Abstract:
Purview has customarily been considered in worldwide law as simply an address of the rights and powers of states. Conceived in this way, the rules onward serve the imperative work of delimiting (whereas tolerating a few covers of) state administrative specialist – the address of when an individual or occasion may be subject to national direction – a work which is shared with the cognate teach of private worldwide law. This article proposes that the thought and the rules of locale in worldwide law require reconceptualization in light of three advancements. The primary is the developing acknowledgment that in an extend of circumstances, the work out of national locale may, beneath worldwide law, be an address of duty or commitment instead of right. The moment advancement is the expanded acknowledgment that such jurisdictional obligations may, in a few circumstances, be owed not as it were to other states but also to private parties, especially through the rise and fortifying of the teachings of refusal of equity and get to equity. The third improvement is the broadly perceived wonder known as party independence, beneath which private parties in the gracious debate have the control to bestow locale on national courts and to decide themselves which law administers their connections. In combination, these improvements propose the need to reexamine the concept of ward in worldwide law to reflect the more complex substances of a worldwide lawful arrangement beneath which states possess both jurisdictional rights and commitments and are not the elite on-screen characters. Keywords: international law, jurisdiction, purview, preconceptions, commitment

Authors: Sun-Mi Park, Ji-Hyun Jung, Min-Jung Kang
Abstract:
Software (SW) education is scheduled to be included in the National curriculum in South Korea by 2018. However, Korean national kindergarten curriculum has been excepted from the revision of the entire Korean national school curriculum including software education. Even though the SW education has not been considered a part of current national kindergarten curriculum, there is a growing interest of adopting software education into the ECE practice. Teachers might be a key element in introducing and implementing new educational change such as SW education. In preparation for the adoption of SW education in ECE, it might be necessary to figure out ECE teachers’ perception and attitudes toward early childhood software education. For this study, 219 ECE teachers’ concern level in SW education was surveyed by using the Stages of Concern Questionnaire (SoCQ). As a result, the teachers' concern level in SW education is the highest at stage 0-Unconcerned and is high level in stage 1-informational, stage 2-personal, and stage 3-management concern. Thus, a non-user pattern was mostly indicated. However, compared to a typical non-user pattern, the personal and informative concern level is slightly high. The 'tailing up' phenomenon toward stage 6-refocusing was shown. Therefore, the pattern aspect close to critical non-user ever appeared to some extent. In addition, a significant difference in concern level was shown at all stages depending on the awareness of necessity. Teachers with SW training experience showed higher intensity only at stage 0. There was statistically significant difference in stage 0 and 6 depending on the future implementation decision. These results will be utilized as a resource in building ECE teachers’ support system according to his or her concern level of SW education. Keywords: concerns-based adoption model (CBAM), early childhood education teachers, software education, Stages of Concern (SoC)

Authors: Tomasz Lewinski
Abstract:
The right to know becomes gradually recognised as an increasing number of states adopts national legislations regarding access to state-held information. Laws differ from each other in the scope of the right to information (hereinafter: RTI). In all regimes of RTI, there are exceptions from the general notion of the right. States’ authorities too often use exceptions to justify refusals to requests for state-held information. This paper sets out how states hamper RTI basing on the notion of exception and by not providing an effective procedure that could redress unlawful denials. This paper bases on two selected examples of RTI incorporation into the national legal regime, United Kingdom, and South Africa. It succinctly outlines the international standard given in Article 19 of the International Covenant on Civil and Political Rights (hereinafter: ICCPR) and its influence on the RTI in selected countries. It shortly demonstrates as a background to further analysis the Human Rights Committee’s jurisprudence and standards articulated by successive Special Rapporteurs on freedom of opinion and expression. Subsequently, it presents a brief comparison of these standards with the regional standards, namely the African Charter on Human and Peoples' Rights and the European Convention on Human Rights. It critically discusses the regimes of exceptions in RTI legislations in respective national laws. It shows how excessive these regimes are, what implications they have for the transparency in general. Also, the objective is to divide exceptions enumerated in legislations of selected states in relation to exceptions provided in Article 19 of the ICCPR. Basing on the established division of exceptions by its natures, it compares both regimes of exceptions related to the principle of national security. That is to compare jurisprudence of domestic courts, and overview practices of states’ authorities applied to RTI requests. The paper evaluates remedies available in legislations, including contexts of the length and costs of the subsequent proceedings. This provides a general assessment of the given mechanisms and present potential risks of its ineffectiveness. The paper relies on examination of the national legislations, comments of the credible non-governmental organisations (e.g. The Public's Right to Know Principles on Freedom of Information Legislation by the Article 19, The Tshwane Principles on National Security and the Right to Information), academics and also the research of the relevant judgements delivered by domestic and international courts. Conclusion assesses whether selected countries’ legislations go in line with international law and trends, whether the jurisprudence of the regional courts provide appropriate benchmarks for national courts to address RTI issues effectively. Furthermore, it identifies the largest disadvantages of current legislations and to what outcomes it leads in domestic courts jurisprudences. In the end, it provides recommendations and policy arguments for states to improve transparency and support local organisations in their endeavours to establish more transparent states and societies. Keywords: access to information, freedom of information, national security, right to know, transparency

Authors: Watcharin Sangma, Onsiri Chanmuang, Pitsanu Tongkhow
Abstract:
A forecasting model for steel demand uncertainty in Thailand is proposed. It consists of trend, autocorrelation, and outliers in a hierarchical Bayesian frame work. The proposed model uses a cumulative Weibull distribution function, latent first-order autocorrelation, and binary selection, to account for trend, time-varying autocorrelation, and outliers, respectively. The Gibbs sampling Markov Chain Monte Carlo (MCMC) is used for parameter estimation. The proposed model is applied to steel demand index data in Thailand. The root mean square error (RMSE), mean absolute percentage error (MAPE), and mean absolute error (MAE) criteria are used for model comparison. The study reveals that the proposed model is more appropriate than the exponential smoothing method. Keywords: forecasting model, steel demand uncertainty, hierarchical Bayesian framework, exponential smoothing method

Authors: Putul Haldar, Yogendra Singh, D. K. Paul
Abstract:
Un-Reinforced Masonry (URM) infilled RC framed buildings are the most common construction practice for modern multi-storey buildings in India like many other parts of the world. Although the behavior and failure pattern of the global structure changes significantly due to infill-frame interaction, the general design practice is to treat them as non-structural elements and their stiffness, strength and interaction with frame is often ignored, as it is difficult to simulate. Indian Standard, like many other major national codes, does not provide any explicit guideline for modeling of infills. This paper takes a stock of controlling design provisions in some of the major national seismic design codes (BIS 2002; CEN 2004; NZS-4230 2004; ASCE-41 2007) to ensure the desired seismic performance of infilled frame. Most of the national codes on seismic design of buildings still lack in adequate guidelines on modeling and design of URM infilled frames results in variable assumption in analysis and design. This paper, using nonlinear pushover analysis, also presents the effect of one of such assumptions of conventional ‘simultaneous’ analysis procedure of infilled frame on the seismic performance of URM infilled RC frame buildings. Keywords: URM infills, RC frame, seismic design codes, construction sequence of infilled frame

Authors: Abdulrahman S. Alqahtani
Abstract:
The revolution of computing and networks could revolutionise terrorism in the same way that it has brought about changes in other aspects of life. The modern technological era has faced countries with a new set of security challenges. There are many states and potential adversaries who have the potential and capacity in cyberspace, which makes them able to carry out cyber-attacks in the future. Some of them are currently conducting surveillance, gathering and analysis of technical information, and mapping of networks and nodes and infrastructure of opponents, which may be exploited in future conflicts. This poster presents the results of the quantitative study (survey) to test the validity of the proposed theoretical framework for the cyber terrorist threats. This theoretical framework will help to in-depth understand these new digital terrorist threats. It may also be a practical guide for managers and technicians in critical infrastructure, to understand and assess the threats they face. It might also be the foundation for building a national strategy to counter cyberterrorism. In the beginning, it provides basic information about the data. To purify the data, reliability and exploratory factor analysis, as well as confirmatory factor analysis (CFA) were performed. Authors: Shotiros Protong
Abstract:
The incidents of sudden landslides in Thailand during the past decade have occurred frequently and more severely. It is necessary to focus on the principal parameters used for analysis such as land cover land use, rainfall values, characteristic of soil and digital elevation model (DEM). The combination of intense rainfall and severe monsoons is increasing due to global climate change. Landslide occurrences rapidly increase during intense rainfall especially in the rainy season in Thailand which usually starts around mid-May and ends in the middle of October. The rain-triggered landslide hazard analysis is the focus of this research. The combination of geotechnical and hydrological data are used to determine permeability, conductivity, bedding orientation, overburden and presence of loose blocks. The regional landslide hazard mapping is developed using the Slope Stability Index SINMAP model supported on Arc GIS software version 10.1. Geological and land use data are used to define the probability of landslide occurrences in terms of geotechnical data. The geological data can indicate the shear strength and the angle of friction values for soils above given rock types, which leads to the general applicability of the approach for landslide hazard analysis. To address the research objectives, the methods are described in this study: setup and calibration of the SINMAP model, sensitivity of the SINMAP model, geotechnical laboratory, landslide assessment at present calibration and landslide assessment under future climate simulation scenario A2 and B2. In terms of hydrological data, the millimetres/twenty-four hours of average rainfall data are used to assess the rain triggered landslide hazard analysis in slope stability mapping. During 1954-2012 period, is used for the baseline of rainfall data at the present calibration. The climate change in Thailand, the future of climate scenarios are simulated by spatial and temporal scales. The precipitation impact is need to predict for the climate future, Statistical Downscaling Model (SDSM) version 4.2, is used to assess the simulation scenario of future change between latitude 16o 26’ and 18o 37’ north and between longitude 98o 52’ and 103o 05’ east by SDSM software. The research allows the mapping of risk parameters for landslide dynamics, and indicates the spatial and time trends of landslide occurrences. Thus, regional landslide hazard mapping under present-day climatic conditions from 1954 to 2012 and simulations of climate change based on GCM scenarios A2 and B2 from 2013 to 2099 related to the threshold rainfall values for the selected the study area in Uttaradit province in the northern part of Thailand. Finally, the landslide hazard mapping will be compared and shown by areas (km2 ) in both the present and the future under climate simulation scenarios A2 and B2 in Uttaradit province. Keywords: landslide hazard, GIS, slope stability index (SINMAP), landslides, Thailand

Procedia PDF Downloads 2484948 Impact of Instructional Designing in Digital Game-Based Learning for Enhancing Students' Motivation
Authors: Shafaq Rubab
Abstract:
The primary reason for dropping out of school is associated with students’ lack of motivation in class, especially in mathematics. Digital game-based learning is an approach that is being actively explored; there are very few learning games based on proven instructional design models or frameworks due to which the effectiveness of the learning games suffers. The purpose of this research was twofold: first, developing an appropriate instructional design model and second, evaluating the impact of the instructional design model on students’ motivation. This research contributes significantly to the existing literature in terms of student motivation and the impact of instructional design model in digital game-based learning. The sample size for this study consists of two hundred out-of-school students between the age of 6 and 12 years. The research methodology used for this research was a quasi-experimental approach and data was analyzed by using the instructional material motivational survey questionnaire which is adapted from the Keller Arcs model. Control and experimental groups consisting of two hundred students were analyzed by utilizing instructional material motivational survey (IMMS), and comparison of result from both groups showed the difference in the level of motivation of the students. The result of the research showed that the motivational level of student in the experimental group who were taught by the game was higher than the student in control group (taught by conventional methodology). The mean score of the experimental group against all subscales (attention, relevance, confidence, and satisfaction) of IMMS survey was higher; however, no statistical significance was found between the motivational scores of control and experimental group. The positive impact of game-based learning on students’ level of motivation, as measured in this study, strengthens the case for the use of pedagogically sound instructional design models in the design of interactive learning applications. In addition, the present study suggests learning from interactive, immersive applications as an alternative solution for children, especially in Third World countries, who, for various reasons, do not attend school. The mean score of experimental group against all subscales of IMMS survey was higher; however, no statistical significance was found between motivational scores of control and experimental group. Keywords: digital game-based learning, students’ motivation, and instructional designing, instructional material motivational survey

The establishment of the European Union signified the culmination of the supra-national power addressing economic, political, legal and humanitarian matters within and above a national territory. Human rights have taken a protagonist role as one of the pressing concerns that the EU addresses, and one of the most critical problems is that of human trafficking. This multi-billion dollar criminal business represents $31.6 per year made out of 2.5 million trafficked persons worldwide, making it one of the most crucial human rights problems in the world to address. The EU has developed strategies to tackle this issue through supra-national governance, however, how have they fared? What is the impact of its development on the issue? This paper will address the direct and indirect impact of the formation of the European Union as a supranational political and economic entity on the illicit industry of human trafficking in Europe. It attempts to analyse first, the situation of human trafficking in Europe, as an attempt to understand its importance in the region, addressing its root causes and the role of the states addressed. Second, the paper will examine the impact of the EU on human breaking down its policy-making at a supranational level, the role of the economic integration of the region, and the change of migration patterns since its inception. Keywords: human trafficking, human rights, European union, criminal business

Authors: Claire P. Griffin
Abstract:
The education provision for students with special educational needs, including students with Autism Spectrum Disorder (ASD), has undergone significant national and international changes in recent years. In particular, an increase in resource-based provision has occurred across educational settings in an effort to support inclusive practices. This paper seeks to explore the role of the Special Needs Assistant (SNA) in supporting children with ASD in Irish schools. This research stems from the second national evaluation of ‘Education Provision for Students with Autism Spectrum Disorder in Ireland’ (NCSE, 2016). This research was commissioned by the National Council for Special Education (NCSE) in Ireland and conducted by a team of researchers from Mary Immaculate College, Limerick from February to July 2014. This study involved a multiple case study research strategy across 24 educational sites, as selected through a stratified sampling process. Research strategies included semi-structured interviews, classroom observations, documentary review and child conversations. Data analysis was conducted electronically using Nvivo software, with use of an additional quantitative recording mechanism based on scaled weighting criteria for collected data. Based on such information, key findings from the NCSE national evaluation will be presented and critically reviewed, with particular reference to the role of the SNA in supporting pupils with ASD. Examples of positive practice inherent within the SNA role will be outlined and contrasted with discrete areas for development. Based on such findings, recommendations for the evolving role of the SNA will be presented, with the aim of informing both policy and best practice within the field. Keywords: autism spectrum disorder, inclusive education , paraprofessional, special needs assistant

Abstract:
Inclusive education services for students with Autism remains in its early developmental stages in Thailand. Despite many more children with autism are attending schools since the Thai government introduced the Education Provision for People with Disabilities Act in 2008, the services students with autism and their families receive are generally lacking. This quantitative study used Attitude and Preparedness to Teach Students with Autism Scale (APTSAS) to investigate 110 primary school teachers’ attitude and preparedness to teach students with autism in the general education classroom. Descriptive statistical analysis of the data found that student behavior was the most significant factor in building teachers’ negative attitudes students with autism. The majority of teachers also indicated that their pre-service education did not prepare them to meet the learning needs of children with autism in particular, those who are non-verbal. The study is significant and provides direction for enhancing teacher education for inclusivity in Thailand. Keywords: attitude, autism, teachers, thailandsports activates, movement skills, motor skills
