3887 Criminal Protection Objectivity of the Child's Right to Life and Physical and Psychological Safety

Abstract:
Nowadays, child affairs is a matter of both national and international interests. This issue is regarded a vital topic for various scientific fields across ages, and for all the communities without exception. However, the nature of child caring may vary due to the verities in science perspectives. So, considering child's affairs from different perspectives is helpful to have a complementary image about this matter. The purpose behind selecting this topic is to keep a balance between the victim on the one hand, and the guardian and the offender on the other hand, (i.e.) to avoid any kind of excessiveness either in the protection of the child and its rights not in the punishment of the offender. This is achieved through considering various legal materials in the Iraqi legislation and in the comparative legislations that are concerned with the child's issue and the extent to which the child makes use of these rights. The scope of this study involves the crimes that are considered as aggressions against the child's right to life, and the crimes that are dangerous to their physical and psychological safety. So, this study comprehensively considers the intentional murder of child, child murder to avoid disgrace, child kidnapping, child abandonment, physical abuse for the sake of punishment or not, child circumcision, verbal violence, and abstaining from leaving a child with a person who has the right of custody. This study ends with the most significant concluding points that have been derived throughout this study, which are: Unlike the Iraqi legislation, the Egyptian legislation defines the child in the Article 2 of the Child Law No. 12 of 1996 amended by the Law No. 126 of 2008 that the child is a person who does not exceed 18 years of age. Some legislation does not provide special criminal protection for child intentional murder, as in the Iraqi and the Egyptian legislation. However, some others have provided special criminal protection for a child, as in French and Syrian legislations. Child kidnapping is regarded as one of the most dangerous crimes that affects the child and the family as well, as it may expose the child's life to danger or to death. The most significant recommendations from the researcher are: The Iraqi legislation is recommended to take the necessary measures to establish a particular legislation for the child by including all the legal provisions that are associated with this weak creature, and make use of the Egyptian legislator’s experience as a pioneer in this respect. Both the Iraqi legislation and the Egyptian legislation are recommended to enact special laws to protect a child from the crimes of intentional murder, as the crime of child murder is currently subjected to the same provisions consider for adult murder.Keywords: child, criminal, penal, law, safety

Abstract:
Latin America is marked by its history: conquest, colonialism, and slavery left deep footprints in most Latin American countries. Also, the past century has been affected by wars, military dictatorships, and political violence, which profoundly influenced Latin American popular culture. Consequently, reminiscences of historical crimes are frequently present in daily life, media, public opinion, and arts. This legacy is remembered in novels, paintings, songs, and films. In fact, Latin American cinema has a trend which refers to the verisimilitude with reality in fiction films. These films about historical violence are narrated as fictional characters, but their stories are based on real historical contexts. Therefore, cultural criminology has considered films as a significant field to understand social representations of violence related to historical crimes. The aim of the present contribution is to analyze the legacy of past and historical memory in social representations of violence in Latin American cinema as a critical approach to historical crimes. This qualitative research is based on content analysis. The sample is seven multi-award winning films of the International Festival of New Latin American Cinema of Havana. The films selected are Kamchatka, Argentina (2002); Carandiru, Brazil (2003); Enlightened by fire, Argentina (2005); Post-mortem, Chile (2010); No, Chile (2012) Wakolda; Argentina (2013) and The Clan, Argentina (2015). Cultural criminology highlights that cinema shapes meanings of social practices such as historical crimes. Critical criminology offers a critical theory framework to interpret Latin American cinema. This analysis reveals historical conditions deeply associated with power relationships, policy, and inequality issues. As indicated by this theory, violence is characterized as a structural process based on social asymmetries. These social asymmetries are crossed by social scopes, including institutional and personal dimensions. Thus, institutions of the states are depicted through personal stories of characters involved with human conflicts. Intimacy and social background are linked in the personages who simultaneously perform roles such as soldiers, policemen, professionals or inmates and they are at the same time depict as human beings with family, gender, racial, ideological or generational issues. Social representations of violence related to past legacy are a portrait of historical crimes perpetrated against Latin American citizens. Thereby, they have contributed to political positions, social behaviors, and public opinion. The legacy of these historical crimes suggests a path that should never be taken again. It means past legacy is a reminder, a warning, and a historic lesson for Latin American people. Then it studies some regional upgrading & urban development projects in Egypt followed by international projects, and the analysis the strategies followed in dealing with these projects. Afterwards, we state the regional aspects of both Damietta governorate & city, dealing with its potentials & development constraints. Followed by studying the upgrading and urban development projects strategies in reflection to the city’s crucial problems, and the constraints that faced the upgrading & development project. Then, it studied the implementation of the project’s strategies & it provided the financial resources needed for the development project in Damietta city. Followed by the studying of the urban and human development projects in the upgrading of Damietta city, as well as analyzing the different projects &analyzing the results of these projects on the aspects of the city’s needs. Then the research analysis in comparison the upgrading and urban development project in Damietta and the regional upgrading and development projects in Egypt. As well as the comparison between the upgrading and urban development project and the international projects in some Arabic and foreign countries in relation to the goals, problems, obstacles, the community participation, the finance resources and the results. Finally, it reviews the results and recommendations that were reached as a result of studying the similar urban upgrading projects in Egypt and in some Arabic and foreign countries. Abstract:
The growth of the agricultural sector is known as an essential way to achieve development goals in developing countries. Urban agriculture is a way to reduce the vulnerability of urban populations of the world toward global environmental change. It is a sustainable and efficient system to respond to the environmental, social and economic needs of the city, which leads to urban sustainability. Today, many local and national governments are developing urban agriculture as an effective tool in responding to challenges such as poverty, food security, and environmental problems. In this study, we follow a perspective based on urban agriculture literature in order to indicate the urban agriculture’s benefits in environmental planning strategies in non-western countries like Iran. The methodological approach adopted is based on qualitative approach and documentary studies. A total of 35 articles (mixed quantitative and qualitative methods studies) were studied in final analysis, which are published in relevant journals that focus on this subject. Studies show the wide range of positive benefits of urban agriculture on food security, nutrition outcomes, health outcomes, environmental outcomes, and social capital. However, there was no definitive conclusion about the negative effects of urban agriculture. This paper provides a conceptual and theoretical basis to know about urban agriculture and its roles in environmental planning, and also conclude the benefits of urban agriculture for researchers, practitioners, and policymakers who seek to create spaces in cities for implementation urban agriculture in future.Keywords: urban agriculture, environmental planning, urban planning, literature

Embracing the upcoming era of urbanization with the challenges of limitation of resources, disappearing cultural identities and conflicts among different groups of stakeholders, new integrated approaches are offered in our urban practice to help decision-makers and stakeholders frame and develop well-conceived, practical strategies for urban developing trajectories to approach urban-level sustainability in multiple social, cultural, ecological dimensions. Through bottom-up participation, we take advantage of tourism and leisure industries as driving forces for urbanization in China to promote integrated sustainable systems, with the hope of approaching both historical and ecological aspects of urban sustainability; and also thanks to top-down participation, we have codes, standards and rules established by the governments to strengthen the implementation of ecological urban sustainability. The results are monitored and evaluated experimentally and multidimensionally and the sustainable systems we constructed with local stakeholder groups turned out to be effective. Population growth in big cities of Iran has led to limitation of land resources, more consumption of non-renewable sources of energy and many environmental problems. Emerging of overbuilt urban areas and decreasing amount of green spaces cause the appearance of an undesirable landscape in the cities. Green roof technology is a solution to improve environmental concerns in urban areas which combines green spaces with buildings as the private or semi-private spaces. Successful implementation in different areas definitely depends on accommodation of green roof type with the environment and urban and building typology in Iran. This paper is aiming to provide some recommendation for selecting appropriate type of green roof and executive solutions considering to climatic zoning and urban situation in Iran. Nowadays, intelligent research technology is more and more important than traditional research methods in urban research work, and this proportion will greatly increase in the next few decades. Frequently such analyzing work cannot be carried without some software engineering knowledge. And here, domain models of urban research will be necessary when applying software engineering knowledge to urban work. In many urban plan practice projects, making rational models, feeding reliable data, and providing enough computation all make indispensable assistance in producing good urban planning. During the whole work process, domain models can optimize workflow design. At present, human beings have entered the era of big data. The amount of digital data generated by cities every day will increase at an exponential rate, and new data forms are constantly emerging. How to select a suitable data set from the massive amount of data, manage and process it has become an ability that more and more planners and urban researchers need to possess. This paper summarizes and makes predictions of the emergence of technologies and technological iterations that may affect urban research in the future, discover urban problems, and implement targeted sustainable urban strategies. They are summarized into seven major domain models. They are urban and rural regional domain model, urban ecological domain model, urban industry domain model, development dynamic domain model, urban social and cultural domain model, urban traffic domain model, and urban space domain model. These seven domain models can be used to guide the construction of systematic urban research topics and help researchers organize a series of intelligent analytical tools, such as Python, R, GIS, etc. These seven models make full use of quantitative spatial analysis, machine learning, and other technologies to achieve higher efficiency and accuracy in urban research, assisting people in making reasonable decisions.Keywords: big data, domain model, urban planning, urban quantitative analysis, machine learning, workflow design

As China's urban construction enters a new phase of 'stock optimization,' the key point of urban development has shifted to the development and reuse of existing public space. However, cities still face a series of challenges, such as the shortage of space quantity and insufficient space quality, which indirectly affect urban vitality. A review of the vitality of urban public space will significantly contribute to optimizing the quality of the urban built environment. It firstly analyses the research hotspots of urban vitality at home and abroad, based on a semi-systematic literature review. Then this paper summarizes the theoretical definitions of the vitality of urban public space and sorts out the influencing factors from the perspectives of society, environment, and users. Lastly, the paper concludes with the mainstream quantitative and evaluation methods, such as linear evaluation and integrated evaluation. This paper renders a multi-theoretical perspective to understand the characteristics and evaluation system of the vitality of public space, which helps to acknowledge the dynamic relationship between users, urban environment, and vitality. Military Court which is a judicial institution within the military institution has a heavy duty. Military court has to ensuring a fair legal process for military personnel (due process of law) and enforces military discipline. Military justice must also ensure protects the rights of military personnel. In Indonesia tren of military court changes in vision. The debate is happened on the jurisdiction of military court that allegedly has the potential existence of impunity. The Decree of People’s Consultative Assembly Number VII/MPR/2000 which states that the army general who committed the crime should not be tried in military court is one that underlies the proposed amendment limits the jurisdiction of military court. For the identify of the background in a specific format that is limited to juridical review. The goals this research is to gain knowledge, deep understanding and the concept of jurisdiction of military courts for military members who committed general crimes in adjudication procedure from the perspective of legal reform as alternative to establish independency of military judiciary. This research using Rule of Law as Grand Theory, Development Legal Theory as a Middle Theory and Criminal Justice System and concept of jurisdiction as supporting as Applied Theory. This study using a normative juridical approach, and equipped by primary data juridical approach of historical and comparative approach. The author uses descriptive analytical specifications. The main data used in this research is secondary data, which includes primary legal materials, secondary legal material and legal materials tertiary. Analysis primary data and qualitative data is done legally. Technique checking the validity of the data in this study used multiple methods with the research triangulation. This paper will demonstrate the problems concerning the jurisdiction of military courts for military personnel who committed general crimes in perspective of military justice reform Indonesia and adjudication procedures for military member who committed general crimes in the military justice system in Indonesia, as alternative to establish independency of judiciary in military justice in Indonesia. Abstract:
In recent years, global warming, the dramatic change in energy prices and the exhaustion of natural resources illustrated that energy-related topic cannot be ignored. Despite the relationship between the cities and CO₂ emissions has been extensively studied in recent years, little attention has been paid to differences in the geographical location of the city. However, the geographical climate has a great impact on lifestyle from city to city, such as the type of buildings, the major industry of the city, etc. Therefore, the paper instigates empirically the effects of kinds of urban factors and CO₂ emissions with consideration of the different geographic, climatic zones which cities are located. Using the regression model and a dataset of urban agglomeration in East Asia cities with over one million population, including 2005, 2010, and 2015 three years, the findings suggest that the impact of urban factors on CO₂ emissions vary with the latitude of the cities. Surprisingly, all kinds of urban factors, including the urban population, the share of GDP in service industry, per capita income, and others, have different level of impact on the cities locate in the tropical climate zone and temperate climate zone. The results of the study analyze the impact of different urban factors on CO₂ emissions in urban area with different geographical climate zones. These findings will be helpful for the formulation of relevant policies for urban planners and policy makers in different regions.Keywords: carbon emissions, urban agglomeration, urban factor, urban geography

Against the backdrop of China's burgeoning migration from rural to urban areas, a demographic group has emerged in China, which is called left-behind children. Due to many reasons, including the issue of the rural-urban education gap, the education of left-behind children has been below the national education average. In this situation, the issue has attracted the attention of researchers and policymakers. In order to gain a comprehensive understanding of this issue, this paper adopts an analytical approach to studying the rural-urban education gap and left-behind children in rural China. The paper first introduces the current situation of migration, the education gap, and left-behind children within China. Then, it further explores the causes of these two questions and barriers as well as the consequences for left-behind children. Based on the Tapio decoupling model and the theoretical framework of urban green development and regional integration, this paper builds an analysis system, makes a quantitative analysis of urban green development and regional integration level in a certain period, and discusses the relationship between the two. This paper goes on with examining how, by giving death penalties we are, on one hand trying to wipe out those heinous offenders committing such unspeakable crimes against the public; while on the other hand it comes with a devastating effect of corroding and eluding the existence of ethics and morality which is in the very nature of “protecting the life of humankind”. As it can be stated that, by giving capital punishment, we are trying to legitimize an irreversible act of violence by the authority of state and target innocent victims because as long as the human justice is fallible, the risk of executing an innocent can never be eliminated. Abstract:
Air temperatures are generally higher in cities than in their rural surroundings. The overheating of cities is a direct consequence of increasing urbanization, characterized by the artificial filling of soils, the release of anthropogenic heat, and the complexity of urban geometry. This phenomenon, referred to as urban heat island (UHI), is more prevalent during heat waves, which have increased in frequency and intensity in recent years. In the context of global warming and urban population growth, helping urban planners implement UHI mitigation and adaptation strategies is critical. In practice, the study of UHI requires air temperature information at the street canyon level, which is difficult to obtain. Many urban air temperature simulation models have been proposed (mostly based on physics or statistics), all of which require a variety of input parameters related to urban morphology, land use, material properties, or meteorological conditions. In this paper, we build and evaluate a neural network model based on Urban Weather Generator (UWG) model simulations and data from meteorological stations that simulate air temperature over Toulouse, France, on days favourable to UHI.Keywords: air temperature, neural network model, urban heat island, urban weather generator

Urbanization is an inevitable process of development of human society and an outcome of economic development and scientific and technological progress. While urbanization process in promoting the development of human civilization, also no doubt, urban landscape has been a corresponding impact. Urban environment has suffered unprecedented damage majorly due to the increase in urban population density and heavy migration rate, traffic congestion, and environmental pollution. All this have however led to a major ecological degradation and imbalance. As lands are used for the rapid and unplanned urbanization, the green lands are diminished, and severe pollution is created by waste products. Plastic, the most alarming waste at landfill sites, is yet uncontrolled. Therefore, initiatives must be taken to reduce plastic mediated pollution and increase green application. However, increasing green land is not possible due to the landfill by urban structures. In order to create a harmonious environment, sustainable development in the urban landscape becomes a matter of prime focus. The ongoing humanitarian crises spur rapid and unpredicted refugee influxes resulting in demographic changes in cities. Regarding different urban systems are vulnerable in refugee neighborhoods. With the consequent social, economic, and spatial challenges, cities must respond with a more durable and sustainable approach based on urban resilience. The paper systematically approaches urban resilience to contribute to refugee spaces by reflecting on the overall urban systems of their neighborhoods. The research will review the urban resilience literature to develop an evaluation framework. The developed framework applies urban resilience more holistically in refugee neighborhoods and expands to the urban systems of social, economic, and spatial. However, the main highlight of this paper is the resilient spatial structure in refugee neighborhoods to face the internal and complex stress of refugee waves and their demographic changes. Finding a set of resilient spatial measurements and focusing on urban forms at a neighborhood scale provide vulnerability reduction and enhance adaptation capacity. As a model example, the paper applies these measurements and facilitates geospatial technologies to one of the refugee neighborhoods in Amman, Jordan, namely Al-Jubilee. The application in Al-Jubilee helps to demonstrate a road map towards a developmental pattern in design and planning by different decision-makers of inter-governmental and humanitarian organizations. In this regard, urban resilience improves the humanitarian assistantship of refugee settings beyond providing the essential needs. Increases in urbanization during XX century, have brought as one major problem the increased of sediment production. Hydraulic erosion is one of the major causes of increasing of sediments in small urban catchments. Such increments in sediment yielding in header urban catchments can caused obstruction of drainage systems, making impossible to capture urban runoff, increasing runoff volumes and thus exacerbating problems of urban flooding. For these reasons, it is more and more important to study of sediment production in urban watershed for properly analyze and solve problems associated to sediments. The study of sediments production has improved with the use of mathematical modeling. For that reason, it is proposed a new physically based model applicable to small header urban watersheds that includes the advantages of distributed physically base models, but with more realistic data requirements. However, uncontrolled urban growth caused some anonymous and unsightly images of the cities such as unused or abandoned spaces. When social interaction is missed in a public space it means the public space is lost since public spaces reflect the social life and interaction of people. Accordingly; this space became one of the most meaningless parts of the cities and has broken the continuity of the urban fabric. Lost urban spaces are the leftover unstructured landscape within the urban fabric. They are generally the unrecognized urban areas that are in need of redesign, since they have a great value that can add to their surrounding urban context. The research significance lies within the importance of urban open spaces, their value and their impact on the urban fabric. The research also addresses the reuse and reclamation of lost urban spaces in order to increase the percentage of green areas along the urban fabric, provide urban open spaces, develop a sustainable approach towards urban landscape and enhance the quality of the public open space and user experience. In addition, the reuse of lost space will give it the identity and function it lacks while also providing places for presence, spending time and observing. Creating continuity in a broken urban fabric represents an exploratory process in the relationship between infrastructure and the urban fabric and seeks to establish an architectural solution to leftover space within the city. In doing so, the research establishes a framework (criteria) for adaptive reuse of lost urban space throughout inductive and deductive methodology, analytical methodology; by analyzing some relevant examples and similar cases of lost spaces and finally through field methodology; by applying the achieved criteria on a case study in Alexandria and carrying on SWOT analysis and evaluation of the potentials of this case study.Keywords: adaptive reuse, lost urban space, quality of public open space, urban fabric

Abstract:
For the present study a total of 219 women, from urban and rural areas of Sagar district of central India were selected. The mean age at menarche of rural women was found 13.89±1.17 years and for urban women, it was 13.78±1.12 years. The difference between the mean age at menarche of urban and rural women was statistically insignificant (t=0.580, p≤0.05). Mean age at menopause among rural women was (47.4±4.92). The difference between the mean of urban and rural women was statistically insignificant (t=0.739 and p≤0.05). These findings indicate that rural women experience menopause at a later age as compared to their urban counterparts.Keywords: menarche, menopause, urban, rural, Bidi workers

Abstract:
With massive population expansion and fast economic development in last decade, urban land has increasingly expanded and formed high informal development territory in Kabul city. This paper investigates integrated urbanization trends in Kabul city since the formation of the basic structure of the present city using GIS and remote sensing. This study explores the spatial and temporal difference of urban land expansion and land use categories among different time intervals, 1964-1978 and 1978-2008 from 1964 to 2008 in Kabul city. Furthermore, the goal of this paper is to understand the extent of urban land expansion and the factors driving urban land expansion in Kabul city. Many factors like population expansion, the return of refugees from neighboring countries and significant economic growth of the city affected urban land expansion. Across all the study area urban land expansion rate, population expansion rate and economic growth rate have been compared to analyze the relationship of driving forces with urban land expansion. Based on urban land change data detected by interpreting land use maps, it was found that in the entire study area the urban territory has been expanded by 14 times between 1964 and 2008.Keywords: GIS, Kabul city, land use, urban land expansion, urbanization

Content analysis was the method used for the conduction of the study. This study is delimited to Capital City Police and Cellular Forensic Unit Peshawar-KP, Pakistan. information technologies. Major finding(s): It is evident that the old traditional approach will never provide solutions for better management in controlling crimes. The best way to control crimes and promotion of proactive policing is to adopt new technologies. The study reveals that technology have transformed police more effective and vigilant as compared to traditional policing. The heinous crimes like abduction, missing of an individual, snatching, burglaries and blind murder cases are now traceable with the help of technology. Population growth, urban development and urban buildup have disturbed the balance between the nature and the city, and so leading to the loss of quality of sustainability of proximity to rivers. While in the past, the sides of urban rivers were considered as urban green space. Urban rivers and their sides that have environmental, social and economic values are important to achieve sustainable development. So far, efforts have been made at various scales in various cities around the world to revitalize these areas. On the other hand, biophilic design is an innovative design approach in which attention to natural details and relation to nature is a fundamental concept. The purpose of this study is to provide an integrated framework of urban design using the potential of urban rivers (in order to increase sustainability) with a biophilic design approach to be used in cities in developing countries. The methodology of the research is based on the collection of data and information from research and projects including a study on biophilic design, investigations and projects related to the urban rivers, and a review of the literature on sustainable urban development. Then studying the boundary of urban rivers is completed by examining case samples. Eventually, integrated framework of urban design, to design the boundaries of urban rivers in the cities of developing countries is presented regarding the factors affecting the design of these areas. The result shows that according to this framework, the potential of the river banks is utilized to increase not only the environmental sustainability but also social, economic and physical stability with regard to water, light, and the usage of indigenous materials, etc.Keywords: urban rivers, biophilic design, urban sustainability, nature

Monitoring of changes in the urban places and sustainable urban development accounted a base for the realization of worthy goals urban sustainable development. The importance of women in environmental protection programs is high enough that in 21 agenda has been requested from all countries to allocate more shares to women in their policies. On the other hand, urban waste landfill has become one of the environmental concerns in modern cities. This research assumes that the impact of women on recycling, reduction and proper waste landfill is much more than men. For this reason, three districts; Yousef Abad, Heshmatieh and Nezam Abad are gauged through questionnaire and using the analytical research hypothesis model. This research will be categorized as functional research. The literature, the scientific and disciplinary debate related to the impacts of climate change on the territory has highlighted, in recent years, the need for climate-proof and resilient tools of urban planning that adopt an integrated and inter-scalar approach for the construction of urban regeneration strategies by the objectives of the European Strategy on adaptation to climate change, the 2030 Agenda for Sustainable Development and the Climate Conference. This article addresses the operational implications of urban climate resilience in urban planning tools as a priority objective of policymakers (government bodies, institutions, etc.) to respond to the risks of climate change-related impacts on the environment. Within the general framework of the research activities carried out by the author, this article provides a critical synthesis of the analysis and evaluation of some case studies from the Italian national context, which enabled, through an inductive method, the assessment of the process of implementing the adaptation to climate change within the regional urban planning frameworks (regional urban laws), specific regional adaptation strategies or local adaptation plans and within the territorial and urban planning tools of a metropolitan or local scale. Nowadays, with the decline of traditional industrial society as well as the rise of post-industrial age, contemporary society must face the ruins and garbage problem which is left by industrial society. Commencing from the perspective of emotion and memory, this paper analyzes the importance for emotional needs as well as their existing status of several projects, such as the Capital Steelworks in Beijing (industrial devastation), the Shibati old section in Chongqing (urban slums) and the Old Hurva Synagogue in Jerusalem (ruins of war).
