223 Author’s Moral Rights in the Copyright Laws of the Baltic States: Comparative Legal Analysis

Abstract:

This paper examines the general protection and implementation of authors' moral rights in the copyright laws of Latvia, Lithuania, and Estonia, focusing on their legal frameworks in light of the Berne Convention. The analysis highlights how moral rights, such as authorship attribution, integrity of the work, and opposition to derogatory treatment, are upheld in these jurisdictions. The study compares national approaches to posthumous protection of moral rights and their interplay with economic rights. Drawing on legal texts and court decisions, the paper identifies challenges in enforcement and suggests harmonization opportunities to strengthen the moral rights framework across the Baltic region.

222 The Implementation of Anti-Circumvention Legislations in Thai Copyright System

Abstract:

The WIPO copyright treaty (WCT) was established by the World Intellectual Property Organisation (WIPO). This agreement required the contracting nations to provide adequate protection to technological measures to prevent massive copyright infringement in the internet system. Thailand had to implement the anti-circumvention rules into domestic legislation to comply with this international obligation. The purpose of this paper is to critically discuss the legislative standard under the WCT. It also aims to examine the legal development of technological protection measures in Thailand and demonstrate that the scope of prohibitions under the copyright Act 2022 (NO.5) is similar to the Digital Millennium Copyright Act 1998 (DMCA) of the United States (US). It could be found that the anti-circumvention laws of Thailand prohibit the circumvention of access-control technologies, and the regulation on trafficking circumvention devices has been added to the latest version of the Thai Copyright Act. These legislative evolutions have revealed the attempt to reinforce the legal protection of technological measures and copyright holders in order to be in line with global practices. However, the amendment has problems concerning the legal definitions of effective technological measure and the prohibited act of circumvention. The vagueness might affect the scope of protection and the boundary of prohibition. With this aspect, the DMCA will be evaluated and compared to gain guidelines for interpretation and enforcement in Thailand. The lessons and experiences learned from this study might be useful to correct the flaws or at least clarify the ambiguities embodied in Thai copyright legislation.

221 Models of Copyrights System

Abstract:

The copyrights system is a combination of different elements. The number, content and the correlation of these elements are different for different legal orders. The models of copyrights systems display this system in terms of the interaction of economic and author's moral rights. Monistic and dualistic models are the most popular ones. The article deals with different points of view on the monism and dualism in copyright system. A specific model of the copyright in Switzerland in the XXth century is analyzed. The evolution of a French dualistic model of copyright is shown. The author believes that one should talk not about one, but rather about a number of dualism forms of copyright system.

220 Criminal liability for Copyright and Related Rights Infringement: Albania Legislation Perspective

Abstract:

Copyright and related rights have been pivotal in driving the economic growth of nations worldwide and fostering culture and new forms of entertainment. The introduction of the internet and technological advancement has significantly expanded the opportunities for creators and rights holders to promote their works and boost their revenues. However, this digital era has also brought about complex challenges, leading to a more extensive range of copyright infringement, primarily due to the substantial surge in piracy and counterfeiting. Despite being reported internationally, the mechanisms to tackle and the responsibility for enforcing copyright infringements often remain rooted in national jurisdictions, resulting in a gap between the scale of the problem and the efficacy of enforcement measures. Thus, it is essential to ensure adequate legal protection, a vital safeguard for authors' economic and moral interests, information security, innovative development promotion, and intellectual creativity preservation. This paper describes Albanian criminal law-based copyright enforcement legislation, focusing on doctrinal guidance and practical judicial considerations. Lastly, the paper offers recommendations for enhancing copyright protection and related rights.

219 Improved Zero Text Watermarking Algorithm against Meaning Preserving Attacks

Abstract:

Internet is largely composed of textual contents and a huge volume of digital contents gets floated over the Internet daily. The ease of information sharing and re-production has made it difficult to preserve author-s copyright. Digital watermarking came up as a solution for copyright protection of plain text problem after 1993. In this paper, we propose a zero text watermarking algorithm based on occurrence frequency of non-vowel ASCII characters and words for copyright protection of plain text. The embedding algorithm makes use of frequency non-vowel ASCII characters and words to generate a specialized author key. The extraction algorithm uses this key to extract watermark, hence identify the original copyright owner. Experimental results illustrate the effectiveness of the proposed algorithm on text encountering meaning preserving attacks performed by five independent attackers.

218 A Method of Protecting Relational Databases Copyright with Cloud Watermark

Abstract:

With the development of Internet and databases application techniques, the demand that lots of databases in the Internet are permitted to remote query and access for authorized users becomes common, and the problem that how to protect the copyright of relational databases arises. This paper simply introduces the knowledge of cloud model firstly, includes cloud generators and similar cloud. And then combined with the property of the cloud, a method of protecting relational databases copyright with cloud watermark is proposed according to the idea of digital watermark and the property of relational databases. Meanwhile, the corresponding watermark algorithms such as cloud watermark embedding algorithm and detection algorithm are proposed. Then, some experiments are run and the results are analyzed to validate the correctness and feasibility of the watermark scheme. In the end, the foreground of watermarking relational database and its research direction are prospected.

217 Research on Laws and Regulations of Sustainable Construction in China

Abstract:

This paper introduced the status quo of laws and regulations of sustainable construction in China and investigated the existing problems of current laws and regulations through person-interviews in Beijing, Shanghai, Chongqing and Shenzhen in China. The problems include incomplete legal system, lack of guidance of higher-level laws, backward in some laws and regulations, unclear legal liability and poor law enforcement. Aimed at these problems, this paper also put forward some improvement approaches, such as filling the legal gap, revising laws and regulations, establishing incentive system and keeping pace with level of development.

216 A Copyright Protection Scheme for Color Images using Secret Sharing and Wavelet Transform

Abstract:

This paper proposes a copyright protection scheme for color images using secret sharing and wavelet transform. The scheme contains two phases: the share image generation phase and the watermark retrieval phase. In the generation phase, the proposed scheme first converts the image into the YCbCr color space and creates a special sampling plane from the color space. Next, the scheme extracts the features from the sampling plane using the discrete wavelet transform. Then, the scheme employs the features and the watermark to generate a principal share image. In the retrieval phase, an expanded watermark is first reconstructed using the features of the suspect image and the principal share image. Next, the scheme reduces the additional noise to obtain the recovered watermark, which is then verified against the original watermark to examine the copyright. The experimental results show that the proposed scheme can resist several attacks such as JPEG compression, blurring, sharpening, noise addition, and cropping. The accuracy rates are all higher than 97%.

215 Web Page Watermarking: XML files using Synonyms and Acronyms

Abstract:

Advent enhancements in the field of computing have increased massive use of web based electronic documents. Current Copyright protection laws are inadequate to prove the ownership for electronic documents and do not provide strong features against copying and manipulating information from the web. This has opened many channels for securing information and significant evolutions have been made in the area of information security. Digital Watermarking has developed into a very dynamic area of research and has addressed challenging issues for digital content. Watermarking can be visible (logos or signatures) and invisible (encoding and decoding). Many visible watermarking techniques have been studied for text documents but there are very few for web based text. XML files are used to trade information on the internet and contain important information. In this paper, two invisible watermarking techniques using Synonyms and Acronyms are proposed for XML files to prove the intellectual ownership and to achieve the security. Analysis is made for different attacks and amount of capacity to be embedded in the XML file is also noticed. A comparative analysis for capacity is also made for both methods. The system has been implemented using C# language and all tests are made practically to get the results.

214 Digital Image Watermarking in the Wavelet Transform Domain

Abstract:

In this paper, we start by first characterizing the most important and distinguishing features of wavelet-based watermarking schemes. We studied the overwhelming amount of algorithms proposed in the literature. Application scenario, copyright protection is considered and building on the experience that was gained, implemented two distinguishing watermarking schemes. Detailed comparison and obtained results are presented and discussed. We concluded that Joo-s [1] technique is more robust for standard noise attacks than Dote-s [2] technique.

213 Symmetries, Conservation Laws and Reduction of Wave and Gordon-type Equations on Riemannian Manifolds

Abstract:

Equations on curved manifolds display interesting properties in a number of ways. In particular, the symmetries and, therefore, the conservation laws reduce depending on how curved the manifold is. Of particular interest are the wave and Gordon-type equations; we study the symmetry properties and conservation laws of these equations on the Milne and Bianchi type III metrics. Properties of reduction procedures via symmetries, variational structures and conservation laws are more involved than on the well known flat (Minkowski) manifold.

212 Obstacle and Collision Avoidance Control Laws of a Swarm of Boids

Abstract:

This paper proposes a new obstacle and collision avoidance control laws for a three-dimensional swarm of boids. The swarm exhibit collective emergent behaviors whilst avoiding the obstacles in the workspace. While flocking, animals group up in order to do various tasks and even a greater chance of evading predators. A generalized algorithms for attraction to the centroid, inter-individual swarm avoidance and obstacle avoidance is designed in this paper. We present a set of new continuous time-invariant velocity control laws is presented which is formulated via the Lyapunov-based control scheme. The control laws proposed in this paper also ensures practical stability of the system. The effectiveness of the proposed control laws is demonstrated via computer simulations

211 A Web Oriented Watermarking Protocol

Abstract:

This paper presents a watermarking protocol able to solve the well-known “customer-s right problem" and “unbinding problem". In particular, the protocol has been purposely designed to be adopted in a web context, where users wanting to buy digital contents are usually neither provided with digital certificates issued by certification authorities (CAs) nor able to autonomously perform specific security actions. Furthermore, the protocol enables users to keep their identities unexposed during web transactions as well as allows guilty buyers, i.e. who are responsible distributors of illegal replicas, to be unambiguously identified. Finally, the protocol has been designed so that web content providers (CPs) can exploit copyright protection services supplied by web service providers (SPs) in a security context. Thus, CPs can take advantage of complex services without having to directly implement them.

210 A Visual Cryptography and Statistics Based Method for Ownership Identification of Digital Images

Abstract:

In this paper, a novel copyright protection scheme for digital images based on Visual Cryptography and Statistics is proposed. In our scheme, the theories and properties of sampling distribution of means and visual cryptography are employed to achieve the requirements of robustness and security. Our method does not need to alter the original image and can identify the ownership without resorting to the original image. Besides, our method allows multiple watermarks to be registered for a single host image without causing any damage to other hidden watermarks. Moreover, it is also possible for our scheme to cast a larger watermark into a smaller host image. Finally, experimental results will show the robustness of our scheme against several common attacks.

208 A Nonoblivious Image Watermarking System Based on Singular Value Decomposition and Texture Segmentation

Abstract:

In this paper, a robust digital image watermarking scheme for copyright protection applications using the singular value decomposition (SVD) is proposed. In this scheme, an entropy masking model has been applied on the host image for the texture segmentation. Moreover, the local luminance and textures of the host image are considered for watermark embedding procedure to increase the robustness of the watermarking scheme. In contrast to all existing SVD-based watermarking systems that have been designed to embed visual watermarks, our system uses a pseudo-random sequence as a watermark. We have tested the performance of our method using a wide variety of image processing attacks on different test images. A comparison is made between the results of our proposed algorithm with those of a wavelet-based method to demonstrate the superior performance of our algorithm.

207 Understanding the Silence: When Courts Don-t Speak About Religion

Abstract:

India recognizes the personal laws of the various religious communities that reside in the country. At the same time all the institutions of the state in India are committed to the value of secularism. This paper has been developed on the basis of a case study that indicates the dynamics of religion in the working of the lower judiciary in India. Majority of the commentary on religion and the judiciary has focused on debates surrounding the existence and application of personal laws. This paper, through a case study in the lower judiciary, makes an attempt to examine whether the interface between religion and the judiciary goes beyond personal laws. The first part of this paper explains the history and application of personal laws in social, political and legal contexts in India. The second part examines the case study located in two courts of first instance, following into the third part which provides an analysis of the empirical evidence. The fourth part focuses on preliminary observations about why there is a hesitancy to speak about religion in relation to the working of the judicial system.

206 An Algorithm for Secure Visible Logo Embedding and Removing in Compression Domain

Abstract:

Digital watermarking is the process of embedding information into a digital signal which can be used in DRM (digital rights managements) system. The visible watermark (often called logo) can indicate the owner of the copyright which can often be seen in the TV program and protects the copyright in an active way. However, most of the schemes do not consider the visible watermark removing process. To solve this problem, a visible watermarking scheme with embedding and removing process is proposed under the control of a secure template. The template generates different version of watermarks which can be seen visually the same for different users. Users with the right key can completely remove the watermark and recover the original image while the unauthorized user is prevented to remove the watermark. Experiment results show that our watermarking algorithm obtains a good visual quality and is hard to be removed by the illegally users. Additionally, the authorized users can completely remove the visible watermark and recover the original image with a good quality.

205 Image Adaptive Watermarking with Visual Model in Orthogonal Polynomials based Transformation Domain

Abstract:

In this paper, an image adaptive, invisible digital watermarking algorithm with Orthogonal Polynomials based Transformation (OPT) is proposed, for copyright protection of digital images. The proposed algorithm utilizes a visual model to determine the watermarking strength necessary to invisibly embed the watermark in the mid frequency AC coefficients of the cover image, chosen with a secret key. The visual model is designed to generate a Just Noticeable Distortion mask (JND) by analyzing the low level image characteristics such as textures, edges and luminance of the cover image in the orthogonal polynomials based transformation domain. Since the secret key is required for both embedding and extraction of watermark, it is not possible for an unauthorized user to extract the embedded watermark. The proposed scheme is robust to common image processing distortions like filtering, JPEG compression and additive noise. Experimental results show that the quality of OPT domain watermarked images is better than its DCT counterpart.

204 A Multipurpose Audio Watermarking Algorithm Based on Vector Quantization in DCT Domain

Abstract:

In this paper, a novel multipurpose audio watermarking algorithm is proposed based on Vector Quantization (VQ) in Discrete Cosine Transform (DCT) domain using the codeword labeling and index-bit constrained method. By using this algorithm, it can fulfill the requirements of both the copyright protection and content integrity authentication at the same time for the multimedia artworks. The robust watermark is embedded in the middle frequency coefficients of the DCT transform during the labeled codeword vector quantization procedure. The fragile watermark is embedded into the indices of the high frequency coefficients of the DCT transform by using the constrained index vector quantization method for the purpose of integrity authentication of the original audio signals. Both the robust and the fragile watermarks can be extracted without the original audio signals, and the simulation results show that our algorithm is effective with regard to the transparency, robustness and the authentication requirements

203 Combating Money Laundering in the Banking Industry: Malaysian Experience

Abstract:

Money laundering has been described by many as the lifeblood of crime and is a major threat to the economic and social well-being of societies. It has been recognized that the banking system has long been the central element of money laundering. This is in part due to the complexity and confidentiality of the banking system itself. It is generally accepted that effective anti-money laundering (AML) measures adopted by banks will make it tougher for criminals to get their "dirty money" into the financial system. In fact, for law enforcement agencies, banks are considered to be an important source of valuable information for the detection of money laundering. However, from the banks- perspective, the main reason for their existence is to make as much profits as possible. Hence their cultural and commercial interests are totally distinct from that of the law enforcement authorities. Undoubtedly, AML laws create a major dilemma for banks as they produce a significant shift in the way banks interact with their customers. Furthermore, the implementation of the laws not only creates significant compliance problems for banks, but also has the potential to adversely affect the operations of banks. As such, it is legitimate to ask whether these laws are effective in preventing money launderers from using banks, or whether they simply put an unreasonable burden on banks and their customers. This paper attempts to address these issues and analyze them against the background of the Malaysian AML laws. It must be said that effective coordination between AML regulator and the banking industry is vital to minimize problems faced by the banks and thereby to ensure effective implementation of the laws in combating money laundering.

202 The Classical Islamic Laws of Apostasy in the Present Context

Abstract:

The main purpose of this essay is to examine whether or not the earthly punishments in regards to apostates that are often found in classical Islamic sources are applicable in the present context. The paper indeed addresses how Muslims should understand the question of apostasy in the contemporary context. To do so, the paper first argues that an accurate understanding of the way the Quranic verses and prophetic hadiths deal with the concept of apostasy could help us rethink and re-examine the classical Islamic laws on apostasy in the present context. In addition, building on Abdolkarim Soroush’s theory of contraction and expansion of religious knowledge, this article argues that approaches to apostasy in the present context can move away from what prescribed by classical Islamic laws. Finally, it argues that instances of persecution of apostates in the early days of Islam during the Medinan period of Muhammad’s prophetic mission should be interpreted in their own socio-historical context. Rereading these reports within our modern context supports the mutability of the traditional corporal punishments of apostasy.

201 A Web Oriented Spread Spectrum Watermarking Procedure for MPEG-2 Videos

Abstract:

In the last decade digital watermarking procedures have become increasingly applied to implement the copyright protection of multimedia digital contents distributed on the Internet. To this end, it is worth noting that a lot of watermarking procedures for images and videos proposed in literature are based on spread spectrum techniques. However, some scepticism about the robustness and security of such watermarking procedures has arisen because of some documented attacks which claim to render the inserted watermarks undetectable. On the other hand, web content providers wish to exploit watermarking procedures characterized by flexible and efficient implementations and which can be easily integrated in their existing web services frameworks or platforms. This paper presents how a simple spread spectrum watermarking procedure for MPEG-2 videos can be modified to be exploited in web contexts. To this end, the proposed procedure has been made secure and robust against some well-known and dangerous attacks. Furthermore, its basic scheme has been optimized by making the insertion procedure adaptive with respect to the terminals used to open the videos and the network transactions carried out to deliver them to buyers. Finally, two different implementations of the procedure have been developed: the former is a high performance parallel implementation, whereas the latter is a portable Java and XML based implementation. Thus, the paper demonstrates that a simple spread spectrum watermarking procedure, with limited and appropriate modifications to the embedding scheme, can still represent a valid alternative to many other well-known and more recent watermarking procedures proposed in literature.

200 Motion Planning and Control of a Swarm of Boids in a 3-Dimensional Space

Abstract:

In this paper, we propose a solution to the motion planning and control problem for a swarm of three-dimensional boids. The swarm exhibit collective emergent behaviors within the vicinity of the workspace. The capability of biological systems to autonomously maneuver, track and pursue evasive targets in a cluttered environment is vastly superior to any engineered system. It is considered an emergent behavior arising from simple rules that are followed by individuals and may not involve any central coordination. A generalized, yet scalable algorithm for attraction to the centroid and inter-individual swarm avoidance is proposed. We present a set of new continuous time-invariant velocity control laws, formulated via the Lyapunov-based control scheme for target attraction and collision avoidance. The controllers provide a collision-free trajectory. The control laws proposed in this paper also ensures practical stability of the system. The effectiveness of the control laws is demonstrated via computer simulations.

199 On Asymptotic Laws and Transfer Processes Enhancement in Complex Turbulent Flows

Abstract:

The lecture represents significant advances in understanding of the transfer processes mechanism in turbulent separated flows. Based upon experimental data suggesting the governing role of generated local pressure gradient that takes place in the immediate vicinity of the wall in separated flow as a result of intense instantaneous accelerations induced by large-scale vortex flow structures similarity laws for mean velocity and temperature and spectral characteristics and heat and mass transfer law for turbulent separated flows have been developed. These laws are confirmed by available experimental data. The results obtained were employed for analysis of heat and mass transfer in some very complex processes occurring in technological applications such as impinging jets, heat transfer of cylinders in cross flow and in tube banks, packed beds where processes manifest distinct properties which allow them to be classified under turbulent separated flows. Many facts have got an explanation for the first time.

198 Application of Novel Conserving Immersed Boundary Method to Moving Boundary Problem

Abstract:

A new conserving approach in the context of Immersed Boundary Method (IBM) is presented to simulate one dimensional, incompressible flow in a moving boundary problem. The method employs control volume scheme to simulate the flow field. The concept of ghost node is used at the boundaries to conserve the mass and momentum equations. The Present method implements the conservation laws in all cells including boundary control volumes. Application of the method is studied in a test case with moving boundary. Comparison between the results of this new method and a sharp interface (Image Point Method) IBM algorithm shows a well distinguished improvement in both pressure and velocity fields of the present method. Fluctuations in pressure field are fully resolved in this proposed method. This approach expands the IBM capability to simulate flow field for variety of problems by implementing conservation laws in a fully Cartesian grid compared to other conserving methods.

197 Hybrid Color-Texture Space for Image Classification

Abstract:

This work presents an approach for the construction of a hybrid color-texture space by using mutual information. Feature extraction is done by the Laws filter with SVM (Support Vectors Machine) as a classifier. The classification is applied on the VisTex database and a SPOT HRV (XS) image representing two forest areas in the region of Rabat in Morocco. The result of classification obtained in the hybrid space is compared with the one obtained in the RGB color space.

196 Combining Laws of Mechanics and Hydrostatics in Non-Inertial Reference Frames

Abstract:

Method of combined teaching laws of classical mechanics and hydrostatics in non-inertial reference frames for undergraduate students is proposed. Pressure distribution in a liquid (or gas) moving with acceleration is considered. Combined effect of hydrostatic force and force of inertia on a body immersed in a liquid can lead to paradoxical results, in a motion of pendulum in particular. The body motion under Stokes force influence and forces in rotating reference frames are investigated as well. Problems and difficulties in student perceptions are analyzed.

195 Swarm Navigation in a Complex Environment

Abstract:

This paper proposes a solution to the motion planning and control problem of car-like mobile robots which is required to move safely to a designated target in a priori known workspace cluttered with swarm of boids exhibiting collective emergent behaviors. A generalized algorithm for target convergence and swarm avoidance is proposed that will work for any number of swarms. The control laws proposed in this paper also ensures practical stability of the system. The effectiveness of the proposed control laws are demonstrated via computer simulations of an emergent behavior.

194 Traffic Flow on Road Junctions

Abstract:

The paper deals with a mathematical model for fluid dynamic flows on road networks which is based on conservation laws. This nonlinear framework is based on the conservation of cars. We focus on traffic circle, which is a finite number of roads that meet at some junctions. The traffic circle with junctions having either one incoming and two outgoing or two incoming and one outgoing roads. We describe the numerical schemes with the particular boundary conditions used to produce approximated solutions of the problem.
