban environment that is controlled by technologies yet lacks the physical architectural representation of this smartness as the current smart applications are mostly obscured from the public as they are applied now on a diminutive scale and highly integrated into the built environment. Regardless of the importance of these technologies in improving the quality of people's lives and in facing cities' challenges, it is important not to neglect their architectural and urban presentations will affect the shaping and development of city neighborhoods. By investigating the concept of smart cities and exploring its potential applications on a neighbourhood scale, this paper aims to shed light on understanding the challenges faced by cities and exploring innovative solutions such as smart city applications in urban mobility and how they affect the different aspects of communities. The paper aims to shape better articulations of smart neighborhoods’ morphologies on the social, architectural, functional, and material levels. To understand how to create more sustainable and liveable future approaches to developing urban environments inside cities. The findings of this paper will contribute to ongoing discussions and efforts in achieving sustainable urban development. Keywords: sustainability, urban development, smart city, resilience, sense of belonging

Abstract:
A severe injury to a peripheral nerve leads to its degeneration and the loss of sensory and motor function. To this day, there still lacks a more effective alternative to the autograft which has long been considered the gold standard for nerve repair. In order to overcome the numerous drawbacks of the autograft, tissue engineered biomaterials may be effective alternatives. Silk fibroin is a favorable biomaterial due to its many advantageous properties such as its biocompatibility, its biodegradability, and its robust mechanical properties. In this study, bio-mimicking multi-channeled nerve guidance conduits made of aligned nanofibers achieved by electrospinning were functionalized with signaling biomolecules and were tested in vitro and in vivo for nerve regeneration support. Silk fibroin (SF) extracted directly from silkworm cocoons was put in solution at a concentration of 10wt%. Poly(ethylene oxide) (PEO) was added to the resulting SF solution to increase solution viscosity and the following three electrospinning solutions were made: (1) SF/PEO solution, (2) SF/PEO solution with nerve growth factor and ciliary neurotrophic factor, and (3) SF/PEO solution with nerve growth factor and neurotrophin-3. Each of these solutions was electrospun into a multi-layer architecture to obtain mechanically optimized aligned nanofibrous mats. For in vitro studies, aligned fibers were treated to induce β-sheet formation and thoroughly rinsed to eliminate presence of PEO. Each material was tested using rat embryo neuron cultures to evaluate neurite extension and the interaction with bio-functionalized or non-functionalized aligned fibers. For in vivo studies, the mats were rolled into 5mm long multi-, micro-channeled conduits then treated and thoroughly rinsed. The conduits were each subsequently implanted between a severed rat sciatic nerve. The effectiveness of nerve repair over a period of 8 months was extensively evaluated by cross-referencing electrophysiological, histological, and movement analysis results to comprehensively evaluate the progression of nerve repair. In vitro results show a more favorable interaction between growing neurons and bio-functionalized silk fibers compared to pure silk fibers. Neurites can also be seen having extended unidirectionally along the alignment of the nanofibers which confirms a guidance factor for the electrospun material. The in vivo study has produced positive results for the regeneration of the sciatic nerve over the length of the study, showing contrasts between the bio-functionalized material and the non-functionalized material along with comparisons to the experimental control. Nerve regeneration has been evaluated not only by histological analysis, but also by electrophysiological assessment and motion analysis of two separate natural movements. By studying these three components in parallel, the most comprehensive evaluation of nerve repair for the conduit designs can be made which can, therefore, more accurately depict their overall effectiveness. Authors: Colette Malyack, Pius Egbelu
Abstract:
Business-to-Customer (B2C) delivery options have improved to meet increased demand in recent years. The change in end users has forced logistics networks to focus on customer service and sentiment that would have previously been the priority of the company or organization of origin. This has led to increased pressure on logistics companies to extend traditional B2B networks into a B2C solution while accommodating additional costs, roadblocks, and customer sentiment; the result has been the creation of the omnichannel delivery network encompassing a number of traditional and modern methods of package delivery. In this paper the many solutions within the omnichannel delivery network are defined and discussed. It can be seen through this analysis that the omnichannel delivery network can be applied to reduce the complexity of package delivery and provide customers with more options. Applied correctly the result is a reduction in cost to the logistics company over time, even with an initial increase in cost to obtain the technology. Keywords: network planning, last mile delivery, omnichannel delivery network, omnichannel logistics
