5626 The Relations Between Hans Kelsen’s Concept of Law and the Theory of Democracy

Abstract:
Hans Kelsen was a versatile legal thinker whose achievements in the fields of legal theory, international law, and the theory of democracy are remarkable. All of the fields tackled by Kelsen are regarded as part of his “pure theory of law.” While the link between international law and Kelsen’s pure theory of law is apparent, the same cannot be said about the link between the theory of democracy and his pure theory of law. On the contrary, the general thinking concerning Kelsen’s thought is that it can be used to legitimize authoritarian regimes. The aim of this presentation is to address this concern by identifying the common ground between Kelsen’s pure theory of law and his theory of democracy and to show that they are compatible in a way that his pure theory of law and authoritarianism cannot be. The conceptual analysis of the purity of Kelsen’s theory and his goal of creating ideology-free legal science hints at how Kelsen’s pure theory of law and the theory of democracy are brought together. The presentation will first demonstrate that these two conceptions have common underlying values and meta-ethical convictions. Both are founded on relativism and a rational worldview, and the aim of both is peaceful co-existence. Second, it will be demonstrated that the separation of law and morality provides the maximum space for deliberation within democratic processes. The conclusion of this analysis is that striking similarities exist between Kelsen’s legal theory and his theory of democracy. These similarities are grounded in the Enlightenment tradition and its values, including rationality, a scientific worldview, tolerance, and equality. This observation supports the claim that, for Kelsen, legal positivism and the theory of democracy are not two separate theories but rather stem from the same set of values and from Kelsen’s relativistic worldview. Furthermore, three main issues determine Kelsen’s orientation toward a positivistic and democratic outlook. The first, which is associated with personality type, is the distinction between absolutism and relativism. The second, which is associated with the values that Kelsen favors in the social order, is peace. The third is legality, which creates the necessary condition for democracy to thrive and reveals that democracy is capable of fulfilling Kelsen’s ideal of law at its fullest. The first two categories exist in the background of Kelsen’s pure theory of law, while the latter is an inherent part of Kelsen’s concept of law. The analysis of the text concerning natural law doctrine and democracy indicates that behind the technical language of Kelsen’s pure theory of law is a strong concern with the trends that appeared after World War I. Despite his rigorous scientific mind, Kelsen was deeply humanistic. He tried to create a powerful intellectual weapon to provide strong arguments for peaceful coexistence and a rational outlook in Europe. The analysis provided by this presentation facilitates a broad theoretical, philosophical, and political understanding of Kelsen’s perspectives and, consequently, urges a strong endorsement of Kelsen’s approach to constitutional democracy.Keywords: hans kelsen, democracy, legal positivism, pure theory of law

Abstract:
Carbon nanostructures are of great importance in academic research and industry, which can be mentioned to chemical sensors, catalytic processes, pharmaceutical and environmental issues. Common point in all of these applications is the occurrence of adsorption of molecules on these structures. Important carbon nanostructures in this case are mainly nanotubes and graphene. To modify pure graphene, recently, many experimental and theoretical studies have carried out to investigate of metal adsorption on graphene. In this work, the adsorption of CO molecules on pure graphene and on metal adatom on graphene surface has been simulated based on density functional theory (DFT). All calculations were performed by PBE functional and Troullier-Martins pseudopotentials. Density of states (DOS) for graphene-CO, graphen and CO around the Fermi energy has been moved and very small mixing occured which implies the physisorption of CO on the bare graphen surface. While, the results have showed that CO adsorption on transition-metal adatom on graphene surface is chemisorption.Keywords: adsorption, density functional theory, graphene, metal adatom

Abstract:
We present calculations of the structural, elastic and electronic properties of nonferrous Ti, Zr, and Hf pure metals in both parent and martensite phases in bcc and hcp structures respectively. They are based on the generalized gradient approximation (GGA) within the density functional theory (DFT). The shear modulus, Young's modulus and Poisson's ratio for Ti, Zr, and Hf metals have were calculated and compared with the corresponding experimental values. Using elastic constants obtained from calculations GGA, the bulk modulus along the crystallographic axes of single crystals was calculated. This is in good agreement with experiment for Ti and Zr, whereas the hcp structure for Hf is a prediction. At zero temperature and zero pressure, the bcc crystal structure is found to be mechanically unstable for Ti, Zr, and Hf. In our calculations the hcp structures is correctly found to be stable at the equilibrium volume. In the electronic density of states (DOS), the smaller n(EF) is, the more stable the compound is. Therefore, in agreement with the results obtained from the total energy minimum.Keywords: Ti, Zr, Hf, pure metals, transformation, energy

We present a discrete game theoretical model with homogeneous individuals who make simultaneous decisions. In this model the strategy space of all individuals is a discrete and dichotomous set which consists of two strategies. We fully characterize the coherent, split and mixed strategies that form Nash equilibria and we determine the corresponding Nash domains for all individuals. An analysis was carried out on 19,759 citations appended to the References Section of 881 research articles published in Bayero Journal of Pure and Applied Sciences. It was found that journals publications were the most cited source of information among pure and applied sciences scientists with 12,090 (61.2%). Abstract:
Pure economic loss can be brought into the 21st century and become a useful tool to keep the tort of negligence within reasonable limits, provided the concept is minutely reexamined. The term came about when wealth was physical, and Law wanted to be a modern science. As a tool to draw the line, it leads to satisfactory decisions in most cases, but needlessly creates distressing conundrums in others, and these are the ones parties bother to litigate about. Economic loss is deemed to be pure based on a blind negative criterion of physical harm, that inadvertently smelts vastly disparate problems into an indiscernible mass, with arbitrary outcomes. These shortcomings are usually dismissed as minor byproducts, for the lack of a better formula. Law could instead stick to the sound paradigms of the intended rule, and be more specific in identifying the losses deserving of compensation. The proposed theory completely denies Einstein's existing Theory of Relativity. The only thing that connects these theories is that the proposed theory is also built on postulates. The proposed theory is intended to establish the foundation of classical Newtonian physics. The proposed theory is intended to establish continuity in the development of the fundamentals of physics and is intended to eliminate all kinds of speculation in explanations of physical phenomena. To elucidate the material characteristics of single crystals of pure aluminum and copper, the respective relations between crystallographic orientations and micro structures were examined, along with bending and mechanical properties. The texture distribution was also analysed. Bending tests were performed in a SEM apparatus while its behaviors were observed. The Magic Bullet theory was a popular media effect theory that defined the power of the mass media in altering beliefs and perceptions of its audiences. However, following the People's Choice study, the theory was said to have been disproved and was supplanted by the Two-Step Flow Theory. This paper examines the relevance of the Magic Bullet theory in Africa and establishes whether it is still relevant in Africa's media spaces and societies. Casualty insurance business, the optimal premium pricing and adequate cost for an insurance company are important in risk management. Normally, the insurance pure premium can be determined by multiplying the claim frequency with the claim cost. The aim of this research was to study in the application of generalized linear models to select the risk factor for model of claim frequency and claim cost for estimating a pure premium. In this study, the data set was the claim of comprehensive motor insurance, which was provided by one of the insurance company in Thailand. This paper develops a model influenced by (the classical) enterprise theory and resource theory that includes more than money in the business activities of an enterprise. In advancing the management of integrated electric vehicle (EV) parking-charging behaviors, this study uses Changshu City in Suzhou as a case study to establish a data association mechanism for parking-charging platforms and to develop a database for EV parking-charging behaviors. Key indicators, such as charging start time, initial state of charge, final state of charge, and parking-charging time difference, are considered. Utilizing the K-S test method, the paper examines the heterogeneity of parking-charging behavior preferences among pure EV and non-pure EV users. The K-means clustering method is employed to analyze the characteristics of parking-charging behaviors for both user groups, thereby enhancing the overall understanding of these behaviors. The findings of this study reveal that using a classification model, the parking-charging behaviors of pure EVs can be classified into five distinct groups, while those of non-pure EVs can be separated into four groups. Among them, both types of EV users exhibit groups with low range anxiety for complete charging with special journeys, complete charging at destination, and partial charging. Additionally, both types have a group with high range anxiety, characterized by pure EV users displaying a preference for complete charging with specific journeys, while non-pure EV users exhibit a preference for complete charging. Notably, pure EV users also display a significant group engaging in nocturnal complete charging. The findings of this study can provide technical support for the scientific and rational layout and management of integrated parking and charging facilities for EVs.Keywords: traffic engineering, potential preferences, cluster analysis, EV, parking-charging behavior

Abnormalities in auditory processing are one of the most commonly reported sensory processing impairments in children with Autism Spectrum Disorder (ASD). Tonal language speaker with autism has enhanced neural sensitivity to pitch changes in pure tone. However, not all children with ASD exhibit the same performance in pitch processing due to different auditory sensitivity. The current study aimed to examine auditory change detection in ASD with different auditory sensitivity. K-means clustering method was adopted to classify ASD participants into two groups according to the auditory processing scores of the Sensory Profile, 11 autism with hypersensitivity (mean age = 11.36 ; SD = 1.46) and 18 with hypo-sensitivity (mean age = 10.64; SD = 1.89) participated in a passive auditory oddball paradigm designed for eliciting mismatch negativity (MMN) under the pure tone condition. Results revealed that compared to hypersensitive autism, the children with hypo-sensitivity showed smaller MMN responses to pure tone stimuli. These results suggest that ASD with auditory hypersensitivity and hypo-sensitivity performed differently in processing pure tone, so neural responses to pure tone hold promise for predicting the auditory sensitivity of ASD and targeted treatment in children with ASD.Keywords: ASD, sensory profile, pitch processing, mismatch negativity, MMN

One of the limitations of this review paper is that data were only collected from Google Scholar where many papers were sometimes not freely accessible. Entropy generation of an Al2O3-water nanofluid due to heat transfer and fluid friction irreversibility has been investigated in a square cavity subject to different side wall temperatures using a nanofluid for natural convection flow. This study has been carried out for the pertinent parameters in the following ranges: Rayleigh number between 104 to 107 and volume fraction between 0 to 0.05. Based on the obtained dimensionless velocity and temperature values, the distributions of local entropy generation, average entropy generation and average Bejan number are determined. The results are compared for a pure fluid and a nanofluid. It is totally found that the heat transfer and entropy generation of the nanofluid is more than the pure fluid and minimum entropy generation and Nusselt number occur in the pure fluid at any Rayleigh number. Results depict that the addition of nanoparticles to the pure fluid has more effect on the entropy generation as the Rayleigh number goes up.Keywords: entropy generation, natural convection, bejan number, nuselt number, nanofluid

In Extreme Value Theory, inference estimation for the parameters of the distribution is made employing a small part of the observation values. When block maxima values are taken, many data are discarded. We developed a new Bayesian inference model to seize all the information provided by the data, introducing informative priors and using the relations between baseline and limit parameters. Firstly, we studied the accuracy of the new model for three baseline distributions that lead to a Gumbel extreme distribution: Exponential, Normal and Gumbel. Abstract:
Transcendental analytics, in the critique of pure reason, combines space and time as conditions of the possibility of the phenomenon from the transcendental aesthetic with the pure magnitude-intuition notion. The property of continuity as a qualitative result of the additive magnitude brings the possibility of connecting with experience, even though only as a potential because of the a priori necessity from assumption, as syntheticity of the a priori task of a scientific method of philosophy given by Kant, which precludes the application of categories to something not empirically reducible to the content of such a category's corresponding and possible object. This continuity as the qualitative result of a priori constructed notion of magnitude lies as a fundamental assumption and property of, what in Microeconomic theory is called as, 'choice rules' which combine the potentially-empirical and practical budget-price pairs with preference relations. This latter result is the purest qualitative side of the choice rules', otherwise autonomously, quantitative nature. The theoretical, barring the empirical, nature of this qualitative result is a synthetic a priori truth, which, if at all, it should be, if the axiomatic structure of the economic theory is held to be correct. It has a potentially verifiable content as its possible object in the form of quantitative price-budget pairs. Yet, the object that serves the respective Kantian category is qualitative itself, which is utility. Abstract:
Pure CeO2, Sm and Gd doped CeO2 were successfully prepared via hydrothermal method. The effect of hydrothermal temperature, reaction time and precursors were investigated. The prepared nanoparticles were characterized using X-ray diffraction (XRD), FT-Raman Spectroscopy, transmission electron microscope (TEM) and field emission scanning electron microscope (FESEM). The prepared pure and doped CeO2 nanoparticles were used as photo-catalyst for the degradation of Methylene blue (MB) dye under UV light irradiation. The results showed that Gd doped CeO2 nano-particles have the best catalytic degradation effect for MB under UV irradiation. The degradation pathways of MB were followed using liquid chromatography (LC/MS) and it was found that Gd doped CeO2 was able to oxidize MB dye with a complete mineralization of carbon, nitrogen and sulfur heteroatoms into CO2, NH4+, NO3- and SO42-.Keywords: CeO2, doped CeO2, photocatalysis, methylene blue

This paper approach cognitive radio technic and applied pure proactive handoff Model to decrease interference between PU and SU and comparing it with reactive handoff model. Through the study and analysis of multivariate models SAW and TOPSIS join to 3 dynamic prediction techniques AR, MA ,and ARMA. To evaluate the best model is taken four metrics: number failed handoff, number handoff, number predictions, and number interference. The result presented the advantages using this type of pure proactive models to predict changes in the PU according to the selected channel and reduce interference. Microstructural and hardening changes of Fe-0.2wt.%V alloy and pure Fe irradiated with 100 keV hydrogen ions at room temperature were investigated. It was found that dislocation density varies dramatically after irradiation, ranging from dislocation free to dense areas with tangled and complex dislocation configuration. As the irradiated Fe-0.2wt.%V samples were annealed at 773 K, the irradiation-induced dislocation loops disappear, while many small precipitates with enriched C distribute in the matrix. Some large precipitates with enriched V were also observed. The hardness of Fe-0.2wt.%V alloy and pure Fe increases after irradiation, which ascribes to the formation of dislocation loops in the irradiated specimens. Compared with pure Fe, the size of the irradiation-introduced dislocation loops in Fe-0.2wt.%V alloy decreases and the density increases, the change of the hardness also decreases.Keywords: irradiation, Fe-0.2wt.%V alloy, microstructures, hardness

As energetic and environmental issues are getting more and more attention all around the world, the penetration of distributed energy resources (DERs) mainly those harvesting renewable energies (REs) ascends with an unprecedented rate. This matter causes more uncertainties to appear in the power system context; ergo, the uncertainty analysis of the system performance is an obligation. The uncertainties of any system can be represented probabilistically or possibilistically. Since sufficient historical data about all the system variables is not available, therefore, they do not have a probability density function (PDF) and must be represented possibilistiacally. When some of system uncertain variables are probabilistic and some are possibilistic, neither the conventional pure probabilistic nor pure possibilistic methods can be implemented. Hence, a combined solution is appealed. The first of this two-paper series formulates a new possibilistic-probabilistic tool for the load flow uncertainty assessment. The proposed methodology is based on the evidence theory and joint propagation of possibilistic and probabilistic uncertainties. Abstract:
The ultraporous nanofibrous alumina (NOA, Al2O3·nH2O) was synthesized by oxidation of laminated aluminium plates through a liquid mercury-silver layer in a humid atmosphere ~80% at 25°C. The material has an extremely high purity (99%), porosity (90%) and specific area (300 m2/g). The subsequent annealing of raw NOA permits obtaining pure transition phase (γ and θ) nanostructured materials. In this combination, we report on chemical, structural and phase transformations of pure and modified NOA by an impregnation of trimethylethoxysilane (TMES) and tetraethoxysilane (TEOS) during thermal annealing in the temperature range between 20 and 1650°C. The mass density, specific area, average diameter and specific area are analysed. The 3D model of pure NOA monoliths and silica modified NOA is proposed, which successfully describes the evolution of specific area, mass density and phase transformations. Activation energies of the mass transport in two regimes of surface diffusion and bulk sintering were obtained based on this model. Regarding the phase equilibria of this system, the modeling of solid-supercritical fluid behavior was performed using the Perturbed-Chain Statistical Association Fluid Theory (PC-SAFT) and Peng-Robinson equations of state (PR EoS). For this purpose, five PC-SAFT EoS parameters for pure benzoic acid were obtained using its experimental vapor pressure. Benzoic acid has association sites and the behavior of the benzoic acid-supercritical fluid system was well-predicted using both equations of state, while the binary interaction parameter values for PR EoS were negative. Genetic algorithm, which is one of the most accurate global optimization algorithms, was also used to optimize the pure benzoic acid parameters and the binary interaction parameters. The AAD% value for the PC-SAFT EoS, were 0.22 for the carbon dioxide-benzoic acid system.Keywords: supercritical fluids, solubility, solid, PC-SAFT EoS, genetic algorithm

Abstract:
Ultrafine grained (UFG) and nanostructured (NS) materials have experienced a rapid development during the last decade and made profound impact on every field of materials science and engineering. The present work has been undertaken to develop ultra-fine grained pure copper by severe plastic deformation method and to examine the impact property by different characterizing tools. For this aim, equal channel angular pressing die with the channel angle, outer corner angle and channel diameter of 90°, 17° and 20 mm had been designed and manufactured. Commercial pure copper billets were ECAPed up to four passes by route BC at the ambient temperature. The results indicated that there is a great improvement at the hardness measurement, yield strength and ultimate tensile strength after ECAP process. It is found that the magnitudes of HV reach 136HV from 52HV after the final pass. Also, about 285% and 125% enhancement at the YS and UTS values have been obtained after the fourth pass as compared to the as-received conditions, respectively. On the other hand, the elongation to failure and impact energy have been reduced by imposing ECAP process and pass numbers. It is needed to say that about 56% reduction in the impact energy have been attained for the samples as contrasted to annealed specimens.Keywords: SPD, ECAP, pure cu, impact property

Abstract:
Maximal radar wave absorbing cannot be achieved by shaping alone. We have to focus on the parameters of absorbing materials such as permittivity, permeability, and thickness so that best absorbing according to our necessity can happen. The real and imaginary parts of the relative complex permittivity (εr' and εr") and permeability (µr' and µr") were obtained by simulation. The microwave absorbing property of carbon and Ni(C) is simulated in this study by MATLAB software; the simulation was in the frequency range between 2 to 12 GHz for carbon black (C), and carbon coated nickel (Ni(C)) with different thicknesses. In fact, we draw reflection loss (RL) for C and Ni-C via frequency. We have compared their absorption for 3-mm thickness and predicted for other thicknesses by using of electromagnetic wave transmission theory. The results showed that reflection loss position changes in low frequency with increasing of thickness. We found out that, in all cases, using nanocomposites as absorbance cannot get better results relative to pure nanoparticles. The frequency where absorption is maximum can determine the best choice between nanocomposites and pure nanoparticles. Also, we could find an optimal thickness for long wavelength absorbing in order to utilize them in protecting shields and covering.Keywords: absorbing, carbon, carbon nickel, frequency, thicknesses

Abstract:
Developing mechanical properties of pure titanium has been reviewed in this paper by using ECAP process. At the first step of this article, the experimental samples were prepared as mentioned in the standards. Then pure grade 2 Ti was processed via equal-channel angular pressing (ECAp) for 2 passes following route-A at 400°C. After processing, the microstructural evolution, tensile, fatigue, hardness properties and wear behavior were investigated. Finally, the effect of ECAP process on these samples was analyzed. The results showed improvement in strength values with a slight decrease in ductility. The analysis on 30 points within the sample showed hardness increase in each pass. Abstract:
Unsteady flow and heat transfer from a circular cylinder in cross-flow is studied numerically. The governing equations are solved by using finite volume method. Reynolds number varies in range of 50 to 200, in this range flow is considered to be laminar and unsteady. Al2O3 nanoparticle with volume fraction in range of 5% to 20% is added to pure water. Effects of adding nanoparticle to pure water on lift and drag coefficient and Nusselt number is presented. Addition of Al2O3 has inconsiderable effect on the value of drags and lift coefficient. However, it has significant effect on heat transfer; results show that heat transfer of Al2O3 nanofluid is about 9% to 36% higher than pure water.Keywords: nanofluid, heat transfer, unsteady flow, forced convection, cross-flow

Abstract:
Alcohol fuels are renewable, have low pollution and have high octane number; therefore, they are important as fuel in internal combustion engines. Percentage detection of these alcoholic fuels with gasoline is a complicated, time consuming, and expensive process. Nowadays, these processes are done in equipped laboratories, based on international standards. The aim of this research is to determine percentage detection of different fuels based on vibration analysis of engine block signals. By doing, so considerable saving in time and cost can be achieved. Five different fuels consisted of pure gasoline (G) as base fuel and combination of this fuel with different percent of ethanol and methanol are prepared. For example, volumetric combination of pure gasoline with 10 percent ethanol is called E10. By this convention, we made M10 (10% methanol plus 90% pure gasoline), E30 (30% ethanol plus 70% pure gasoline), and M30 (30% Methanol plus 70% pure gasoline) were prepared. To simulate real working condition for this experiment, the vehicle was mounted on a chassis dynamometer and run under 1900 rpm and 30 KW load. To measure the engine block vibration, a three axis accelerometer was mounted between cylinder 2 and 3. After acquisition of vibration signal, eight time feature of these signals were used as inputs to an Adaptive Neuro Fuzzy Inference System (ANFIS). The designed ANFIS was trained for classifying these five different fuels. The results show suitable classification ability of the designed ANFIS network with 96.3 percent of correct classification.Keywords: internal combustion engine, vibration signal, fuel composition, classification, ANFIS

Abstract:
A scalar equilibrium (SE) is an alternative type of equilibrium in pure strategies for an n-person normal-form game G. It is defined using optimization techniques to obtain a pure strategy for each player of G by maximizing an appropriate utility function over the acceptable joint actions. The players’ actions are determined by the choice of the utility function. Such a utility function could be agreed upon by the players or chosen by an arbitrator. An SE is an equilibrium since no players of G can increase the value of this utility function by changing their strategies. SEs are formally defined, and examples are given. In a greedy SE, the goal is to assign actions to the players giving them the largest individual payoffs jointly possible. In a weighted SE, each player is assigned weights modeling the degree to which he helps every player, including himself, achieve as large a payoff as jointly possible. In a compromise SE, each player wants a fair payoff for a reasonable interpretation of fairness. In a parity SE, the players want their payoffs to be as nearly equal as jointly possible. Finally, a satisficing SE achieves a personal target payoff value for each player. Abstract:
The current theory for the creation of the universe, the Big Bang theory, is widely accepted but leaves some unanswered questions. It does not explain the origin of the singularity or what causes the Big Bang. The theory of the Big Bang also does not explain why there is such a huge amount of dark energy and dark matter in our universe. Also, there is a question related to one universe or multiple universes which needs to be answered. This research addresses these questions using the Bhagvat Puran and other Vedic scriptures as the basis. There is a Unique Pure Energy Field that is eternal, infinite, and finest of all and never transforms when in its original form. The Carrier Particles of Unique Pure Energy are Param-anus- Fundamental Energy Particles. Param-anus and a combination of these particles create bigger particles from which the Universe gets created. For creation to initiate, Unique Pure Energy is represented in three phases: positive phase energy, neutral phase eternal time energy and negative phase energy. Positive phase energy further expands in three forms of creative energies (CE1, CE2andCE3). From CE1 energy, three energy modes, mode of activation, mode of action, and mode of darkness, were created. From these three modes, 16 Principles, subtlest forms of energies, namely Pradhan, Mahat-tattva, Time, Ego, Intellect, Mind, Sound, Space, Touch, Air, Form, Fire, Taste, Water, Smell, and Earth, get created. In the Mahat-tattva, dominant in the Mode of Darkness, CE1 energy creates innumerable primary singularities from seven principles: Pradhan, Mahat-tattva, Ego, Sky, Air, Fire, and Water. CE1 energy gets divided as CE2 and enters, along with three modes and time, in each singularity, and primary Big Bang takes place, and innumerable Invisible Universes get created. Each Universe has seven coverings of 7 principles, and each layer is 10 times thicker than the previous layer. By energy CE2, space in Invisible Universe under the coverings is divided into two halves. In the lower half, the process of evolution gets initiated, and seeds of 24 elements get created, out of which 5 fundamental elements, building blocks of matter, Sky, Air, Fire, Water and Earth, create seeds of stars, planets, galaxies and all other matter. Since 5 fundamental elements get created out of the mode of darkness, it explains why there is so much dark energy and dark matter in our Universe. This process of creation, in the lower half of Invisible universe continues for 2.16 billion years. Further, in the lower part of the energy field, exactly at the Centre of Invisible Universe, Secondary Singularity is created, through which, by force of Mode of Action, Secondary Big Bang takes place and Visible Universe gets created in the shape of Lotus Flower, expanding into upper part. Visible matter starts appearing after a gap of 360,000 years. Within the Visible Universe, a small part gets created known as the Phenomenal Material World, which is our Solar System, the sun being in the Centre.
