5077 The Defence of Loss of Control within the Coroners and Justice Act 2009: A Critical Discussion
Authors: Bader A. J. Alrajhi
Abstract:
The 'loss of control' defence to murder as enacted in the Coroners and Justice Act 2009 (CJA) represents a legislative effort to bring greater coherence to an aspect of UK homicide law that has vexed several generations of jurists, practitioners, and academic commentators. The analysis developed in this paper illustrates that the loss of control defence as defined in CJA sections 54 and 55 is a laudable initiative; its fuller assessment must await further appellate court determination before a definitive conclusion of its utility is possible. The CJA amendments tend to embrace a legitimate policy that those who found to be provoked by the activities of others to lose their self-control should be dealt with in a different way than those who commit intentional killings when motivated by their own desires or pursuit of gain. However, the 2012 Court of Appeal decisions rendered in the Parker troika of cases, provide useful direction as to how the law is likely to be applied. It shows an attitude in the Court of Appeal that the whole circumstances that challenged the defendant must be examined. The Court of Appeal has introduced an important ingredient into the potential use of sexual infidelity as a section 55 trigger - it is not a permissible stand-alone factor, but it may legitimately form part of an entire qualifying trigger circumstance. Keywords: loss of self-control, Coroners and Justice Act 2009, provocation, diminished responsibility

Procedia PDF Downloads 4185075 Exploring the Implementation of Building Information Modelling Level 2 in the UK Construction Industry: The Case of Small and Medium-Sized Enterprises
Authors: Khaled Abu Awwad, Abdussalam Shibani, Michel Ghostin
Abstract:
In the last few years, building information modelling (BIM) has been acknowledged as a new technology capable of transforming the construction sector to a collaborated industry. The implementation of BIM in the United Kingdom (UK) construction sector has increased significantly in the last decade, particularly after the UK government mandated the use of BIM in all public projects by 2016. Despite this, there are many indicators that BIM implementation is the main concern for large companies, while small and medium-sized enterprises (SMEs) are lagging behind in adopting and implementing this new technology. This slow adoption of BIM leads to an uncompetitive disadvantage in public projects and possible private projects. On the other hand, there is limited research focusing on the implementation of BIM Level 2 within SMEs. Therefore, the aim of this study is to bridge this gap and provide a conceptual framework to aid SMEs in implementing BIM Level 2. This framework is a result of interpreting qualitative data obtained by conducting semi-structured interviews with BIM experts in the UK construction industry. Keywords: building information modelling, critical success factors, small and medium-sized enterprises, United Kingdom
Procedia PDF Downloads 2125074 Sustainability of Carbon Nanotube-Reinforced Concrete
Authors: Rashad Al Araj, Adil K. Tamimi
Abstract:
Concrete, despite being one of the most produced materials in the world, still has weaknesses and drawbacks. Significant concern of the cementitious materials in structural applications is their quasi-brittle behavior, which causes the material to crack and lose its durability. One of the very recently proposed mitigations for this problem is the implementation of nanotechnology in the concrete mix by adding carbon nanotubes (CNTs) to it. CNTs can enhance the critical mechanical properties of concrete as a structural material. Thus, this paper demonstrates a state-of-the-art review of reinforcing concrete with CNTs, emphasizing on the structural performance. It also goes over the properties of CNTs alone, the present methods and costs associated with producing them, the possible special applications of concretes reinforced with CNTs, the key challenges and drawbacks that this new technology still encounters, and the most reliable practices and methodologies to produce CNT-reinforced concrete in the lab. This work has shown that the addition of CNTs to the concrete mix in percentages as low as 0.25% weight of cement could increase the flexural strength and toughness of concrete by more than 45% and 25%, respectively, and enhance other durability-related properties, given that an effective dispersion of CNTs in the cementitious mix is achieved. Since nano reinforcement for cementitious materials is a new technology, many challenges have to be tackled before it becomes practiced at the mass level. Keywords: sustainability, carbon nano tube, microsilica, concrete

Authors: H. Loumi-Fergane, A. Belaidi
Abstract:
The problem of symmetries in field theory has been analyzed using geometric frameworks, such as the multisymplectic models by using in particular the multivector field formalism. In this paper, we expand the vector fields associated to infinitesimal symmetries which give rise to invariant quantities as Noether currents for classical field theories and relativistic mechanic using the multisymplectic geometry where the Poincaré-Cartan form has thus been greatly simplified using the Second Order Partial Differential Equation (SOPDE) for multi-vector fields verifying Euler equations. These symmetries have been classified naturally according to the construction of the fiber bundle used. In this work, unlike other works using the analytical method, our geometric model has allowed us firstly to distinguish the angular moments of the gauge field obtained during different transformations while these moments are gathered in a single expression and are obtained during a rotation in the Minkowsky space. Secondly, no conditions are imposed on the Lagrangian of the mechanics with respect to its dependence in time and in qi, the currents obtained naturally from the transformations are respectively the energy and the momentum of the system. Keywords: conservation laws, field theories, multisymplectic geometry, relativistic mechanics

Authors: Sadia Arshad
Abstract:
The new coronavirus disease or COVID-19 still poses an alarming situation around the world. Modeling based on the derivative of fractional order is relatively important to capture real-world problems and to analyze the realistic situation of the proposed model. Weproposed a mathematical model for the investigation of COVID-19 dynamics in a generalized fractional framework. The new model is formulated in the Caputo sense and employs a nonlinear time-varying transmission rate. The existence and uniqueness solutions of the fractional order derivative have been studied using the fixed-point theory. The associated dynamical behaviors are discussed in terms of equilibrium, stability, and basic reproduction number. For the purpose of numerical implementation, an effcient approximation scheme is also employed to solve the fractional COVID-19 model. Numerical simulations are reported for various fractional orders, and simulation results are compared with a real case of COVID-19 pandemic. According to the comparative results with real data, we find the best value of fractional orderand justify the use of the fractional concept in the mathematical modelling, for the new fractional modelsimulates the reality more accurately than the other classical frameworks. Keywords: fractional calculus, modeling, stability, numerical solution

Procedia PDF Downloads 785065 Creating Coherence: Lessons from Bali on Achieving a Coherent Life Through Service
Authors: Veronica Basilio, Shuting Palomo
Abstract:
This research paper explores the psychological concept of coherence and wellbeing. In particular, we focus on the relationship between individual well-being and community development. The focus setting for the research is Bali, Indonesia. The major finding of our research is: a coherent life can be achieved through living a life motivated by service to others, which contributes to community development and wellbeing. Coherence occurs when values are consistent with one’s thoughts, words, and actions. According to Antonovsky’s salutogenic theory, a sense of coherence is significant to psychological well-being. The ability to cope with life’s stressors is based on how comprehensive, manageable, and meaningful one’s sense of coherence is. The methodology for the research draws on an ethnographic approach with particular attention to participant observation and in-depth interviews within the context of village and family life in Bali. The research highlights Viktor Frankl’s ideas on self-actualization that is achieved through a life of service to others. The research also focuses on the individual’s ability to shift their perspective in the face of adversity, which contributes to individual development. Through personal transformation, one can be committed to serving others, which in the end, is the foundation of a coherent life and community development. Keywords: psychology, bali, coherence, well-being, sociology

Authors: Kun-Ting Song, Christian Schott, Peter Schneider, Sebastian Watzele, Regina Kluge, Elena Gubanova, Aliaksandr S. Bandarenka
Abstract:
The combination of electrochemical impedance spectroscopy (EIS) and the hydrodynamic technique like rotation disc electrode (RDE) provides a critical method for quantitively investigating mechanisms of hydrogen evolution reaction (HER) in acidic and alkaline media. Pt5Gd represented higher HER activities than polycrystalline Pt (Pt(pc)) by means of the surface strain effects. The model of the equivalent electric circuit to fit the impedance data under the RDE configurations is developed. To investigate the relative reaction contribution, the ratio of the charge transfer reactions of the Volmer-Heyrovsky and Volmer-Tafel pathways on Pt and Pt5Gd electrodes is determined. The ratio remains comparably similar in acidic media, but it changes in alkaline media with Volmer–Heyrovsky pathway dominating. This combined approach of EIS and RDE can help to study the electrolyte effects and other essential reactions for electrocatalysis in future work. Keywords: hydrogen evolution reaction, electrochemical impedance spectroscopy, hydrodynamic methods, electrocatalysis, electrochemical interface
Procedia PDF Downloads 905063 The Evaluation of a Mobile Proximity Payment Application through Its Legitimacy and Social Acceptability
Authors: Intissar Abbes, Yousra Hallem, Jean-michel Sahut
Abstract:
The purpose of this research is to explore the legitimacy of a proximity mobile payment (PMP) system by taking into account the social aspects related to its use (social acceptability). We have chosen to focus on the acceptability process of a PMP application (‘Flashplay’) from the first testing to the adoption in a service context. This PMP solution is a pilot program developed as part of a global strategy of disintermediation in various sectors (retail, catering, and entertainment). This case is particularly interesting for two reasons: the context and environment are suitable to the adoption of innovation in payment like other African countries and the possibility to study different stages of the social acceptability process of that PMP system. The neo-institutional theory is mobilized to identify the three pillars of legitimacy: cognitive, normative and regulatory. A longitudinal qualitative study was conducted with 27 customers using the PMP service. Results highlighted the importance of the consumption system and the service provider as institutions. Recommendations are thus proposed to PMP service providers in order to rethink the design and implementation strategies of their PMP system to ensure their adoption and promote the institutionalization of this type of consumption practice. Keywords: legitimacy, payment, acceptability, mobility

Authors: Benjamin Morse, Michaela Zint, Jennifer Carman
Abstract:
This study proposes a behavioral model in which ecotourists’ level of observational learning shapes their subsequent environmentally responsible behavioral intentions through ecotourism participation. Unlike past studies that have focused on individual attributes such as attitudes, locus of control, personal responsibility, knowledge, skills or effect, this present study explores select social attributes as potential antecedents to environmentally responsible behaviors. A total of 207 completed questionnaires were obtained from ecotourists in Korea and path analyses were conducted to explore the degree in which the hypothesized model directly and indirectly explained ecotourists’ environmentally responsible behavioral intentions. Results suggest that observational learning and its associated predictors (i.e., engagement, observation, reproduction and reinforcement) are key determinants of ecotourists environmentally responsible behavioral intentions. The application of observational learning proved to be informative, and has a number of implications for improving ecotourism programs. Our model also lays out a theoretical framework for future research. Keywords: ecotourism, observational learning, environmentally responsible behavior, social learning theory

Authors: Hsiao-Yung Wang
Abstract:
This paper aims to elaborate the standpoint of neo-Marxism of Russian philosopher Mikhail Bakhtin by critical reading his concept of Bildungsroman; thereby, it aims to map the theoretical implication of spatial rhetoric and its time politics/emancipatory politics in late Bakhtin’s thought. First, it aims to outline the two revolving rings of spatiality in Bildungsroman, proceeding from 'recollecting the past' to 'foreseeing the future' on the basis of visuality and materialistic realism. Herein, Bakhtin has temporarily been leaving his previous research concern on polyphonic novel. Second, it aims to demonstrate that although Bakhtin has constantly emphasized the necessity of reconstructing opened future space, his insistence on 'emergence' has still generated a seemingly theoretical lacuna which needs to be filled. 'Doubled heterotopia,' as popularized by contemporary rhetorician Saindon, might be an adequate approach to articulate and present the rhetorical functions and dynamics of Bakhtin’s spatial rhetoric dialectically. Based on the research findings, this paper argues that Bakhtin indeed attempted to go beyond the deterministic model of Marxism and neo-Marxism strategically and reciprocally. Keywords: Bildungsroman, double heterotopia, emergence, Mikhail Bakhtin, neo-Marxism, spatial rhetoric, time-politics, visuality
Procedia PDF Downloads 2665060 Exploring the Impact of Additive Manufacturing on Supply Chains: A Game-Theoretic Analysis of Manufacturer-Retailer Dynamics
Authors: Mohammad Ebrahim Arbabian
Abstract:
This paper investigates the impact of 3D printing, also known as additive manufacturing, on a multi-item supply chain comprising a manufacturer and retailer. Operating under a wholesale-price contract and catering to stochastic customer demand, this study delves into the largely unexplored realm of how 3D printing technology reshapes supply chain dynamics. A distinguishing aspect of 3D printing is its versatility in producing various product types, yet its slower production pace compared to traditional methods poses a challenge. We analyze the trade-off between 3D printing's limited capacity and its enhancement of production flexibility. By delineating the economic circumstances favoring 3D printing adoption by the manufacturer, we establish the Stackelberg equilibrium in the retailer-manufacturer game. Additionally, we determine optimal order quantities for the retailer considering 3D printing as an option for the manufacturer, ascertain optimal wholesale prices in the presence of 3D printing, and compute optimal profits for both parties involved in the supply chain. Keywords: additive manufacturing, supply chain management, contract theory, Stackelberg game, optimization

Authors: Hossein Mardani, Neil Buchanan, Robert Cahill, Vincent Fusco
Abstract:
In this paper, we study the input impedance characteristics of axial mode helical antennas to find an effective way for matching it to 50 Ω. The study is done on the important matching parameters such as like wire diameter and helix to the ground plane gap. It is intended that these parameters control the matching without detrimentally affecting the radiation pattern. Using transmission line theory, a simple broadband technique is proposed, which is applicable for perfect matching of antennas with similar design parameters. We provide design curves to help to choose the proper dimensions of the matching section based on the antenna’s unmatched input impedance. Finally, using the proposed technique, a 4-turn axial mode helix is designed at 2.5 GHz center frequency and the measurement results of the manufactured antenna will be included. This parametric study gives a good insight into the input impedance characteristics of axial mode helical antennas and the proposed impedance matching approach provides a simple, useful method for matching these types of antennas. Keywords: antenna, helix, helical, axial mode, wireless power transfer, impedance matching

Authors: V. Sathya Narayanan, P. Sidharth, V. R. Sanal Kumar
Abstract:
The success of any retail business is predisposed by its swift response and its knack in understanding the constraints and the requirements of customers. In this paper a conceptual design model of an automated customer-friendly supermarket has been proposed. In this model a 10-sided, space benefited, regular polygon shaped gravity shelves have been designed for goods storage and effective customer-specific algorithms have been built-in for quick automatic delivery of the randomly listed goods. The algorithm is developed with two main objectives, viz., delivery time and priority. For meeting these objectives the randomly listed items are reorganized according to the critical-path of the robotic arm specific to the identified shop and its layout and the items are categorized according to the demand, shape, size, similarity and nature of the product for an efficient pick-up, packing and delivery process. We conjectured that the proposed automated supermarket model reduces business operating costs with much customer satisfaction warranting a win-win situation. Keywords: automated supermarket, electronic shopping, polygon-shaped rack, shortest path algorithm for shopping

Authors: Kenichiro Hida, Shin-Ichi Kuribayashi
Abstract:
In a conventional network, most network devices, such as routers, are dedicated devices that do not have much variation in capacity. In recent years, a new concept of network functions virtualisation (NFV) has come into use. The intention is to implement a variety of network functions with software on general-purpose servers and this allows the network operator to select their capacities and locations without any constraints. This paper focuses on the allocation of NFV-based routing functions which are one of critical network functions, and presents the virtual routing function allocation algorithm that minimizes the total power consumption. In addition, this study presents the useful allocation policy of virtual routing functions, based on an evaluation with a ladder-shaped network model. This policy takes the ratio of the power consumption of a routing function to that of a circuit and traffic distribution between areas into consideration. Furthermore, the present paper shows that there are cases where the use of NFV-based routing functions makes it possible to reduce the total power consumption dramatically, in comparison to a conventional network, in which it is not economically viable to distribute small-capacity routing functions. Keywords: NFV, resource allocation, virtual routing function, minimum power consumption

Authors: Ryo Sato
Abstract:
The United States and many other countries witness alarmingly low voting rates among youths, skewing democratic representation. Many scholars and pundits have ascribed to this trend young voters' laziness, indifference, and self-centeredness and placed blame on them. However, a growing body of research is focusing on structural barriers to voting, which are defined as built-in obstacles lying in electoral laws and procedures. Drawing on national survey data from 891 young adults in 2020 and extant literature on structural barriers to voting, the project aims to develop a framework for analyzing systematic obstacles to voting experienced by young people and offer tangible policy recommendations. The preliminary findings presented at this conference include an intersectional analysis of the survey data, focusing on how different social categories — race, gender, socioeconomic status, immigration status, and others — in combination create unique voting experiences and barriers. This project offers a critical framework to combat the individualized understanding of low voting rates among youths and inform pathways to functional democracy. Keywords: youth voting behavior, structural barriers, intersectionality, democratic participation, S

Authors: Ali Hamza, Bertug Akintug
Abstract:
Having an appropriate plan of sanitation systems is one of the critical issues for global urban slums. Poor sanitation systems in urban slums outcomes an enhanced vulnerability of severe diseases, low hygiene and environmental risks within our environment. Mentioning human excreta being one of the most highly risked pollutants among all the other major contributors of sanitation pollutants is increasing public health risks and amounts of pollution loads within the slum environment. Higher population growth, urge of urbanization and illegal status of urban slums makes it impossible to increase the level of performance of sanitation systems in urban slums. According to Sustainable Sanitation Alliance, design parameters for sanitation systems were set up to ensure sustainable environment. This paper reviews the characteristics of human excreta at present, treatment technologies, and procedures of processes that can be adopted feasibly in the urban slums. Keeping these factors as our significant concern of study, assessment of sustainable sanitation systems is done using sanitation chain concept in accordance to the pre-determined sustainability indicators and criteria which reflect the potential and feasible application of waterless sanitation systems bringing sustainable sanitation systems in urban slums. Keywords: human excreta, sanitation chain, sustainable sanitation systems, urban slums

Authors: Montaceur Zaghdoud, Mohamed Moussaoui, Jalel Akaichi
Abstract:
Frequent subgraph mining refers usually to graph matching and it is widely used in when analyzing big data with large graphs. A lot of research works dealt with structural exact or inexact graph matching but a little attention is paid to semantic matching when graph vertices and/or edges are attributed and typed. Therefore, it seems very interesting to integrate background knowledge into the analysis and that extracted frequent subgraphs should become more pruned by applying a new semantic filter instead of using only structural similarity in graph matching process. Consequently, this paper focuses on developing a new hybrid approximate structuralsemantic graph matching to discover a set of frequent subgraphs. It uses simultaneously an approximate structural similarity function based on graph edit distance function and a possibilistic vertices similarity function based on affinity function. Both structural and semantic filters contribute together to prune extracted frequent set. Indeed, new hybrid structural-semantic frequent subgraph mining approach searches will be suitable to be applied to several application such as community detection in social networks. Keywords: approximate graph matching, hybrid frequent subgraph mining, graph mining, possibility theory

Despite their high visibility in informal labor markets, their undocumented status renders them invisible in everyday life. Their invisibility in both official status and social life, coupled with their vulnerability to exploitation in the labor market, renders them particularly susceptible to marginalization. This research employs the concept of the subaltern to examine the characteristics of Afghan migrants as unrepresented, unheard, and invisible. It also analyzes their experiences in the labor market based on the concept of biopolitics. Undocumented Afghan migrants are engaged in labor-intensive occupations such as shepherding, thereby addressing an essential gap in the workforce that local workers are reluctant to undertake. The reliance of employers on the labor of these employees is significant; however, the undocumented status of these workers leaves them vulnerable to exploitation. In addition to serving as a critical source of low-cost labor, these individuals are susceptible to exploitation in the form of non-payment for their work, extended and intensive work schedules, and, on some occasions, physical violence. In the event of a conflict between shepherds and their employers, undocumented workers are unable to seek legal recourse, which serves to reinforce their marginalized status further. The predominant practice among Afghan shepherds is to utilize the workplace as a place of residence. In the context of shepherding work, the prevailing conditions at the workplace frequently pose a significant threat to the health and well-being of the individuals engaged in such activities. As a result of their lack of official status, these individuals lack access to basic services such as healthcare, which has the consequence of rendering them invisible in public and institutional spaces. Attempts to engage with public systems carry the risk of deportation, reinforcing the already fragile and precarious nature of their existence. This study examines the socio-political implications of undocumented status and addresses these experiences in the context of national and international migration policies. In line with Agamben's concept of the "state of exception" undocumented migrants exist in a state where fundamental rights are effectively nullified, and they are rendered outside the protection of the law. This exclusion is further exacerbated by the intersection of economic exploitation, political and physical invisibility, and limited access to basic services, which collectively contribute to a cycle of vulnerability. This research is based on in-depth interviews with 18 Afghan shepherds in Igdir province in August 2024. The research contributes to the ongoing critical debates on migration, labor exploitation, and biopolitics by focusing on the experiences of Afghan shepherds. The article examines how undocumented migrants maneuver between visibility and invisibility within the context of a system that relies on exploitation in the labor market and migration policies. The research findings demonstrate the necessity for policy intervention to address the structural exclusion of undocumented Afghan migrants from national and international protection systems, as well as their indispensable role in local economies. Keywords: Afghan migrants, biopolitics, border economy, informal labour market, migration policy, sheepherding, Subaltern

Authors: Mohammad E. Nikoofal, Mehmet Gumus
Abstract:
Besides the many benefits of outsourcing, firms are still concerned about the lack of critical information regarding both the risk levels and actions of their suppliers that are just a few links away. In this paper, we study the effectiveness of audit for the manufacturer in managing her supplier’s process improvement effort when the supplier is privately informed about his disruption risk and actions. By comparing the agency costs associated with the optimal menu of contracts with and without audit, we completely characterize the value of audit for all the cases from the perspectives of both manufacturer, and supplier as well as total supply chain. First, the analysis of value of audit from the manufacturer’s perspective shows that she can strictly benefit from auditing her supplier’s actions. To the best of our knowledge, this result has not been documented before in the principal-agent literature under a standard setting where the agent is assumed to be risk-neutral and not protected by limited liability constraints. Second, we find that not only the manufacturer but also the supplier can strictly benefit from audit. Third, the audit enables the manufacturer to customize her contract offerings based on the reliability of the supplier. Finally, by analyzing the impact of problem parameters on the value of audit, we identify the conditions under which an audit would be beneficial for individual supply chain parties as well as total supply chain. Keywords: supply disruption, adverse selection, moral hazard incentives, audit
