48992 Evolving Jurisprudence of Rape Laws in India: A Study of Last One Decade
Authors: Drutika Upadhyay
Abstract:
Rape is one of the most heinous crimes committed against the body of a woman violating her privacy and dignity. The Right to Privacy and the Right to Live with Dignity constitute the very essence of the Right to Life and Personal Liberty, a Fundamental Right guaranteed under Article 21 of the Indian Constitution. The study is conducted with the primary objective of analyzing the efficacy of rape laws in India. The study begins by explaining the origin, meaning, and kinds of rape recognised under Indian jurisprudence. Further, it explains various statutory and penal provisions relating to rape and the loopholes in such provisions. It focuses on the procedure followed during investigation and trial and also aims at developing an understanding of the rights of the victim and the sentence in cases of rape. The study also throws some light upon the amendments made to the criminal law and the recommendations of the Law Commission of India to meet the demands of the changing criminal justice delivery system. The outcome of the study suggests that the laws relating to rape have proved to be a major failure owing to the lack of proper implementation. Also, the lack of education among the masses leads to gender biasness, which is the ultimate cause for the commission of such crime. At last, the author concludes that the present criminal law system of the country contains various lacunae that need to be filled in so as to make the criminal justice system more stringent. Further, the scope of the definition of ‘rape’ needs to be widened in order to include such other acts of non-consensual and sexual nature that are currently not included in the definition. The author has adopted a non-doctrinal and analytical approach and relied upon the secondary sources of data for the purpose of the study. The scope of the study is limited to the crime committed against women. Keywords: amendment, criminal law, fundamental right, personal liberty, privacy, rape

Authors: Rafia Afroz
Abstract:
This article examines the perceptions, consciousness and attitudes of farmers on climate change in Kedah Malaysia. To reach the objectives of this study, a survey was conducted on 350 farmers and the collected data were used to perform multiple regression analysis. The results show that factors such as age, farm income, farm experience, limited agricultural prevalence, inadequacies in credit availability and farm size are factors influencing adjustment practices. Moreover, farmers have a positive attitude through adaptation strategies that are appropriate for climate change issues. However, the study found that various adaptation barriers prevented farmers from implementing climate change adjustment policies. At present, Malaysia does not seem to have a specific policy aimed at counteracting the impacts and productivity of climate change on individual sectors. For this reason, the findings of this study will help policymakers to comply with an appropriate policy framework that takes into account the best fit alignment strategies that can come across all relevant obstacles. Keywords: climate change, adaptation, awareness, perception, attitude

Authors: Artiya Sopharak, Tosaphol Ratniyomchai, Thanatchai Kulworawanichpong
Abstract:
This paper presents an energy-saving study of Mass Rapid Transit (MRT) using an optimal train coasting operation. For the dynamic train movement with four modes of operation, including accelerating mode, constant speed or cruising mode, coasting mode, and braking mode are considered in this study. The acceleration rate, the deceleration rate, and the starting coasting point are taken into account the optimal train speed profile during coasting mode with considering the energy saving and acceptable travel time comparison to the based case with no coasting operation. In this study, the mathematical method as a Quadratic Search Method (QDS) is conducted to carry out the optimization problem. A single train of MRT services between two stations with a distance of 2 km and a maximum speed of 80 km/h is taken to be the case study. Regarding the coasting mode operation, the results show that the longer distance of costing mode, the less energy consumption in cruising mode and the less braking energy. On the other hand, the shorter distance of coasting mode, the more energy consumption in cruising mode and the more braking energy. Keywords: energy saving, coasting mode, mass rapid transit, quadratic search method

Abstract:
In this field study, it is hypothesised that affiliation motivation is relevant to dark terminal technology readiness. The theoretical basis for this work was the TAM 2, focusing on the social process variables and the short-scale technology readiness. Two hypotheses to be tested are the focus of consideration: H1: The TAM constructs are independently positively related to dark device use. H2: Sense of social belonging is positively related to dark device use. In this quantitative study, 30 male subjects participated with their dark devices. Using a post-basket exercise, affiliation is manipulated by content items on the website to investigate whether affiliation between computers and people and smartphones and people leads to similar effects as an affiliation between people. The entire scientific study, including the questionnaire, took about 30 minutes. This study contributes to the current literature and draws attention to the fact that male users' terminal devices have an influence in the form of affiliation effects. Keywords: human-computer-interaction, computers, smartphones, addiction, social affiliation effects, TAM 2, pyramid of needs, social actors

Authors: Elisabeth Eder
Abstract:
Memorizing music plays an important role for instrumentalists and has been researched very little so far. Almost every musician is confronted with memorizing music in the course of their musical career. For numerous competitions, examinations (e.g., at universities, music schools), solo performances, and the like, memorization is a requirement. Learners are often required to learn a piece by heart but are rarely given guidance on how to proceed. This was also confirmed by Eder's preliminary study to examine the topicality and relevance of the topic, in which 111 instrumentalists took part. The preliminary study revealed a great desire for more knowledge or information about learning strategies as well as a greater sense of security when performing by heart on stage through the use of learning strategies by those musicians who use learning strategies. Eder’s research focuses on learning strategies for memorizing music. As part of a large-scale empirical study – an online questionnaire translated into 10 languages was used to conduct the study – 1091 musicians from 64 different countries described how they memorize. The participants in the study also evaluated their learning strategies and justified their choice in terms of their degree of effectiveness. Based on the study and pedagogical literature, 100 learning strategies were identified and categorized; the strategies were examined with regard to their effectiveness, and instrument-specific, age-specific, country-specific, gender-specific, and education-related differences and similarities concerning the choice of learning strategies were investigated. Her research also deals with forms and models of memory and how music-related information can be stored and retrieved and also forgotten again. A further part is devoted to the possibilities that teachers and learners have to support the process of memorization independently of learning strategies. The findings resulting from Elisabeth Eder's research should enable musicians and instrumental students to memorize faster and more confidently. Keywords: memorizing music, learning strategies, empirical study, effectiveness of strategies

Authors: Manoj Malviya, Shubham Shinde
Abstract:
The present study focuses on the determination of torsional stiffness of a space frame chassis and comparison of elements used in the Finite Element Analysis of frame. The study also discusses various concepts and design aspects of a space frame chassis with the emphasis on their applicability in BAJA SAE vehicles. Torsional stiffness is a very important factor that determines the chassis strength, vehicle control, and handling. Therefore, it is very important to determine the torsional stiffness of the vehicle before designing an optimum chassis so that it should not fail during extreme conditions. This study determines the torsional stiffness of frame with respect to suspension shocks, roll-stiffness and anti-roll bar rates. A spring model is developed to study the effects of suspension parameters. The engine greatly contributes to torsional stiffness, and therefore, its effects on torsional stiffness need to be considered. Deflections in the tire have not been considered in the present study. The proper element shape should be selected to analyze the effects of various loadings on chassis while implementing finite element methods. The study compares the accuracy of results and computational time for different element types. Shape functions of these elements are also discussed. Modelling methodology is discussed for the multibody analysis of chassis integrated with suspension arms and engine. Proper boundary conditions are presented so as to replicate the real life conditions. Keywords: space frame chassis, torsional stiffness, multi-body analysis of chassis, element selection
Procedia PDF Downloads 35448983 Post-Structural Study of Gender in Shakespearean Othello from Butlerian Perspective
Authors: Muhammad Shakeel Rehman Hissam
Abstract:
This study aims at analyzing gender in Othello by applying Judith Butler’s Post-Structural theory of gender and gender performance. The analysis of the play provides us context by which we can examine what kinds of effects the drama have on understanding of the researchers regarding gender identity. The study sets out to examine that, is there any evidence or ground in Shakespearean selected work which leads to challenge the patriarchal taken for granted prescribed roles of gender? This would be the focal point in study of Othello that actions and performances of characters determine their gender identity rather than their sexuality. It argues that gender of Shakespearean characters has no constant, fixed and structural impression. On the contrary, they undergo consistent variations in their behavior and performance which impart fluidity and volatility to them. The focal point of the present study is Butler’s prominent work; Gender Trouble: Feminism and subversion of Identity and her post structural theory of Gender performativity as the theoretical underpinning of the text. It analyzes the selected play in Post-Structural gender perspective. The gender-centric plot of the play is riddled with fluidity of gender. The most fascinating aspect of the play is the transformations of genders on the basis of performances by different characters and through these transformations; gender identity is revealed and determined. The study reconstructs the accepted gender norms by challenging the traditional concept of gender that is based on sexual differences of characters. Keywords: post structural, gender, performativity, socio-cultural gender norms, binaries, Othello, Butler, identity

Authors: Ibrahim Özbek, Erdoğan Mehmet Özkan
Abstract:
In this study, we generalize (k,n) threshold secret sharing scheme on the study Ozbek and Siap to the codes over the ring Fq+ αFq. In this way, it is mentioned that the method obtained in that article can also be used on codes over rings, and new advantages to be obtained. The method of securely sharing the key in cryptography, which Shamir first systematized and Massey carried over to codes, became usable for all error-correcting codes. The firewall of this scheme is based on the hardness of the syndrome decoding problem. Also, an open study area is left for those working for other rings and code classes. All codes that correct errors with this method have been the working area of this method. Keywords: secret sharing scheme, linear codes, algebra, finite rings

Authors: Ali Rashash Alzahrani, Elizabeth Stojanovski
Abstract:
Data on various aspects of education are collected at the institutional and government level regularly. In Australia, for example, students at various levels of schooling undertake examinations in numeracy and literacy as part of NAPLAN testing, enabling longitudinal assessment of such data as well as comparisons between schools and states within Australia. Another source of educational data collected internationally is via the PISA study which collects data from several countries when students are approximately 15 years of age and enables comparisons in the performance of science, mathematics and English between countries as well as ranking of countries based on performance in these standardised tests. As well as student and school outcomes based on the tests taken as part of the PISA study, there is a wealth of other data collected in the study including parental demographics data and data related to teaching strategies used by educators. Overall, an abundance of educational data is available which has the potential to be used to help improve educational attainment and teaching of content in order to improve learning outcomes. A multivariate assessment of such data enables multiple variables to be considered simultaneously and will be used in the present study to help develop profiles of students based on performance in mathematics using data obtained from the PISA study. Keywords: cluster analysis, education, mathematics, profiles

Procedia PDF Downloads 13948979 Acquisition of the Attributive Adjectives and the Noun Adjuncts by the L3 Learners of French and German: Further Evidence for the Typological Proximity Model
Authors: Ali Akbar Jabbari
Abstract:
This study investigates the role of the prior acquired languages, Persian and English, concerning the acquisition of the third language (L3) French and German at the initial stages. The data were collected from two groups of L3 learners: 28 learners of L3 French and 21 learners of L3 German, in order to test the placement of the attributive adjectives and the noun adjuncts through a grammaticality judgment task and an element rearrangement task. The aim of the study was to investigate whether any of the models proposed in the L3 acquisition could account for the case of the present study. The results of the analysis revealed that the learners of L3 German and French were both affected by the typological similarity of the previous languages. The outperformance of the German learners is an indication of the facilitative effect of L2 English (which is typologically more similar to the German than that of French). English had also a non-facilitative role in the acquisition of French and this is proved in the lower performance of the French learners. This study provided evidence for the TPM as the most accepted model of L3 acquisition. Keywords: cross-linguistic influence, multilingualism, third language acquisition, transfer

Authors: Rami Al Jafar, Paul Elliott, Konstantinos K. Tsilidis, Abbas Dehghan
Abstract:
Although Ramadan fasting is a ritual that is practiced every year by millions of Muslims, studies on Ramadan fasting are still scarce. To the best of our knowledge, none of the previous studies comprehensively explored the effect on the metabolic profile. In London Ramadan Fasting Study, blood samples were collected from 81 participants before and 10-14 days after Ramadan. Blood samples were analysed using nuclear magnetic resonance (NMR) spectroscopy which covers 249 metabolites. Mixed-effects models were used to analyse collected data and assess the effect of Ramadan fasting on the metabolic profile. Our observational study involved 85 individuals with a mean age of 45.2 years, and 53.1% of them were males. After Ramadan, forty metabolites were affected significantly by Ramadan fasting. Most of these metabolites were metabolites ratios (24), and the rest were three Glycolysis, three ketone bodies, nine Lipoprotein subclasses and one inflammation marker. This study suggests that Ramadan fasting is significantly associated with changes in the metabolic profile. However, the changes are assumed to be temporary, and the long-term effect of these changes is unknown. Keywords: metabolic profile, Ramadan fasting, metabolites, intermittent fasting

Authors: Mohammad Javad Seddighi, Avar Almukhtar
Abstract:
The occurrence of natural disasters, such as floods and earthquakes, can cause significant damage to heritage sites and surrounding areas. In Iran, the city of Bam was devastated by an earthquake in 2003, which had a major impact on the rivers and watercourses around the city. This study aims to investigate the environmental design techniques and sustainable hazard mitigation strategies that can be employed to preserve heritage sites in the face of natural disasters, using the Bam experience as a case study. The research employs a mixed-methods approach, combining both qualitative and quantitative data collection and analysis methods. The study begins with a comprehensive literature review of recent publications on environmental design techniques and sustainable hazard mitigation strategies in heritage conservation. This is followed by a field study of the rivers and watercourses around Bam, including the Adoori River (Talangoo) and other watercourses, to assess the current conditions and identify potential hazards. The data collected from the field study is analysed using statistical methods and GIS mapping techniques. The findings of this study reveal the importance of sustainable hazard mitigation strategies and environmental design techniques in preserving heritage sites during natural disasters. The study suggests that these techniques can be used to prevent the outbreak of another natural disaster in Bam and the surrounding areas. Authors: Maria Magdy Danial Riad
Abstract:
The hypothalamic-pituitary-adrenal axis is activated by the adaptation stress, and this might result in the alteration of certain behavioral signs. The primary purpose of this paper is the adaptive stress effect on dietary behavior, which is directly correlated with changes in plasma cortisol levels. Physiological factors have a role in systems of adaptation and stress. Objectives: Ten clinically healthy cats were included in the study, and they were all kept in the same setting. Methods: On days 1, 5, 9, and 10 of the stay, each cat's behavior was observed through ethograms, and the serum cortisol levels were also measured at the same time. Significant behavioral changes in terms of nutrition were seen on the first day, with 50% of the participants not feeding and all participants not watering. Toward the study's conclusion, between days 5 and 9, there were no longer any discernible changes in the dietary habits, which might be attributed to the adaptation to the new living conditions. Cortisol variations in serological levels were consistent with behavioral changes; in 50% of the participants under observation, there was a substantial increase in values (p<0.05), which gradually declined as the study came to an end. Keywords: domestic cats, ewes, nutritional behavior, adjustment stress, plasma cortisol levels

Authors: Asmaa Sokrat, Aykut Karaman
Abstract:
Public and private spaces are major components of the morphology of the city. This research aims to study the interactions between public and private domains in terms of urban space in Casablanca. The research focuses on a general vision of a socio-spatial issue. It plans to identify the public, private, and transition (semi-public, semi-private) spaces as the constituent of the urban space. Moreover, the study investigates the link between public and private spaces with the social dimensions. Additionally, the research argues that the public space is a place of social interaction; as a reflection, this interaction is the intersection between urban space and social connectedness. Besides, social interaction can be the key to distinguishing between the public and private spheres. The methodological approach of the research is based on the literature review and field study. The article is targeting a case study on the old Medina of Casablanca, from daily use of the public and private spaces, the urban tissue, and the urban space types. In conclusion, the research exhibits that a public space could influence the privacy of the residents of a local urban area; thus, this privacy is inverted on the social interaction. This social interaction is the link between the urban space and social connectedness. Hence, this equation affects the typology of the private space. Keywords: public sphere, private sphere, social connectedness, old Medina of Casablanca

Authors: Barbara Rebecca Mutonyi, Chukwuemeka Echebiri, Terje Slåtten, Gudbrand Lien
Abstract:
The concept of affective commitment to change has been scarcely explored among employees in the higher education literature. The present study addresses this knowledge gap in the literature by examining how various psychological factors, such as psychological empowerment (PsyEmp), and psychological capital (PsyCap), promotes affective commitment to change. As affective commitment to change has been identified by previous studies as an important aspect to implementation behavior, the study examines the correlation of affective commitment to change on employee innovative behavior (EIB) in higher education. The study proposes mediation relationship between PsyEmp, PsyCap, and affective commitment to change. 250 employees in higher education in Norway were sampled for this study. The study employed online survey for data collection, utilizing Stata software to perform Partial least square equation modeling to test the proposed hypotheses of the study. Through bootstrapping, the study was able to test for mediating effects. Findings of the study shows a strong direct relationship between the leadership factor PsyEmp on the individual factor PsyCap ( = 0.453). In addition, the findings of the study reveal that both PsyEmp and PsyCap are related to affective commitment to change ( = 0.28 and = 0.249, respectively). In total, PsyEmp and PsyCap explains about 10% of the variance in the concept of affective commitment to change. Further, the direct effect of effective commitment to change and EIB is also supported ( = 0.183). The three factors, PsyEmp, PsyCap, and affective commitment to change, explains nearly 40% (R2 = 0.39) of the variance found in EIB. The relationship between PsyEmp, PsyCap, and affective commitment to change are mediated through the individual factor PsyCap. In order to effectively promote affective commitment to change among higher education employees, higher education managers should focus on both the leadership factor, PsyEmp, as well as the individual factor, PsyCap, of their employees. In this regard, higher education managers should strengthen employees EIB through providing autonomy, creating a safe environment that encourages innovation thinking and action, and providing employees in higher education opportunities to be involved in changes occurring at work. This contributes to strengthening employees´ affective commitment to change, that further improves their EIB in their work roles as higher education employees. As such, the results of this study implicate the ambidextrous nature of the concepts of affective commitment to change and EIB that should be considered in future studies of innovation in higher education research. Keywords: affective commitment to change, psychological capital, innovative behavior, psychological empowerment, higher education
