905 The Use of Foreign Law by the Constitutional Court of Taiwan: A Case-By-Case Analysis from 1990 to 2017

Abstract:
The increasing transactions among countries worldwide have brought about a trend of comparative law research in the legal community. An important branch of legal research, i.e., constitutional law, is no exception to the trend. The comparative study of constitutional law takes various forms, and one of these is to study the use of foreign law by constitutional courts. There are, in essence, three sources of foreign law usually used by constitutional courts: foreign constitutions, decisions by foreign constitutional courts, and legal theories developed by foreign scholars. There are two types of using foreign law by constitutional courts: citing any of the forenamed sources for reference purpose, ruling based on the contents or logic of any of the forenamed sources. This paper examines all the decisions handed down by the Constitutional Court of Taiwan from 1990 to 2017. Abstract:
In the applications of jet engine, open-jet wind tunnel and airframe, there wildly exists a shear layer formed by the velocity and temperature gradients between jet flow and surrounded medium. The presence of shear layer will refract and reflect the sound path that consequently influences the measurement results in far-field. To investigate and evaluate the shear layer effect, a gradient term suppression and filtering method is adopted to simulate sound propagation through a steady sheared flow in three dimensions. Two typical configurations are considered: one is an incompressible and cold jet flow in wind tunnel and the other is a compressible and hot jet flow in turbofan engine. A numerically linear microphone array is used to localize the position of given sound source. Abstract:
In the realm of flight control, the Proportional- Derivative (PD) control is still widely used for the attitude control in practice, particularly for the pitch control, and the attitude dynamics using PD controller should be investigated deeply. According to the empirical knowledge about the unstable flight dynamics, the control parameter combination conditions to generate sole or finite number of closed-loop oscillations, which is a quite smooth response and is more preferred by practitioners, are presented in analytical or numerical manners. To analyze the effects of the combination conditions of the control parameters, the roots of several polynomials are sought to obtain feasible solutions. These conditions can also be plotted in a 2-D plane which makes the conditions be more explicit by using multiple interval operations. Abstract:
Zinc coating as a sacrificial protection plays an important role in the traditional steel anticorrosion field. Adding second-phase reinforcement particles into zinc matrix is an interesting approach to further enhance its corrosion performance. In this paper, pure Zn and Zn–graphene composite coatings of different graphene contents were prepared by direct current electrodeposition on 304 stainless steel substrate. The coatings were characterized by XRD, SEM/EDS, and Raman spectroscopy. Tafel polarization and electrochemical impedance spectroscopic methods were used to study their corrosion behavior. Result obtained have shown that the concentration of grapheme oxide (GO) in zinc sulfate bath has an important effect on textured structure and surface morphology of Zn–graphene composite coatings. The coating prepared with 1.0g/L GO has shown the best corrosion resistance compared to other coatings prepared in this study.Keywords: Zn-graphene coatings, electrodeposition, microstructure, corrosion behavior

In the last decade, the nature of cathode spot splitting and the current per spot depended on an oblique magnetic field was investigated. This model for cathode current splitting is developed that we have investigated with relationship the magnetic pressures produced by kinetic pressure, self-magnetic pressure, and changed with an external magnetic field. We propose a theoretical model that has been established to an external magnetic field with components normal and tangential to the cathode surface influenced on magnetic pressure strength. Abstract:
A highly sensitive, and selective α-Lipoic acid (ALA) sensor based on a functionalized multi-walled carbon nanotubes-polyindole/Ti2O3 (f-MWCNTs-PIN/Ti2O3) nanocomposite modified glassy carbon electrode (GCE) was developed. The fabricated f-MWCNTs-PIN/Ti2O3/GCE displayed an enhanced voltammetric response for oxidation towards ALA relative to that of a f-MWCNTs/GCE, f-MWCNTs-PIN/GCE, Ti2O3/GCE, and a bare GCE. Under optimum conditions, the f-MWCNTs-PIN/Ti2O3/GCE showed a wide linear range at ALA concentrations of 0.39-115.8 µM. The limit of detection of 12 nM and sensitivity of about 6.39 µA µM-1cm-2. The developed sensor showed anti-interference, reproducibility, good repeatability, and operational stability. Abstract:
Gaussian process (GP) with spectral mixture (SM) kernel demonstrates flexible non-parametric Bayesian learning ability in modeling unknown function. In this work a novel time-varying and non-stationary convolution spectral mixture (TN-CSM) kernel with a significant enhancing of interpretability by using process convolution is introduced. A way decomposing the SM component into an auto-convolution of base SM component and parameterizing it to be input dependent is outlined. Smoothly, performing a convolution between two base SM component yields a novel structure of non-stationary SM component with much better generalized expression and interpretation. The TN-CSM perfectly allows compatibility with the stationary SM kernel in terms of kernel form and spectral base ignored and confused by previous non-stationary kernels. On synthetic and real-world datatsets, experiments show the time-varying characteristics of hyper-parameters in TN-CSM and compare the learning performance of TN-CSM with popular and representative non-stationary GP.Keywords: Gaussian process, spectral mixture, non-stationary, convolution

Abstract:
In 2003 the percentage of students in Shanghai taking part in tertiary education reached 53% of the age cohort, which is at the universal level according to Trow's typology. This achievement led to a conscientious effort by the government to improve internal efficiency of local universities and colleges through a series of programs, the most important of which is the 085 Project. This paper considers the effects of the 085 Project- the 5 initiatives launched in 2008 on increasing the investment to improve institutional overall visibilities, teaching excellence, knowledge innovation, faculty development as well as internationalization. Using the approach of ERC (a theory of equality, reciprocity, and competition) model, it was found that the initiatives helped the lower tier universities and colleges make full play in the aspects of strategic planning and identifying themselves. Abstract:
Automatic vehicle detection using synthetic aperture radar (SAR) image has been widely researched, as well as using optical remote sensing images. However, most researches treat the detection as an independent problem, failing to make full use of SAR data information. In circular SAR (CSAR), the two long borders of vehicle will shrink if the imaging surface is set higher than the reference one. Based on above variance, an automatic vehicle detection using CSAR image is proposed to enhance detection ability under complex environment, such as vehicles’ closely packing, which confuses the detector. The detection method uses the multiple images generated by different height plane to obtain an energy-concentrated image for detecting and then uses the maximally stable extremal regions method (MSER) to detect vehicles. The target population of this research is academics regularly working or long-term visiting in these joint colleges, and semi-structured interviews are used in data collection. Moreover, the theoretical perspectives mainly include Ward’s sociocultural and psychological adaptation theory, Berry’s adaptation strategies and Black and his colleague’s expatriate’s adjustment model. Alkali-active sandstone aggregate was ground by vertical and ball mill into particles with residue over 45 μm less than 12%, and investigations have been launched on particles distribution and characterization of ground sandstone powder, fluidity, heat of hydration, strength as well as hydration products morphology of pastes with incorporation of ground sandstone powder. Results indicated that ground alkali-active sandstone powder with residue over 45 μm less than 8% was easily obtainable, and specific surface area was more sensitive to characterize its fineness with extension of grinding length. Incorporation of sandstone powder resulted in higher water demand and lower strength, advanced hydration of C3A and C2S within 3days and refined pore structure. Based on its manufacturing, characteristics and influence on properties of pastes, it was concluded that sandstone powder was a good selection for use in concrete as mineral admixture.Keywords: concrete, mineral admixture, hydration, structure

Stray animals are on the rise in mainland China's cities. There are legal reasons for this, namely the lack of protection for domestic pets in mainland China, where only wildlife protection laws exist. At a social level, the ease with which families adopt pets and the lack of a social view of animal nature has led to the frequent abandonment and loss of stray animals. If left unmanaged, conflicts between humans and stray animals can also increase. Employees’ spontaneous undertaking of organizationally desired behaviors allows organizations’ gaining the edge in the fiercely competitive business environment. Apart from the contextual factor of leadership, individuals’ goal orientation is found to be highly related to his/her performance. In the era of big data, public investors are faced with more complicated information related to investment decisions than ever before. To survive in the fierce competition, it has become increasingly urgent for investors to combine multi-source knowledge and evaluate the companies’ true value efficiently. For this, a rule-based ontology reasoning method is proposed to support steel companies’ value assessment. Considering the delay in financial disclosure and based on cost-benefit analysis, this paper introduces the supply chain enterprises financial analysis and constructs the ontology model used to value the value of steel company. In addition, domain knowledge is formally expressed with the help of Web Ontology Language (OWL) language and SWRL (Semantic Web Rule Language) rules. Abstract:
High throughput cells counting and sizing are often required for biomedical applications. Here we report design, fabrication and validating of a micro-machined Coulter counter device with multiple-channel to realize such application for low cost. Multiple vertical through-holes were fabricated on a silicon chip, combined with the PDMS micro-fluidics channel that serves as the sensing channel. In order to avoid the crosstalk introduced by the electrical connection, instead of measuring the current passing through, the potential of each channel is monitored, thus the high throughput is possible. A peak of the output potential can be captured when the cell/particle is passing through the microhole. The device was validated by counting and sizing the polystyrene beads with diameter of 6 μm, 10 μm and 15 μm. With the sampling frequency to be set at 100 kHz, up to 5000 counts/sec for each channel can be realized. Sclareolide is made from sclareol by oxidiative synthesis and subsequent crystallization, while the crystallization mother liquor still contains 15%~30%wt of sclareolide to be reclaimed. With the reaction material of sclareol is provided as plant extract, many sorts of complex impurities exist in the mother liquor. Due to the difficulty in recycling sclareolide after solvent recovery, it is common practice for the factories to discard the mother liquor, which not only results in loss of sclareolide, but also contributes extra environmental burden. In this paper, a process based on adsorption and elution has been presented for recycling of sclareolide from mother liquor. After pretreatment of the crystallization mother liquor by HZ-845 resin to remove parts of impurities, sclareolide is adsorbed by HZ-816 resin. The HZ-816 resin loaded with sclareolide is then eluted by elution solvent. Finally, the eluent containing sclareolide is concentrated and fed into the crystallization step in the process. By adoption of the recycle from mother liquor, total yield of sclareolide increases from 86% to 90% with a stable purity of the final sclareolide products maintained.Keywords: sclareolide, resin, adsorption, chromatography

Abstract:
Macroalgae are larger in size compared with microalgae; hence, they imposed lower separation and drying costs. To explore the potential for enhancing cultivation conditions in macroalgae Chaetomorpha linum (C. linum)-based bioreactor for nutrient recovery from municipal wastewaters and examine the biochemical composition of the macroalgae for the potential downstream production of biofuels, screening experiments were performed. This study suggested that C. linum grew well on primary (PW), secondary (SW), and centrate wastewater (CW). A step feeding approach was shown to significantly enhance biomass productivity when grown on 10% CW; meanwhile, nitrogen and phosphorus removal efficiencies increased to 86.8 ± 1.1% and 92.6 ± 0.2%, respectively. The CO₂-supplemented SW cultures were 1.20 times more productive than the corresponding controls without CO₂ supplementation. These findings demonstrate that C. linum could represent a promising and efficient wastewater treatment alternative which could also provide a feedstock for downstream processing to biofuels.Keywords: biofuel production, macroalgae, nutrient removal, wastewater

Abstract:
This study investigates the impact of family involvement, a pivotal factor shaping the management structure of family firms, on the firm’s innovation outputs. The independent variable focuses on the percentage number of family members serving as directors, supervisors and senior management. Our hypothesis suggests that family involvement tends to make management more conservative, thereby increasing the likelihood of impeding innovation investments and resulting in adverse effects on innovation output. Our findings reveal that Chinese family firms with high family involvement exhibit poorer innovation outputs compared to those with lower family involvement. Subsample analyses indicate that this negative influence of family involvement on innovation output is strengthened as the firm faces higher industry competition and a low marketization context. The findings of our paper contribute to the literature on family involvement by empirically illustrating how family involvement hinders innovation efforts and performance in Chinese family firms.Keywords: family firm, family involvement, firm innovation, Chinese family firm

We study the temperature dependence of the interaction energies (IEs) of X (=Ru, Rh) impurities in Pd, due to the Fermi-Dirac (FD) distribution and the thermal vibration effect by the Debye-Grüneisen model. The n-body (n=2~4) IEs among X impurities in Pd, being used to calculate the internal energies in the free energies of the Pd-rich PdX alloys, are determined uniquely and successively from the lower-order to higher-order, by the full-potential Korringa-Kohn-Rostoker Green’s function method (FPKKR), combined with the generalized gradient approximation in the density functional theory. Through the construction of corpus text vector space and knowledge mining, the feature selection, similarity measure and case retrieval method of text in the field of biology are studied. First, we establish a vector space model of the corpus in the biological field and complete the preprocessing steps. Then, the corpus is retrieved by using the vector space model combined with the functional keywords to obtain the biological domain examples related to the design problems. Abstract:
The effects of wastewater, with four different nutrient loadings, from synthetic centrate on biomass production of Chlorella vulgaris, nutrient removal, microalgal settling, and lipid production were investigated in photobioreactors under both batches and, subsequently, semi-continuous operations. At higher centrate concentration factors (17.2% and 36.2%), hydraulic retention time and pH adjustments could be employed to sustain acceptable microalgal growth rates and wastewater treatment. Similar nutrient removals efficiencies (>95%) and biomass production (0.42-0.51 g/L) were observed for the four centrate concentrations. Both the lipid productivity and lipid content decreased with increasing nutrient loading in the wastewater. The results also demonstrated that the mass ratio of carbohydrate to protein could provide a good indication of microalgal settling performance, rather than sole component composition or total extracellular polymeric substances.Keywords: lipid production, microalgae, nutrient removal, wastewater

In this study, we demonstrate a high-resolution refractive index sensor based on a magnetic photonic crystal (MPC) composed of a triangular lattice array of air holes embedded in Si matrix. A microcavity is created by changing the radius of an air hole in the middle of the photonic crystal. The cavity filled with gyrotropic materials can serve as a refractive index sensor. The shift of the resonant frequency of the sensor is obtained numerically using finite difference time domain method under different ambient conditions having refractive index from n = 1.0 to n = 1.1. The numerical results show that a tiny change in refractive index of Δn = 0.0001 is distinguishable. In addition, the spectral response of the MPC sensor is studied while an external magnetic field is present. With the high power density and high integration of electronic devices, their heat flux has been increasing rapidly. Therefore, an effective cooling technology is essential for the reliability and efficient operation of electronic devices. Liquid cooling is studied increasingly widely for its higher heat transfer efficiency. Serpentine channels are superior in the augmentation of single-phase convective heat transfer because of their better channel velocity distribution. In this paper, eight different frame sizes water-cooled serpentine channel heat sinks are designed to study the heat transfer and pressure drop characteristics. There are legal reasons for this, namely the lack of protection for domestic pets in mainland China, where only wildlife protection laws exist. At a social level, the ease with which families adopt pets and the lack of a social view of animal nature have led to the frequent abandonment and loss of stray animals. If left unmanaged, conflicts between humans and stray animals can also increase. This project provides an inexpensive and widely applicable management tool for urban management by collecting videos and pictures of stray animals captured by surveillance or transmitted by humans and using artificial intelligence technology (mainly using Yolov5 recognition technology) and recording and managing them in a database.Keywords: urban planning, urban governance, artificial intelligence, convolutional neural network, machine vision

Abstract:
The coronavirus disease 2019 (COVID‐19) pandemic has changed people's lives from all over the world. More people have turned to Twitter to engage online and discuss the COVID-19 vaccine. This study aims to present a text mining approach to identify people's attitudes towards the COVID-19 vaccine on Twitter. To achieve this purpose, we collected 54,268 COVID-19 vaccine tweets from September 01, 2020, to November 01, 2020, then the BERT model is used for the sentiment and topic analysis. The results show that people had more negative than positive attitudes about the vaccine, and countries with an increasing number of confirmed cases had a higher percentage of negative attitudes. Additionally, the topics discussed in positive and negative tweets are different. The tweet datasets can be helpful to information professionals to inform the public about vaccine-related informational resources. Our findings may have implications for understanding people's cognitions and feelings about the vaccine.Keywords: BERT, COVID-19 vaccine, sentiment analysis, topic modeling

Abstract:
The purpose of the study is to analyze the load rejection transient of ABWR by using TRACE, PARCS, and SNAP codes. This study has some steps. First, using TRACE, PARCS, and SNAP codes establish the model of ABWR. Second, the key parameters are identified to refine the TRACE/PARCS/SNAP model further in the frame of a steady state analysis. Third, the TRACE/PARCS/SNAP model is used to perform the load rejection transient analysis. Finally, the FSAR data are used to compare with the analysis results. The results of TRACE/PARCS are consistent with the FSAR data for the important parameters. It indicates that the TRACE/PARCS/SNAP model of ABWR has a good accuracy in the load rejection transient.Keywords: ABWR, TRACE, PARCS, SNAP

Abstract:
Individuals with Autism Spectrum Disorder (ASD) often struggle with social interactions and communication. It is challenging for them to understand social cues such as facial expressions, body language, and tone of voice in social settings, leading to social conflicts and misunderstandings. Over time, feelings of frustration and anxiety can make them reluctant to engage in social situations and worsen their communication barriers. This study focused on children with autism who also experience social anxiety. Through focus group interviews with parents of children with autism and occupational therapists, it explores the reasons and scenarios behind the development of social anxiety in these children. Social scenario stories and interactive applications tailored for children with autism were designed and developed. In addition, working with the educational robots, coping strategies for various emotional situations were elaborated on, and children were helped to understand their emotions.Keywords: autism spectrum disorder, social anxiety, robot, social scenario story, interactive applications

Abstract:
Using a dataset consisting of 7,120 firm-year observations from the Taiwan stock market over the 2007-2011 sample period, we find a significantly negative relationship between board external connectedness and firm diversification. We propose a learningeffect hypothesis indicating that an externally connected board member’s experiences in other companies directly affect his recommendations regarding the underlying firm’s diversification. The partial correlation between diversification and the performance of firms with externally connected board members is used as a proxy for the learning effect. The empirical results show that the learning effect is asymmetrically embedded in firm diversification, with negative experiences having a greater effect on firm diversification than positive experiences. Externally connected board members are associated with reduced diversification in one firm after they learn that diversification is detrimental to value in other companies. Moreover, the diversification of a firm due to board external connectedness is moderated by the controlling owner’s interest alignment and entrenchment.Keywords: board, external, connectedness, diversification

Abstract:
In this paper, a sliding mode control method based on the passivity approach is proposed to control the position of surface-mounted permanent magnet synchronous motors (PMSMs). Firstly, the dynamics of a PMSM was proved to be strictly passive. The position controller with an adaptive law was used to estimate the load torque to eliminate the chattering effects associated with the conventional sliding mode controller. The stability analysis of the overall position control system was carried out by adopting the passivity theorem instead of Lyapunov-type arguments. Finally, experimental results were provided to show that the good position tracking can be obtained, and exhibit robustness in the variations of the motor parameters and load torque disturbances.Keywords: adaptive law, passivity theorem, permanent magnet synchronous motor, sliding mode control
