2500 Judicial Personality: Observing the Acceptable Limits
Authors: Sonia Anand Knowlton
Abstract:
In many ways, judges can express their personality within and beyond their role as a judge. Judges can use their unique backgrounds and life experiences to inform their legal reasons and can also participate in certain extrajudicial activities outside of their role on the bench. For many judges, the line between the expression of this judicial personality, on the one hand, and the consequence of jeopardizing the public’s perception of their impartiality, on the other, is ambiguous if not wholly unclear. In the famous Canadian decision R v RDS, for instance, a Black judge who was hearing a case about police violence against a Black person was accused of being biased after she acknowledged that her community’s racial dynamics may have impacted the police’s conduct. Many within the legal community might find comfort in the belief that judges do not need to bring their ‘personality’ to the bench in order to uncover the law’s truths and impartially apply it. Indeed, and for a good reason, judges are often discouraged from allowing their personality to shine through in their role as a judge – because the expression of judicial personality can compromise the public perception of the impartiality of the administration of justice. This paper evaluates the theoretical constraints on the expression of judicial personality as a tool for legal decision-making and argues that judges from minority groups are held to a higher level of impartiality. Specifically, minority judges are disproportionately constrained from 1) using life experience to apply the law and 2) engaging in certain extrajudicial activities. Keywords: judging, legal decision making, judicial personality, extrajudicial activities

Authors: Maritz Lourens Van Rensburg, Chantel Niebuhr
Abstract:
Utilizing all available renewable energy sources is an ever-growing necessity, this includes a newfound interest into hydrokinetic energy systems, which open the door to installations where conventional hydropower shows no potential. Optimization and obtaining high efficiencies are key in these installations. In this study a vertical axis Darrieus hydrokinetic turbine is designed and constructed to address certain drawbacks experience by axial flow horizontal axis turbines in an irrigation channel. Many horizontal axis turbines have been well developed and optimized to have high efficiencies but depending on the conditions experienced in an open channel, the performance of these turbines may be adversely affected. The study analyses how the designed vertical axis turbine addresses the problems experienced by a horizontal axis turbine while still achieving a satisfactory efficiency. To be able to optimize the vertical axis turbine, a computational fluid dynamics model was validated to the experimental results obtained from the power generated from a test turbine installation operating at various rotational speeds. It was found that an accurate validated model can be obtained through validation of generated power output. Keywords: hydrokinetic, Darrieus, computational fluid dynamics, vertical axis turbine

Procedia PDF Downloads 3632496 A Mixed-method Study of Psychological Empowerment in Child Protection Practitioners
Authors: Amy Bromley
Abstract:
Child protection practitioners are a vital part of systems designed to protect children from abuse and neglect. Reforms in Anglo-American systems have shown a trend towards compliance-culture that reduces practitioner autonomy and empowerment, increasing staff turnover and negatively impacting outcomes for children. This explanatory mixed-methods study examined psychological empowerment in a national sample of child protection practitioners in Australia (n=109) using the Psychological Empowerment Instrument followed by semi-structured interviews (n=19). The results show that practitioners experience the sub-dimensions of psychological empowerment differently, perceiving themselves to have high levels of competence and satisfaction in their work but limited opportunities for self-determination and low levels of impact on decision-making in their organizations. The qualitative data revealed that practitioners do not trust systemic reforms and have experienced them as ineffective, politically driven, and bureaucratic. The increased compliance demanded from these reforms has left practitioners feeling that their expertise is not valued, leading many to leave their organizations. The practitioners who remain employed in child protection identified their use of advocacy, curiosity, and child-centered values as ways of protecting their psychological empowerment. The findings highlight the ways psychological empowerment can be promoted within child protection systems, improving staff retention and building expertise. Keywords: child protection, implementation, psychological empowerment, systems theory

Authors: Okikiola Olusanu
Abstract:
Power dynamics, one of the lasting effects of the legacies of coloniality, left an indelible scar on our identity and space. This structure ensures a system that deliberately slows down the pace of the colonizer, either within her space or while traveling the world of the colonizer. The politics of oppression through the intersection of race, gender, class, and sex empowers the ideology of sameness and difference. This ideology regulates and sustains the borderlines of the colonizers’ space. Sociologists, anti-colonialists, and feminist theorists have argued that the restrictions that the colonized experience while traveling to the space of the colonizers can be interpreted as an inter-body war that reinforces gender, class, and race inequalities. To foster belonging and accessibility, this study examines the effect of colonial legacy restrictions on traveling. This paper aims to deconstruct the coloniality of knowledge, space, and body for a transnational and decolonial identity transcending borders. it argue that borders are intentionally constructed to keep the other at a significant distance, like identity. We deduce that travel restriction is antibody because the pace is slow, and access is limited. For the analysis of this study, this study examines how the perception of the body of the colonizer influence her travail when traveling to and through the space of the ex-colonizer and the measures necessary for the decolonization of knowledge, space and body. Our interest is not in moving physical borders from space, it is rather in decolonizing the mind that create systematic, social, and political borders. Keywords: space, body, travel, identity

Authors: Rita Garcia
Abstract:
Intelligent Programming Tutors, IPTs, are supplemental educational devices that assist in teaching software development. These systems provide customized learning allowing the user to select the presentation pace, pedagogical strategy, and to recall previous and additional teaching materials reinforcing learning objectives. In addition, IPTs automatically records individual’s progress, providing feedback to the instructor and student. These tutoring systems have an advantage over Tutoring Systems because Intelligent Programming Tutors are not limited to one teaching strategy and can adjust when it detects the user struggling with a concept. The Intelligent Programming Tutor is a category of Intelligent Tutoring Systems, ITS. ITS are available for many fields in education, supporting different learning objectives and integrate into other learning tools, improving the student's learning experience. This study provides a comparison of the IPTs currently adopted by the educational community and will focus on the different teaching methodologies and programming languages. The study also includes the ability to integrate the IPT into other educational technologies, such as massive open online courses, MOOCs. Authors: Monika Paleczna, Barbara Szmigielska
Abstract:
Adolescence is a developmental period, covering the period from 10 to 20 years of age, in which young people face many challenges. One of the most important tasks of the adolescence period is getting a structured identity. The development of identity is possible by undertaking various activities. Nowadays, virtual activities are very common among young people. One of the main adolescents’ activities in the online environment is playing computer games. The main aim of this work is to answer the question about the relationship between the identity style of adolescents and immersion, -a phenomenon often observed while playing computer games. The concept of identity created by Berzonsky is considered as one of the best-defined concepts of identity. He defines identity as both a structure and a process and distinguishes three styles of identity: informational, normative, and diffuse/avoidant. Immersion is a concept that can be applied in a broad context, but in the game environment, it is a specific psychological experience of being involved in a computer game. It refers to the relocation of the attention resources to the game world, with a limited or impossible perception of stimuli from reality. Considering how much time adolescents spend playing computer games, the question about the relationship between their identity and the immersion in the game seems to be extremely interesting. Fifty adolescents aged 15-17 participated in the study. They played a computer game and completed the Identity Style Inventory and the Immersion Questionaire. Keywords: identity, immersion, computer games, adolescence

Abstract:
Today online education has gained more popularity so that people can easily complete their curriculum on their own time. Virtual learning has been widely used by many educators, especially in higher education institutions due to its benefits to students and faculty. A good knowledge of teaching theory and instructional design systems is required to experience meaningful learning. However, most educational websites are not designed to adapt to all screen sizes. Making the website accessible on all screen sizes is our main objective, so we have created a website that is readily accessible across all screen sizes and accepts all types of payment methods. And we see generally educational websites interface is simple and unexciting. So, we have made a user interface attractive and user friendly. It is not enough for a website to be user-friendly, but also to be familiar to admins and to reduce the workload of the admin as well. We visited so many popular websites under development that they all had issues like responsiveness, simple interface, security measures, payment methods, etc. To overcome this limitation, we have created a website which has taken care of security issues that is why we have created only one admin id and it can be control from that only. And if the user has successfully done the payment, then the admin can send him a username and password through mail individually so there will no fraud in the payment of the course. Keywords: responsive, accessible, attractive, interface, objective, security.

Abstract:
This paper presents a technical approach to analysis of security of SCADA systems. Main goal of the paper is to make SCADA administrators aware of risks resulting from SCADA systems usage and to familiarize with methods that can be adopt to existing or planned system, to increase overall system security level. Because SCADA based systems become a industrial standard, more attention should be paid to the security of that systems. Industrial Control Systems (ICS) like SCADA are responsible for controlling crucial aspects of wide range of industrial processes. In pair with that responsibility, goes a lot of money that can be earned or lost – this fact is main reason of increased interest of attackers. Additionally ICS are often responsible for maintaining resources strategic from the point of view of national economy, like electricity (including nuclear power plants), heating, water resources or military facilities, so they can be targets of terrorist cybernetic attacks. Without proper risk analysis and management, vulnerabilities resulting from the usage of SCADA can be easily exploited by potential attacker. Paper is based mostly on own experience in systems security, gathered during academic studies and professional work in international company. As title suggests, it will cover only basics of topic, because every of points mentioned in the document can be base for additional research and papers. Keywords: denial of service, SCADA, security policy, distributed network

Authors: A. Saimen, E. Armstrong, C. Manitshana
Abstract:
Intimate partner violence (IPV) has been recognised as a global human rights violation. It is universally under diagnosed and the institution of timeous multi-faceted interventions has been noted to benefit IPV victims. Currently, the concept of using a screening tool to detect IPV has not been widely explored in a primary healthcare setting in South Africa, and it was for this reason that this study has been undertaken. A systematic random sampling of 1 in 8 women over a period of 3 months was conducted prospectively at the OPD of a Level 1 Hospital. Participants were asked about their experience of IPV during the past 12 months. The WAST-short, a two-question tool, was used to screen patients for IPV. To verify the result of the screening, women were also asked the remaining questions from the WAST. Data was collected from 400 participants, with a response rate of 99.3%. The prevalence of IPV in the sample was 32%. The WAST-short was shown to have the following operating characteristics: sensitivity 45.2%, specificity 98%,positive predictive value 98%, negative predictive value 79%. The WAST-short lacks sufficient sensitivity and therefore is not an ideal screening tool for this setting. Improvement in the sensitivity of the WAST-short in this setting may be achieved by lowering the threshold for a positive result for IPV screening, and modification of the screening questions to better reflect IPV as understood by the local population. Keywords: domestic violence, intimate partner violence, screening, screening tools

Authors: Mohammad Abdulaziz Algrnas, Emma Mulliner
Abstract:
Housing projects have been established in Saudi Arabia, by both government and private construction companies, to meet the increasing demand from Saudi inhabitants across the country. However, the real estate market supply does not meet consumer preference requirements. Preferences normally differ depending on the consumer’s situation, such as the household’s sociological characteristics (age, household size and composition), resources (income, wealth, information and experience), tastes and priorities. Collecting information about consumer attitudes, preferences and perceptions is important for the real estate market in order to better understand housing demand and to ensure that this is met by appropriate supply. The aim of this paper is to identify consumer preferences for housing in Saudi Arabia. A quantitative closed-ended questionnaire was conducted with housing consumers in Saudi Arabia in order to gain insight into consumer needs, current household situation, preferences for a number of investigated housing attributes and consumers’ perceptions around the current housing problem. 752 survey responses were obtained and analysed in order to describe preferences for housing attributes and make comparisons between groups. Factor analysis was also conducted to identify and reduce the attributes. The results indicate a difference in preference according to the gender of the respondents and depending on their region of residence. Keywords: housing attributes, Saudi Arabia, consumer preferences, housing preferences

Abstract:
Adults with age 50 and older will include more than 70% of the diabetic populace by the year 2025. More established patients with diabetes are more inclined to have concurrent ceaseless conditions like hypertension, dyslipidemia, and cardiovascular sickness that may affect their nutritious necessities. The issue of achievement and support of an ideal body weight in elderly diabetic persons may not be as direct as in other age gatherings, and the risk-benefit ratio may be diverse too. Albeit expanded predominance of overweight and weight in the elderly adds to insulin resistance and hyperglycemia, more seasoned tenants of long haul care offices who experience the ill effects of diabetes have a tendency to be underweight. Both may mean insufficient nutritional status and lead to expanded grimness and mortality. The attendant problems of appetite changes, palatability of food, dietary restrictions, loneliness, and depression may influence the sort and amount of food devoured by elderly persons. Organized screening devices may recognize nutrition related issues that warrant proof based mediations. Authors: Orpita U. Laz, Ataur Rahman
Abstract:
Climate change will affect various aspects of hydrological cycle such as rainfall. A change in rainfall will affect flood magnitude and frequency in future which will affect the design and operation of hydraulic structures. In this paper, trends in sub-hourly, sub-daily, and daily extreme rainfall events from 18 rainfall stations located in Tasmania, Australia are examined. Two non-parametric tests (Mann-Kendall and Spearman’s Rho) are applied to detect trends at 10%, 5%, and 1% significance levels. Sub-hourly (6, 12, 18, and 30 minutes) annual maximum rainfall events have been found to experience statistically significant upward trends at 10 % level of significance. However, sub-daily durations (1 hour, 3 and 12 hours) exhibit decreasing trends and no trends exists for longer duration rainfall events (e.g. 24 and 72 hours). Some of the durations (e.g. 6 minutes and 6 hours) show similar results (with upward trends) for both the tests. For 12, 18, 60 minutes and 3 hours durations both the tests show similar downward trends. This finding has important implication for Tasmania in the design of urban infrastructure where shorter duration rainfall events are more relevant for smaller urban catchments such as parking lots, roof catchments and smaller sub-divisions.Keywords: climate change, design rainfall, Mann-Kendall test, trends, Spearman’s Rho, Tasmania

Authors: Seyed Hamed Mousavi, Juha M. Hijmans, Reza Rajabi, Ron Diercks, Johannes Zwerver, Henk van der Worp
Abstract:
Introduction: Running is one of the most popular sports activity among people. Improper sagittal plane ankle, knee and hip kinematics are considered to be associated with the increase of injury risk in runners. Motion assessing smart-phone applications are increasingly used to measure kinematics both in the field and laboratory setting, as they are cheaper, more portable, accessible, and easier to use relative to 3D motion analysis system. The aims of this study are 1) to compare the results of 3D gait analysis system and CE; 2) to evaluate the test-retest and intra-rater reliability of coach’s eye (CE) app for the sagittal plane hip, knee, and ankle angles in the touchdown and toe-off while running. Method: Twenty subjects participated in this study. Sixteen reflective markers and cluster markers were attached to the subject’s body. Subjects were asked to run at a self-selected speed on a treadmill. Twenty-five seconds of running were collected for analyzing kinematics of interest. To measure sagittal plane hip, knee and ankle joint angles at touchdown (TD) and toe off (TO), the mean of first ten acceptable consecutive strides was calculated for each angle. A smartphone (Samsung Note5, android) was placed on the right side of the subject so that whole body was simultaneously filmed with 3D gait system during running. All subjects repeated the task with the same running speed after a short interval of 5 minutes in between. The CE app, installed on the smartphone, was used to measure the sagittal plane hip, knee and ankle joint angles at touchdown and toe off the stance phase. Results: Intraclass correlation coefficient (ICC) was used to assess test-retest and intra-rater reliability. To analyze the agreement between 3D and 2D outcomes, the Bland and Altman plot was used. The values of ICC were for Ankle at TD (TRR=0.8,IRR=0.94), ankle at TO (TRR=0.9,IRR=0.97), knee at TD (TRR=0.78,IRR=0.98), knee at TO (TRR=0.9,IRR=0.96), hip at TD (TRR=0.75,IRR=0.97), hip at TO (TRR=0.87,IRR=0.98). The Bland and Altman plots displaying a mean difference (MD) and ±2 standard deviation of MD (2SDMD) of 3D and 2D outcomes were for Ankle at TD (MD=3.71,+2SDMD=8.19, -2SDMD=-0.77), ankle at TO (MD=-1.27, +2SDMD=6.22, -2SDMD=-8.76), knee at TD (MD=1.48, +2SDMD=8.21, -2SDMD=-5.25), knee at TO (MD=-6.63, +2SDMD=3.94, -2SDMD=-17.19), hip at TD (MD=1.51, +2SDMD=9.05, -2SDMD=-6.03), hip at TO (MD=-0.18, +2SDMD=12.22, -2SDMD=-12.59). Discussion: The ability that the measurements are accurately reproduced is valuable in the performance and clinical assessment of outcomes of joint angles. The results of this study showed that the intra-rater and test-retest reliability of CE app for all kinematics measured are excellent (ICC ≥ 0.75). The Bland and Altman plots display that there are high differences of values for ankle at TD and knee at TO. Measuring ankle at TD by 2D gait analysis depends on the plane of movement. Since ankle at TD mostly occurs in the none-sagittal plane, the measurements can be different as foot progression angle at TD increases during running. The difference in values of the knee at TD can depend on how 3D and the rater detect the TO during the stance phase of running. Keywords: reliability, running, sagittal plane, two dimensional

Authors: Y. Venturini, C. Tintori
Abstract:
Given the continuous demand for improved readout performances in particle and dark matter physics, CAEN SpA is pushing on the development of advanced technologies for detector readout. We present the Digitizers 2.0, the result of the success of the previous Digitizers generation, combined with expanded capabilities and a renovation of the user experience introducing the open FPGA. The first product of the family is the VX2740 (64 ch, 125 MS/s, 16 bit) for advanced waveform recording and Digital Pulse Processing, fitting with the special requirements of Dark Matter and Neutrino experiments. In parallel, CAEN is developing the FERS-5200 platform, a Front-End Readout System designed to read out large multi-detector arrays, such as SiPMs, multi-anode PMTs, silicon strip detectors, wire chambers, GEM, gas tubes, and others. This is a highly-scalable distributed platform, based on small Front-End cards synchronized and read out by a concentrator board, allowing to build extremely large experimental setup. We plan to develop a complete family of cost-effective Front-End cards tailored to specific detectors and applications. The first one available is the A5202, a 64-channel unit for SiPM readout based on CITIROC ASIC by Weeroc. Keywords: dark matter, digitizers, front-end electronics, open FPGA, SiPM

Authors: Paula C. Latorre Arroyo, Andrea C. Latorre Arroyo
Abstract:
In the present society, children are exposed to and impacted by technology from very early on in various ways. Artificial intelligence (AI), in particular, directly affects them, be it positively or negatively. The concept of artificial intelligence is commonly defined as the technological programming of computers or robotic mechanisms with humanlike capabilities and characteristics. These technologies are often designed as helpful machines or disguised as handy tools that could ultimately steal private information for illicit purposes. Children, being one of the most vulnerable groups due to their lack of experience and knowledge, do not have the ability to recognize or have the malice to distinguish if an apparatus with artificial intelligence is good or bad for them. For this reason, as a society, there must be a sense of responsibility to regulate and monitor different types of uses for artificial intelligence to protect children from potential risks that might arise. This article aims to investigate the many implications that artificial intelligence has in the lives of children, starting from a home setting, within the classroom, and, ultimately, in online spaces. Irrefutably, there are numerous beneficial aspects to the use of artificial intelligence. However, due to its limitless potential and lack of specific and substantial regulations to prevent the illicit use of this technology, safety and privacy concerns surface, specifically regarding the youth. This written work aims to provide an in-depth analysis of how artificial intelligence can both help children and jeopardize their safety. Concluding with resources and data supporting the aforementioned statement. Keywords: artificial intelligence, children, privacy, rights, safety

Authors: Huidan Niu
Abstract:
Existing research has focused extensively on teachers’ professional experience in education reforms. However, there is a lack of research on the role and influence of teacher unions in education policy. This study aimed to examine how teacher unions frame teacher professionalisation and professionalism discourses. Critical education policy scholarship study was adopted. This study positioned teacher professionalisation and professionalism discourses within their socio-political contexts to explore how the meanings of teacher professionalisation and professionalism are constructed, as well as how teacher unions, as collective actors, shape these discourses. This study examined the development of professionalisation and professionalism discourses in the two main teacher unions in Aotearoa, New Zealand, the New Zealand Educational Institute, TeRiuRoa (NZEI), and the New Zealand Post-Primary Teachers’ Association, TeWehengarua (PPTA). The data were collected from documents and archival material, as well as elite interviews. Twenty-four union leaders, including national presidents, secretaries, executives, and senior union officials, participated in the study. The data analysis followed a grounded theory method: from codes to themes. The findings of the study suggest that the teacher unions, as teachers’ collective (powerful) voices, appeared to highlight tension and confrontation between the teaching profession and governments with respect to the meanings of teacher professionalisation and professionalism. Keywords: critical education policy scholarship, governments, teacher professionalisation, teacher professionalism, teacher unions

Authors: Sana Tahir, Haya Fatimah
Abstract:
Sexuality is a social construct which is considered as the most confidential affair among individuals where women tend to refrain themselves more from sexually explicit behavior than men. Patriarchy has an elevated influence on the expression of female sexuality. While women’s sexual experiences are suppressed men are entitled to pleasure themselves according to their desire. The purpose of this study is to explore how the internalization of patriarchy affects women’s sexuality. Similarly, it was investigated how women sexuality is associated with psychological distress. The sample consisted of 100(age 20-40) married women. Participants were selected through a combination of convenient and snowball sampling. Women were asked to provide data regarding patriarchal beliefs, sexual awareness and DAS (depression, anxiety, and stress). Pearson Product Moment Correlation Analyze was conducted to examine the nature of the relationship between patriarchal beliefs, sexual awareness and psychological distress in married women. There is a significant negative relation between sexual awareness and patriarchal beliefs (r=-.391, p<.001). There also lies a significant negative relation between sexual awareness and depression, anxiety, stress (r=-.359, p<.001) (r=.301, p=.002) (r=-.221, p=.027). The results reveal that women with strong patriarchal beliefs have less sexual awareness in terms of sexual consciousness, sexual monitoring, sexual assertiveness and sexual appeal consciousness. Similarly, women with strong patriarchal beliefs and less sexual awareness have high levels of depression, anxiety, and stress. Keywords: female sexuality, patriarchy, psychological distress, sexual awareness

Authors: Tewele Gerlase Haile
Abstract:
Like any other country, Ethiopia's state government has reached today by undergoing many political changes. Until the last quarter of the 19th century, the aristocratic regimes of Ethiopia were using their infinite mystical power to shape the traditional public administrative institutions of the country. Mystical, feudal, social, and revolutionary political systems were used as sources of ruling power to the long-lasted monarchical, military and dictatorial regimes. For a country that is struggling to escape from the vicious cycle of poverty, famines, and civil wars, understanding how political regimes reform public policies and institutions is necessary for several reasons. A retrospective policy analysis approach is employed to determine how public policies are shaped by institutional factors and why the traditional public administration paradigm of Ethiopia continues to date despite regime changes. Using the experiences of political reforms practiced in four successive regimes (1916-2023), this retrospective analysis reveals a causal relationship among policy, institutional, and political failures. Moreover, Ethiopia's law-making and policy-making background significantly reflects the behavior of governments and their institutions. With a macro-level policy analysis in mind, the paper analyzes why the recent policy and institutional reforms twisted the country into unresolved military catastrophes. Keywords: public administration, public policy, institutional reform, political structure
