957 A Comparative Study on Software Patent: The Meaning of 'Use' in Direct Infringement

Abstract:
The computer program inventors, particularly in Fintech, are unwilling to apply for patents in Taiwan after 2014. Passing the ‘statutory subject matter eligibility’ test and becoming the system patent are not the only cause to the reduction in the number of application. Taiwanese court needs to resolve whether the defendants had ‘used’ that software patent in patent direct infringement suit. Both 35 U.S.C. § 271(a) and article 58 paragraph 2 of Taiwan Patent Law don’t define the meaning of ‘use’ in the statutes. Centillion Data Sys., LLC v. Qwest Commc’ns Int’l, Inc. reconsidered the meaning of ‘use’ in system patent infringement, and held that ‘a party must put the invention into service, i.e., control the system as a whole and obtain benefit from it.’ In Taiwan, Intellectual Property Office, Ministry of Economic Affairs, has explained that ‘using’ the patent is ‘achieving the technical effect of the patent.’ Nonetheless, this definition is too broad to apply to not only the software patent but also the traditional patent. To supply the friendly environment for Fintech corporations, this article aims to let Taiwanese court realize why and how United States District Court, S.D. Indiana, Indianapolis Division and United States Court of Appeals, Federal Circuit defined the meaning of ‘use’ in 35 U.S.C. § 271(a). However, this definition is so lax and confuses many defendants in United States. Accordingly, this article indicates the elements in Taiwan Patent Law are different with 35 U.S.C. § 271(a), so Taiwanese court can follow the interpretation of ‘use’ in Centillion Data case without the same obstacle.Keywords: direct infringement, FinTech, software patent, use

Abstract:
In comparison to systems that are typically designed to provide capabilities over a narrow frequency range through hardware elements, the next generation cognitive radios are intended to implement a broader range of capabilities through efficient spectrum exploitation. This offers the user the promise of greater flexibility, seamless roaming possible on different networks, countries, frequencies, etc. It requires true paradigm shift i.e., liberalization over a wide band of spectrum as well as a growth path to more and greater capability. This work contributes towards the design and implementation of an open spectrum access (OSA) feature to unlicensed users thus offering a frequency agile radio platform that is capable of performing spectrum sensing over a wideband. Thus, an ultra-wideband (UWB) radio, which has the intelligence of spectrum sensing only, unlike the cognitive radio with complete intelligence, is named as a Smart Software Radio (SSR). The spectrum sensing mechanism is implemented based on energy detection. There is a strong link between technology and development. Architecture as a profession is a call to service and society. Maybe next to soldiers, engineers and patriots. However, unlike soldiers, they always remain employees of society under all circumstances. Despite the construction profession's role in society, there appears to be a lack of respect as some projects fail. This paper focuses on the need to improve development engineering performance in developing countries, using engineering education in Nigerian universities as a tool for discussion. A purposeful survey, interviews and focus group discussions were conducted on one hundred and twenty (120) prominent companies in Nigeria. The subject is approached through a large number of projects that companies have been involved in from the planning stage, some of which have been completed and even reached the maintenance and monitoring stage. It has been found that certain factors beyond the control of engineers are hindering the full development and success of the construction sector in developing countries. Abstract:
Given the limitation of fossil resources to supply energy to buildings, recent years have seen a revival of interest in new technologies that produce the energy using new forms of energy in many developed countries. In this research, first the potentials of new energies in Iran are discussed and then based on case studies undertaken in a building in Tehran, the effects of utilizing new solar energy technology for supplying the energy of buildings are investigated. Then, by analyzing the data recorded over a four-year period, the technical performance of this system is investigated. According to the experimental operation plan, this system requires an auxiliary heating circuit for continuous operation over a year. Also, in the economic analysis, real conditions are considered and the results are recorded based on long-term data. Considering the purchase and commissioning building, supplementary energy consumption, etc. a comparison is drawn between the costs of using a solar water heater in a residential unit with the energy costs of a similar unit equipped with a conventional gas water heater. Given the current price of energy, using a solar water heater in the country will not economical, but considering the global energy prices, this system will have a return on investment after 4.5 years. It also produces 81% less pollution and saves about $21.5 on environmental pollution cleanup.Keywords: energy supply, new energies, new technologies, buildings

Abstract:
This paper proposes and empirically tests a model of the relationships between green supply chain management (GSCM) activities and corporate performance. From the literature review, we identified five constructs, namely, environmental commitment, supplier collaboration, supplier assessment, information sharing among suppliers, and business process improvement. These explanatory variables are used to form a structural model explaining the environmental and economic performance. The model was analyzed using the data from a survey of a sample of manufacturing firms in Japan. The results suggest that the degree of supplier collaboration has an influence on the environmental performance directly. While, the impact of supplier assessment on the environmental performance is mediated by the information sharing and/or business process improvement. And the environmental performance has a positive relationship on the economic performance. Abstract:
Cement utilization to improve the properties of soil is a well-known method applied in field. However, its addition in large quantity must be controlled. This study presents utilization of natural and environmental-friendly material mixed with small amount of cement content in soil improvement, i.e. bamboo chips. Absorbability, elongation, and flatness ratio of bamboo chips were examined to investigate and understand the influence of its characteristics in the mixture. Improvement of dilation behavior as a problem of loose and poorly graded sand soil is discussed. Bamboo chips are able to improve the permeability value that affects the dilation behavior of cemented sand soil. It is proved by the stress path as the result of triaxial compression test in the undrained condition. Resistive random access memories (RRAMs) are one of the main candidates for future computer memories. However, due to their tiny size and immature device technology, the quality of the outgoing RRAM chips is seen as a serious issue. Defective RRAM cells might behave differently than existing semiconductor memories (Dynamic RAM, Static RAM, and Flash), meaning that they are difficult to be detected using existing test schemes. This paper presents an enhanced test scheme, referred to as Programmable Short Write Time (PSWT) that is able to improve the detection of faulty RRAM cells. It is developed by applying multiple weak write operations, each with different time durations. The test circuit embedded in the RRAM chip is made programmable in order to supply different weak write times during testing. The RRAM electrical model is described using Verilog-AMS language and is simulated using HSPICE simulation tools. Abstract:
The key role in phenomenological modelling of cyclic plasticity is good understanding of stress-strain behaviour of given material. There are many models describing behaviour of materials using numerous parameters and constants. Combination of individual parameters in those material models significantly determines whether observed and predicted results are in compliance. Parameter identification techniques such as random gradient, genetic algorithm, and sensitivity analysis are used for identification of parameters using numerical modelling and simulation. In this paper genetic algorithm and sensitivity analysis are used to study effect of 4 parameters of modified AbdelKarim-Ohno cyclic plasticity model. Abstract:
The present study aims at presenting Samuel Beckett's attempts to pierce the world of knowledge and understanding with a hope to approach it though he knew it is unattainable. To know about Beckett more and to get the idea about the notion of the absurd, we found it necessary to find the real meaning of existence both in the notion of the absurd and in Existentialism. Among many philosophers, as is evident in this paper, who worked on the concept of existence, Beckett reveals a very peculiar path by which some labelled him a mere absurdist. In this study, we tried to show that unlike this label and also unlike many philosophers' premise, Beckett did not assign his contemplation on the boundaries of existence but to find a way to retreat from it. This is the only way for him to find the real meaning of Self. While Existentialism advocates primary existence, Beckett's Absurdity appreciates a reliable being in a realm out of limits of the world. The Absurd person has no tendency to put himself in the barriers of time and language. Time imprisons one in the frame of days and nights, the solid dimensions in which the Self cannot be evidenced. Abstract:
Electromagnetic forming process (EMF) is one of high-velocity forming processes using Lorentz force. Advantages of EMF are summarized as improvement of formability, reduction in wrinkling, non-contact forming. In this study, numerical simulations were conducted to determine the practical parameters for EMF process. A 2-D axis-symmetric electromagnetic model was considered based on the spiral type forming coil. In the numerical simulation, RLC circuit coupled with spiral coil was made to consider the design parameters such as system input current and electromagnetic force. In order to deform the sheet in the patter shape die, two types of spiral shape coil were considered to deform the pattern shape sheet. One is a spiral coil that has 6turns with dead zone at centre point. Another is a normal spiral coil without dead zone that has 8 turns. In the electric analysis, input current and magnetic force were compared and then plastic deformation was treated in the mechanical analysis for two coil cases. Deformation behaviour of dead zone coil case has good agreement with pattern shape die. A mobile ad hoc network (MANET) represents a system of wireless mobile nodes that can self-organize freely and dynamically into arbitrary and temporary network topology. Unlike a wired network, wireless network interface has limited transmission range. Routing is the task of forwarding data packets from source to a given destination. Ad-hoc On Demand Distance Vector (AODV) routing protocol creates a path for a destination only when it required. This paper describes the implementation of AODV routing protocol using MATLAB-based Truetime simulator. In MANET's node movements are not fixed while they are random in nature. Hence intelligent techniques i.e. fuzzy and ANFIS are used to optimize the transmission range. In this paper, we compared the transmission range of AODV, fuzzy AODV and ANFIS AODV. For soft computing AODV, we have taken transmitted power and received threshold as input and transmission range as output. To establish the influential mechanism of learning engagement on interpreter’s performance, the present study submitted a questionnaire to a sample of 927 English major students with 804 valid ones and used the structural equation model as the basis for empirical analysis and statistical inference on the sample data. In order to explore the mechanism for interpreting learning engagement on student interpreters’ performance, a path model of interpreting processes with three variables of ‘input-environment-output’ was constructed. The results showed that the effect of each ‘environment’ variable on interpreting ability was different from and greater than the ‘input’ variable, and learning engagement was the greatest influencing factor. At the same time, peer interaction on interpreting performance has significant influence. Results suggest that it is crucial to provide effective guidance for optimizing learning engagement and interpreting teaching research by both improving the environmental support and building the platform of peer interaction, beginning with learning engagement.Keywords: learning engagement, interpreting performance, interpreter training, English major students

Abstract:
Background: Central stabilisation training aims to improve neuromuscular coordination. It is used in the form of injury prevention and completing the swimmers' process. The aim of the study was to access the impact of this training on the results by disabled swimmers at 50 and 100 meters’ freestyle. Material/Method: 20 competitors with similar dysfunctions of the musculoskeletal system, randomly assigned to the experimental and control group, participated in the study. Each group consisted of 7 swimmers started in competitions from the standing starting position, and 3 started from the water. The study included a 4-week set of stabilization exercises, 4 times a week instead of pulling by legs. Exercises were held under specialist swimming conditions and involved controlled circuit muscle movements while maintaining a floating stable position in the water. Results: All groups improved their 'best times' besides swimmers started from standing position in the control group. There were no significant differences between intergroup and intra-group results, both at distance 50 and 100 meters’ freestyle. Conclusions: Better improvements in the experimental group were noted, but this effect cannot be attributed to 4-week stabilisation training. However, this investigation might suggest that this type of training could be beneficial for junior disabled swimmers.Keywords: athletes, swimming, trunk exercises, youth

Abstract:
Cyber-Physical Systems as drones proved their efficiency for supporting emergency applications. For these particular applications, travel time and autonomous navigation algorithms are of paramount importance, especially when missions are performed in urban environments with high obstacle density. In this context, however, safety properties are not properly addressed. Our ambition is to optimize the system safety level under autonomous navigation systems, by preserving performance of the CPS. At this aim, we introduce genetic algorithms in the autonomous navigation process of the drone to better infer its trajectory considering the possible obstacles. We first model the wished safety requirements through a cost function and then seek to optimize it though genetics algorithms (GA). The main advantage in the use of GA is to consider different parameters together, for example, the level of battery for navigation system selection. Our tests show that the GA introduction in the autonomous navigation systems minimize the risk of safety lossless. It is known that the Riemannian manifold determined by the family of inverse Gaussian distributions endowed with the Fisher metric has negative constant curvature κ= -1/2, as does the family of usual Gaussian distributions. In the present paper, firstly, we arrive at this result by following a different path, much simpler than the previous ones. We first put the family in exponential form, thus endowing the family with a new set of parameters, or coordinates, θ₁, θ₂; then we determine the matrix of the Fisher metric in terms of these parameters; and finally we compute this matrix in the original parameters. Secondly, we define the inverse q-Gaussian distribution family (q < 3) as the family obtained by replacing the usual exponential function with the Tsallis q-exponential function in the expression for the inverse Gaussian distribution and observe that it supports two possible geometries, the Fisher and the q-Fisher geometry. The solution is a device that operates indefinitely, requires no maintenance, and has no negative impact on the ambient environment. One promising approach to achieve this is energy harvesting, which involves capturing energy from the ambient environment and transferring it to power devices. This method can revolutionize industries. Such as manufacturing, agriculture, and healthcare by enabling real-time data collection and analysis, reducing maintenance costs, improving efficiency, and contributing to a future with lower carbon emissions. This research explores various energy harvesting techniques, focusing on radio frequencies (RF) and multiple energy sources. It examines RF-based and solar methods for powering battery-free sensors, low-power circuits, and IoT devices. The study investigates a hybrid RF-solar harvesting circuit designed for remote sensing devices. At present, the ultimate aim in digital system designs, especially at the gate level and lower levels of design abstraction, is power optimization. Adders are a nearly universal component of today's integrated circuits. Most of the research was on the design of high-speed adders to execute addition based on various adder structures. This paper discusses the ideal path for selecting an arithmetic unit for IoT applications. Based on the analysis of eight types of 16-bit adders, we found out Carry Look-ahead (CLA) produces low power. Additionally, multiplier and accumulator (MAC) unit is implemented with the Booth multiplier by using the low power adders in the order of preference. The design is synthesized and verified using Synopsys Design Compiler and VCS. Then it is implemented by using Cadence Encounter. This project studies the feasibility of two designs of a float glass manufacture in Kuwait. The first Alternative, consists of one production line of capacity 500 tons of glass per day. It also outlines the moral excellence of individuals and communities, focusing on spiritual, moral, and social dimensions. Da’wah is the act of inviting others to Islam, emphasizing the significance of conveying the message with kindness, patience, and understanding. Qur’anic moral excellence, as evinced in the Qur’an encompasses virtues such as compassion, honesty, humility, patience, and generosity. The Glorious Qur’an, therefore, harps on the importance of embodying these values in daily life, serving as a guide for individuals engaged in Da’wah activities to exemplify moral excellence through their actions and characters. It is in line with this backdrop that this article intends to assess the Da’wah and Qur’anic Moral Excellence. However, to achieve the objectives of the research, the article attempts to answer some basic questions. Emphasizes were laid in the Glorious on the need to invite others to the true path of Islam and the qualities of Da’i necessary for his Da’wah activities. The paper also discussed the impact of Qur’anic moral excellence on the Da’i and those invited to Islam. Laser Forming process as a non-contact thermal forming process is widely used to forming and bending of metallic and non-metallic sheets. In this process, according to laser irradiation along a specific path, sheet is bent. One of the most important output parameters in laser forming is bending angle that depends on process parameters such as physical and mechanical properties of materials, laser power, laser travel speed and the number of scan passes. In this paper, Artificial Neural Network and Fuzzy Logic System were used to predict of bending angle in laser forming process. Inputs to these models were laser travel speed and laser power. Abstract:
We designed novel epoxy/graphitic carbon nitride (g-C₃N₄) nanocomposite materials as suitable surface coatings. g-C₃N₄ nanosheets were facilely prepared and dispersed in the epoxy resin via solution casting. This research focuses on the mechanical and anticorrosion properties of g-C₃N₄ nanofiller reinforced epoxy nanocomposites. The structures, sizes, and morphologies of designed polymeric nanocomposites and nanofillers were elucidated using various techniques such as FT-IR, NMR, FE-TEM, FE-SEM. The developed nanocomposite was applied as a surface coating by air-assisted spray method. The structure-property relationship was studied for different concentrations of nanofiller in the epoxy matrix. The anticorrosive properties were studied via electrochemical experiments, including potentiodynamic polarization, electrochemical impedance, and open-circuit potential analyses, as well as salt spray test. Mechanical durability was assessed by various methods, such as impact, T-bending, and crosscut tests. Surface heterogeneity, elasticity, and corrosion-resistance features are among the merits of developed composite. The highest improvement was achieved with well dispersion of g-C₃N₄ sheets fillers. This fascinating epoxy nanostructured coating provides a promising anticorrosive coatings for a sustainable future environment.Keywords: epoxy, nanocomposite, surface coating, anticorrosive properties, mechanical durability

Abstract:
Detecting the location of pole-to-earth faults is essential for the safe operation of the electrical system of the railroad. This paper aims to use a combination of evolutionary algorithms and neural networks to increase the accuracy of single pole-to-earth fault detection and location on the Tehran railroad power supply system. As a result, the Imperialist Competitive Algorithm (ICA) and Particle Swarm Optimization (PSO) are used to train the neural network to improve the accuracy and convergence of the learning process. Due to the system's nonlinearity, fault detection is an ideal application for the proposed method, where the 600 Hz harmonic ripple method is used in this paper for fault detection. The substations were simulated by considering various situations in feeding the circuit, the transformer, and typical Tehran metro parameters that have developed the silicon rectifier. Required data for the network learning process has been gathered from simulation results. The 600Hz component value will change with the change of the location of a single pole to the earth's fault. Therefore, 600Hz components are used as inputs of the neural network when fault location is the output of the network system. Abstract:
The work aims to develop a robot in the form of autonomous vehicle to detect, inspection and mapping of underground pipelines through the ATmega328 Arduino platform. Hardware prototyping very similar to C / C ++ language that facilitates its use in robotics open source, resembles PLC used in large industrial processes. The robot will traverse the surface independently of direct human action, in order to automate the process of detecting buried pipes, guided by electromagnetic induction. The induction comes from coils that sends the signal to the Arduino microcontroller contained in that will make the difference in intensity and the treatment of the information, then this determines actions to electrical components such as relays and motors, allowing the prototype to move on the surface and getting the necessary information. The robot was developed by electrical and electronic assemblies that allowed test your application. The assembly is made up of metal detector coils, circuit boards and microprocessor, which interconnected circuits previously developed can determine, process control and mechanical actions for a robot (autonomous car) that will make the detection and mapping of buried pipelines plates.Keywords: robotic, metal detector, embedded system, pipeline inspection

Abstract:
This paper presents a wind turbine based on the doubly fed induction generator (DFIG) connected to the utility grid through a shunt active power filter (SAPF). The whole system is controlled by a double nonlinear predictive controller (DNPC). A Taylor series expansion is used to predict the outputs of the system. The control law is calculated by optimization of the cost function. The first nonlinear predictive controller (NPC) is designed to ensure the high performance tracking of the rotor speed and regulate the rotor current of the DFIG, while the second one is designed to control the SAPF in order to compensate the harmonic produces by the three-phase diode bridge supplied by a passive circuit (rd, Ld). As a result, we obtain sinusoidal waveforms of the stator voltage and stator current. The proposed nonlinear predictive controllers (NPCs) are validated via simulation on a 1.5 MW DFIG-based wind turbine connected to an SAPF. Abstract:
The purpose of this research was to investigate the relationship between the factors of using online social network for tourism destination in case of Bangkok area in Thailand, by extending the use of technology acceptance model (TAM). This study employed by quantitative research and the target population were entrepreneurs and local people in Bangkok who use social network-Facebook concerning tourist destinations in Bangkok. Questionnaire was used to collect data from 300 purposive samples. The multiple regression analysis and path analysis were used to analyze data. The results revealed that most people who used Facebook for promoting tourism destinations in Bangkok perceived ease of use, perceived usefulness, perceived trust in using Facebook and influenced by social normative as well as having positive attitude towards using this application. Addition, the hypothesis results indicate that acceptance of online social network-Facebook was related to the positive attitude towards using of Facebook and related to their intention to use this application for tourism.Keywords: Facebook, online social network, technology acceptance model, tourism destination

Abstract:
Hardware Trojan becomes great concern as integrated circuit (IC) technology advances and not all manufacturing steps of an IC are accomplished within one company. Real-time hardware Trojan detection is proven to be a feasible way to detect randomly activated Trojans that cannot be detected at testing stage. On-chip sensors serve as a great candidate to implement real-time hardware Trojan detection, however, the optimization of on-chip sensors has not been thoroughly investigated and the location of Trojan has not been carefully explored. On-chip sensor ellipse distribution method and equivalent mapping technique are proposed based on the characteristics of on-chip power delivery network in this paper to address the optimization and distribution of on-chip sensors for real-time hardware Trojan detection as well as to estimate the location and current consumption of hardware Trojan. Simulation results verify that hardware Trojan activation can be effectively detected and the location of a hardware Trojan can be efficiently estimated with less than 5% error for a realistic power grid using our proposed methods. The proposed techniques therefore lay a solid foundation for isolation and even deactivation of hardware Trojans through accurate location of Trojans.Keywords: hardware trojan, on-chip sensor, power distribution network, power/ground noise

This research aims to explore the potential of shifting urban villages to public housing in China. In common practice, the central and local governments established two divided systems of urban redevelopment and public housing, including aims, design ideas, policy, headquarters, and branch offices. In most cases, the urban regeneration and public housing projects satisfy only the selected part of the society who can afford it (urban regeneration) or meet the requirements (public housing), which fail to cover the housing demand. However, there are many similarities between these two types of housing under the background of a shared economy, especially in target groups, affordable prices, and efficient use of spaces. Shenzhen always takes the lead in China’s urban regeneration and housing reformation. There are some top-down approaches to transforming housing in the urban village into public housing at present. These new approaches will provide a good chance to evaluate existing practices and explore the future development path of urban villages; while at the same time it could positively influence the housing problem in China.Keywords: urban village, public housing, sharing economy, urban redevelopment

Abstract:
This study examines the effects of a solar-based heating system, in a north-south oriented agricultural greenhouse on the development of strawberry plants during winter. This system relies on the circulation of water as a heat transfer fluid in a closed circuit installed on the greenhouse roof to store heat during the day and release it inside at night. A comparative experimental study was conducted in two greenhouses, one experimental with the solar heating system and the other for control without any heating system. Both greenhouses are located on the terrace of the Solar Energy and Environment Laboratory of the Mohammed V University in Rabat, Morocco. The devel-oped heating system consists of a copper coil inserted in double glazing and placed on the roof of the greenhouse, a water pump circulator, a battery, and a photovoltaic solar panel to power the electrical components. This inexpen-sive and environmentally friendly system allows the greenhouse to be heated during the winter and improves its microclimate system. This improvement resulted in an increase in the air temperature inside the experimental green-house by 6 °C and 8 °C, and a reduction in its relative humidity by 23% and 35% compared to the control greenhouse and the ambient air, respectively, throughout the winter. For the agronomic performance, it was observed that the production was 17 days earlier than in the control greenhouse.Keywords: sustainability, solar energy, thermal energy storage., greenhouse heating
