1017 Determining Moment-Curvature Relationship of Reinforced Concrete Rectangular Shear Walls

Abstract:
The behavior of reinforced concrete (RC) members is quite important in RC structures. When evaluating the performance of structures, the nonlinear properties are defined according to the cross sectional behavior of RC members. To be able to determine the behavior of RC members, its cross sectional behavior should be known well. The moment-curvature (MC) relationship is used to represent cross sectional behavior. The MC relationship of RC cross section can be best determined both experimentally and numerically. But, experimental study on RC members is very difficult. The aim of the study is to obtain the MC relationship of RC shear walls. Additionally, it is aimed to determine the parameters which affect MC relationship. While obtaining MC relationship of RC members, XTRACT which can represent robustly the MC relationship is used. Concrete quality, longitudinal and transverse reinforcing ratios, are selected as parameters which affect MC relationship. As a result of the study, curvature ductility and effective flexural stiffness are determined using this parameter. Abstract:
The study examined the effect of accounting choice and level of disclosure on the firm’s implied cost of equity in Indian environment. For the study accounting choice was classified as aggressive or conservative depending upon the firm’s choice of accounting methods, accounting policies and accounting estimates. Level of disclosure is the quantum of financial and non-financial information disclosed in firm’s annual report, essentially in note to accounts section, schedules forming part of financial statements and Management Discussion and Analysis report. Regression models were developed with cost of equity as a dependent variable and accounting choice, level of disclosure as an independent variable along with selected control variables. Cost of equity was measured using Edward-Bell-Ohlson (EBO) valuation model, to measure accounting choice Modified-Jones-Model (MJM) was used and level of disclosure was measured using a disclosure index essentially drawn from Botosan study. Abstract:
In heavy duty areas, asphalt pavement constructed as entrance roadway may expose distresses such as cracking and rutting during service life. To mitigate these problems, composite pavement with a roller-compacted concrete base may be a good alternative; however, it should be initially investigated. Structural performances such as fatigue cracking and rut depth may be changed due to variation of some design factors. Therefore, this study focuses on the variation effect of material modulus, layer thickness and loading on composite pavement performances. Stress and strain at the critical location are determined and used as the input of transfer function for corresponding distresses to evaluate the pavement performance. Also, composite pavement satisfying the design criteria may be selected as a design section for heavy duty areas. Consequently, this investigation indicates that composite pavement has the ability to eliminate fatigue cracking in asphalt surfaces and significantly reduce rut depth. In addition, a thick or strong rigid base can significantly reduce rut depth and prolong fatigue life of this layer.Keywords: composite pavement, ports, cracking, rutting

Abstract:
Traditional cultural practices mirror or replicate the values and beliefs held by members of the community. Throughout the world, every social grouping has specific traditional practices, some of which are beneficial to all, while others have become harmful to specific group such as women. Like in some African states, these traditional cultural practices are performed in South Africa and are violating women’s rights. Women’s rights are human rights. The South African Constitution is one of the most progressive in the world, and notable includes the Bill of Rights which provides protection of socio-economic and cultural rights. Cultural rights are protected in Section 30 and 31 of the constitution, although such protection is not without limitation. This highly complex interplay and competition between human rights and cultural rights, which are manifested through cultural practices, is the golden thread that traces through this paper. The paper argues that there is conflict and the lack of balance between diverse cultural and legal or constitutional framework which promotes the value of human dignity and equality, especially for women. These practices are reviewed in connection with the South African government laws. Abstract:
A numerical study of laminar and turbulent fluid flows in 90° bend of square section was carried out. Three-dimensional meshes, based on hexahedral cells, were generated. The QUICK scheme was employed to discretize the convective term in the transport equations. The SIMPLE algorithm was adopted to treat the velocity-pressure coupling. The flow structure obtained showed interesting features such as recirculation zones and counter-rotating pairs of vortices. The performance of three different turbulence models was evaluated: the standard k- ω model, the SST k-ω model and the Reynolds Stress Model (RSM). Overall, it was found that, the multi-equation model performed better than the two equation models. In fact, the existence of four pairs of counter rotating cells, in the straight duct upstream of the bend, were predicted by the RSM closure but not by the standard eddy viscosity model nor the SST k-ω model. The analysis of the results led to a better understanding of the induced three dimensional secondary flows and the behavior of the local pressure coefficient and the friction coefficient.Keywords: curved duct, counter-rotating cells, secondary flow, laminar, turbulent

Abstract:
This paper surveys the studies on construction change and reveals some of the potential future works. A full-scale investigation of change literature, including change definitions, types, causes and effects, and change management systems, is accomplished to explore some of the coming change trends. It is tried to pick up the critical works in each section to deduct a true timeline of construction changes. The findings show that leaping from best practice guides in late 1990s and generic process models in the early 2000s to very advanced modeling environments in the mid-2000s and the early 2010s have made gaps along with opportunities for change researchers in order to develop some more easy and applicable models. Another finding is that there is a compelling similarity between the change and risk prediction models. Therefore, integrating these two concepts, specifically from proactive management point of view, may lead to a synergy and help project teams avoid rework. Also, the findings show that exploitation of cause-effect relationship models, in order to facilitate the dispute resolutions, seems to be an interesting field for future works.Keywords: construction change, change management systems, dispute resolutions, change literature

Abstract:
Compaction of agricultural soils as a result of the passage of heavy machinery on the fields is a problem that affects many agronomists and farmers since it results in a loss of yield of most crops. To remedy this, and raise the overall future of the food security challenge, we must study and understand the process of soil degradation. The present review is devoted to understanding the effect of repeated passages on agricultural land. The experiments were performed on a plot of the area of the ESIER, characterized by a clay texture in order to quantify the soil compaction caused by the wheels of the tractor during repeated passages on agricultural land. The test tractor CASE type puissance 110 hp and 5470 kg total mass of 3500 kg including the two rear axles and 1970 kg on the front axle. The state of soil compaction has been characterized by measuring its resistance to penetration by means of a penetrometer and direct manual reading, the density and permeability of the soil. Soil moisture was taken jointly. The measurements are made in the initial state before passing the tractor and after each pass varies from 1 to 7 on the track wheel inflated to 1.5 bar for the rear wheel and broke water to the level of valve and 4 bar for the front wheels. The passages are spaced to the average of one week. The results show that the passage of wheels on a farm tilled soil leads to compaction and the latter increases with the number of passages, especially for the upper 15 cm depth horizons. The first passage is characterized by the greatest effect. However, the effect of other passages do not follow a definite law for the complex behavior of granular media and the history of labor and the constraints it suffers from its formation.Keywords: wheel traffic, tractor, soil compaction, wheel

Image classification and localization research is currently an important strategy in the field of computer vision. The evolution and advancement of deep learning and convolutional neural networks (CNN) have greatly improved the capabilities of object detection and image-based classification. Target detection is important to research in the field of computer vision, especially in video surveillance systems. To solve this problem, we will be applying a convolutional neural network of multiple scales at multiple locations in the image in one sliding window. Most translation networks move away from the bounding box around the area of interest. In contrast to this architecture, we consider the problem to be a classification problem where each pixel of the image is a separate section. Image classification is the method of predicting an individual category or specifying by a shoal of data points. Image classification is a part of the classification problem, including any labels throughout the image. The image can be classified as a day or night shot. Or, likewise, images of cars and motorbikes will be automatically placed in their collection. The tremendous loss of life that resulted in the aftermath of recent earthquakes in developing countries is mostly due to the collapse of non-engineered and semi-engineered building structures. Such structures are used as houses, schools, primary healthcare centres and government offices. These building are classified structurally into two categories viz. non-engineered and semi-engineered. Non-engineered structures include: adobe, Unreinforced Masonry (URM) and wood buildings. Semi-engineered buildings are mostly low-rise (up to 3 story) light concrete frame structures or masonry bearing walls with reinforced concrete slab. This paper presents an overview of the typical damage observed in non-engineered structures and their most likely causes in the past earthquakes with specific emphasis on the performance of such structures in the 2005 Kashmir earthquake. It is demonstrated that seismic performance of these structures can be improved from life-safety viewpoint by adopting simple low-cost modifications to the existing construction practices. Abstract:
This paper presents a comparative study of effects of the repeated solid obstacles on the propagation of H2-Air premixed flames. Pressure, speed of the flame front as well as structure of reaction zones are studied for hydrogen. Two equivalence ratios are examined for different configurations of three baffle plates and two obstacles with a square cross-section having blockage ratios of either 0.24 or 0.5. Hydrogen fuel mixtures with two equivalence ratios of 0.7 and 0.8 are studied and this is limited by the excessive overpressures. The results show that the peak pressure and its rate of change can be increased by increasing the blockage ratio or by decreasing the space between successive baffles. As illustrated by the high speed images of LIF-OH, the degree of wrinkling and contortion in the flame front increase as the blockages increase. The images also show how the flame front relaminarises with increasing distances between obstacles, which accounts for the pressure decrease with increasing separation. This 'new health economy' encompasses three key concepts: well-being, well-conditioned and well-shaped; which are shaped by wellness segments and goals that influence purchasing decisions of consumers. The research protocol aims to examine the feasibility, challenges, and capabilities in provision for each customer with an ecosystem, or platform, that organizes data and insights to create an individual health and fitness, nutrition, and beauty profile. Convenience sampling of 100 consumers residing in private housing within five major districts in Singapore will be selected to participate in the study. Statistical Package for Social Science 25 will be used to conduct descriptive statistics for quantitative data while qualitative data results using focus interviews, will be translated and transcribed to identify improvements in provision of these services. Rising income in emerging global markets is fuelling the demand for these general wellbeing products and services. The work of the eminent architect and composer has undoubtedly been influenced both by his architecture and collaboration with Le Corbusier and by the conquests of the musical avant-garde of the 20th century (Schoenberg, Messian, Bartock, electroacoustic music). It is known that the golden mean and the Fibonacci sequence played a momentous role in the Architectural Avant-garde (Modulor) and expanded on musical pursuits. Especially in the 50s (serialism), it was a structural tool for composition. Xenakis' architectural and musical work (Sacrifice, Metastasis, Rebonds, etc.) received the influence of the Golden Section, as has been repeatedly demonstrated. However, the idea of this retrospective sequence and the reflection raised by the search for new proportions, both in the architectural and the musical work of Xenakis, was not limited to constituting a step, a workable formula that acted unifyingly with regard to the other parameters of the musical work, or as an aesthetic model that makes sense - philosophically and poetically - an anthropocentric dimension as in other composers (see Luigi Nono) ̇ triggered a qualitative leap, an opening of the composer to the assimilation of mathematical concepts and scientific types in music and the consolidation of new sound horizons of stochastic music.Keywords: golden ratio, music, space, stochastic music

Currently, database management systems have various tools such as backup and maintenance, and also provide statistical information such as resource usage and security. In terms of query performance, this paper covers query optimization, views, indexed tables, pre-computation materialized view, query performance analysis in which query plan alternatives can be created and the least costly one selected to optimize a query. Indexes and views can be created for related table columns. The literature review of this study showed that, in the course of time, despite the growing capabilities of the database management system, only database administrators are aware of the need for dealing with archival and transactional data types differently. These data may be constantly changing data used in everyday life, and also may be from the completed questionnaire whose data input was completed. For both types of data, the database uses its capabilities; but as shown in the findings section, instead of repeating similar heavy calculations which are carrying out same results with the same query over a survey results, using materialized view results can be in a more simple way. The quality of life of people with blindness is significantly influenced by the level of resilience they possess. A qualitative approach of the descriptive phenomenological design was employed to address basic study objectives. The researcher purposely selected three blind graduate students from Sidist Kilo Campus and conducted a semi-structured interview to gather data. Data were analyzed by using thematic coding techniques. The present study found that personal characteristics such as commitment, living hope, motivation, positive self-esteem, self-confidence, and communication have shaped resiliency for successful university students with visual disabilities. The finding showed that the school environment is the place in which blind students had developed/experienced social, psychological, and economical competency and hope for their academic and entire life success. Furthermore, the finding showed that blind students had experienced individual, family, school, and community-related risks in the success track. Therefore, governmental and non-governmental organizations should provide training for students with visual impairments that focus on the individual traits that shape resilience for academic success, such as commitment, living hope, motivation, positive self-esteem, self-confidence, and communication and also community-oriented training should be to break the social stigma and discriminations for the individuals with the visual impairment.Keywords: blind students, risk and protective factors, lived experience, success

Proof of controlling crack width is a basic condition for securing suitable performance in serviceability limit state. The cracking in concrete can occur at any time from the casting of time to the years after the concrete has been set in place. Most codes struggle with offering procedure for crack width calculation. There is lack in availability of design charts for designers to compute crack width with ease. The focus of the study is to utilize design charts and parametric equations in calculating crack width with minimum error. The paper contains a simplified procedure to calculate crack width for reinforced concrete (RC) sections subjected to bending with axial tensile force following the guidelines of Euro code [DS EN-1992-1-1 & DS EN-1992-1-2]. Numerical examples demonstrate the application of the suggested procedure. Comparison with parallel analytical tools support the validity of result and show the percentage deviation of crack width in both the procedures. Investigation and analysis of flow behavior around different shapes bluff bodies is one of the reputed topics for several years. The importance of these researches is about the unwanted phenomena called flow separation. The location of separation and the size of the wake region should be considered in different industrial designs. In this research a bluff body with D-shaped cross section has been analyzed. In circular cylinder flow separation point changes with Reynolds number but in D-Shaped cylinder there is fix flow separation point. So there is more wake steadiness in D-Shaped cylinder as compared to Circular cylinder and drag reduction because of wake steadiness. In the present work CFD simulation is carried out for flow past a D-Shaped cylinder to see the wake behavior. The Reynolds number regime currently studied corresponds to low Reynolds number and nominally two-dimensional wake. Also the effect of D-Shaped cylinders on the rate of heat transfer has been considered. The 'loss of control' defence to murder as enacted in the Coroners and Justice Act 2009 (CJA) represents a legislative effort to bring greater coherence to an aspect of UK homicide law that has vexed several generations of jurists, practitioners, and academic commentators. The analysis developed in this paper illustrates that the loss of control defence as defined in CJA sections 54 and 55 is a laudable initiative; its fuller assessment must await further appellate court determination before a definitive conclusion of its utility is possible. The CJA amendments tend to embrace a legitimate policy that those who found to be provoked by the activities of others to lose their self-control should be dealt with in a different way than those who commit intentional killings when motivated by their own desires or pursuit of gain. However, the 2012 Court of Appeal decisions rendered in the Parker troika of cases, provide useful direction as to how the law is likely to be applied. It shows an attitude in the Court of Appeal that the whole circumstances that challenged the defendant must be examined. It is becoming more and more necessary to manage flood risk, and it must include all stakeholders and all possible means available. The goal of this work is to map the vulnerability of the Oued Derna-region Tagzirt flood zone in the semi-arid region. This is about implementing predictive models and flood control. This allows for the development of flood risk prevention plans. In this study, A resistivity survey was conducted over the area to locate and evaluate soil characteristics in order to calculate discharges and prevent flooding for the study area. The development of a one-dimensional (1D) hydrodynamic model of the Derna River was carried out in HEC-RAS 5.0.4 using a combination of survey data and spatially extracted cross-sections and recorded river flows. The study area was hit by several extreme floods, causing a lot of property loss and loss of life. This research focuses on the most recent flood events, based on the collected data, the water level, river flow and river cross-section were analyzed. The COVID-19 pandemic has paralyzed many lives until a vaccine was available, which caused the so-called “new normal.” According to the World Health Organization (WHO), COVID-19 is an infectious disease. It can cause significant illness or death in anyone. Governments and health officials tried to impose rules and regulations to avoid and slow down transmission. Therefore, software engineers worldwide developed applications to trace and track patients’ movements and notify others, mainly using Bluetooth. In this way, everyone could be informed whether they come in close contact with someone who has COVID-19 and takes proper safety precautions. Because most of the applications use technologies that can potentially reveal the user’s identity and location, researchers have debated privacy preservation and how to improve user privacy during such pandemics. Thanks to Distributed Ledger Technology (DLT), there have been some proposed methods to develop privacy-preserving Patient Tracking Systems in the last two years. As an instance of the DLT, Blockchain is like a decentralized peer-to-peer database that maintains a record of transactions. Transactions are immutable, transparent, and anonymous in this system. We conducted a comprehensive evaluation of the literature by looking for papers in the relevant field and dividing them into pre- and post-pandemic systems. Additionally, we discussed the many uses of blockchain technology in pandemic control. We found that two major obstacles facing blockchain implementation across many healthcare systems are scalability and privacy. The Polkadot platform is presented, along with a review of its efficacy in tackling current concerns. One major problem when using bonded Fiber Reinforced Polymer is the presence of high inter facial stresses near the end of the composite laminate which might govern the failure of the strengthening schedule. It is known that the decrease of FRP plate thickness and the fitness of adhesive reduce the stress concentration at plate ends. Another way is to use a plate with a non uniform section or tapered ends and softer adhesive at the edges. In this paper, a comprehensive finite element (FE) study has been conducted to investigate the effect of mixed adhesive joints (MAJ) and tapering plate on the inter facial stress distribution in the adhesive layer, this paper presents the results of a study of application of two adhesives with different stiffnesses (bi-adhesive) along the joint strength length between the CFRP-strengthened steel beam for tapered and untapered plate on the distribution of inter facial stresses. A stiff adhesive was applied in the middle portion of the joint strength, while a low modulus adhesive was applied towards the edges prone to stress concentrations.Keywords: FRP, mixed adhesive joints, stresses, tapered plate, retrofitted beams bonded

Abstract:
Type of study: Observational cross section study. Background and purpose: Forward head posture (FHP) is a common sagittal faulty posture with anterior head translation relative to vertical posture line. FHP related to temporomandibular joint dysfunctions, neck pain and headache. Sports persons usually overuse one side of the body in training and playing leading to postural imbalance, yet the effect of playing football or bodybuilding on measurements of FHP has never been studied. Participants: Thirty six subjects divided into 3 groups of 12 football players, 12 body builders and 12 students. Method: FHP severity was assessed by measuring the craniovertebral (CVA) and gaze angles, using the photogrammetric method. Photos were taken from right side of subjects while assuming standing position. Analysis of variance was used to assess angles difference between the three groups. Results: No significant differences were found in CVA and gaze angles between the three groups (P > 0.05). Conclusion: Playing football or body building doesn't impose significant FHP.Keywords: craniovertebral angle, gaze angle, football, body building

Abstract:
This study determined the cases of violence against women in selected barangays of Tarlac City. In this research, the following questions were answered: what is the description of the cases on violence against women?; what are the causes of violence against women?; what support/assistance is provided by the LGUs?; and what plan of action can be proposed to improve the VAW services of the barangays? The methodologies used in the present study are qualitative and descriptive researches. The researchers used documentary analysis and interview to gather data. The subjects of the study are violence against women survivors from the selected ten (10) populous barangays of Tarlac City. Physical abuse, mental abuse, threatening, abandonment of children, child support issues, child custody, psychological abuse, economic abuse, and rape are the other recorded cases among the evaluated barangays. Based on the information, the researchers found out that a VAW desk was established in every respondent barangay. This in compliance with Section 12 D, Rule IV of the Rules and Regulations Implementing the Magna Carta of Women, which provides for the establishment of a VAW desk in every barangay to ensure that violence against women cases are fully addressed in a gender-responsive manner.Keywords: Barangay VAW desk, cases of violence against women, violence against women, women's studies

Outsourcing had been the contractual relationship in which the responsibility for a function or task is handed over to an outside firm for a fixed period of time which is not the same as contracting where a specific one-off task is allocated to an external business; therefore in information technology a specialist area such as maintenance of web servers is controlled by an outside firm or if the department is not a critical factor the whole IT section may be outsourced. Organisation contracts is frequently a major area in successful outsourcing relationship, whereby the contracts specify the right, liability and expectation of the vendor and contracts are mostly of high value and last for very long. Therefore, in this research one particular project that is been outsourced for the financial industry (Guarantee Trust Assurance PlC) is been discussed along with the approach used and the various problems encountered, though Outsourcing is not necessarily a perfect and easy way out for business. It is extremely critical for a company to look at all the aspect of outsourcing before deciding to use it as an instrument for development. Abstract:
Natural disasters like flood, earthquake, cyclone, volcanic eruption and others are causing immense losses to the property and lives every year. Current status and actual loss information of natural hazards can be determined and also prediction for next probable disasters can be made using different remote sensing and mapping technologies. Global Positioning System (GPS) calculates the exact position of damage. It can also communicate with wireless sensor nodes embedded in potentially dangerous places. GPS provide precise and accurate locations and other related information like speed, track, direction and distance of target object to emergency responders. Remote Sensing facilitates to map damages without having physical contact with target area. Now with the addition of more remote sensing satellites and other advancements, early warning system is used very efficiently. Remote sensing is being used both at local and global scale. High Resolution Satellite Imagery (HRSI), airborne remote sensing and space-borne remote sensing is playing vital role in disaster management. Early on Geographic Information System (GIS) was used to collect, arrange, and map the spatial information but now it has capability to analyze spatial data. This analytical ability of GIS is the main cause of its adaption by different emergency services providers like police and ambulance service. Full potential of these so called 3S technologies cannot be used in alone. Integration of GPS and other remote sensing techniques with GIS has pointed new horizons in modeling of earth science activities. Many remote sensing cases including Asian Ocean Tsunami in 2004, Mount Mangart landslides and Pakistan-India earthquake in 2005 are described in this paper.Keywords: disaster mitigation, GIS, GPS, remote sensing

Abstract:
Beam-column elements are defined as structural members subjected to a combination of axial and bending forces. Lateral torsional buckling is one of the major failure modes in which beam-columns that are bent about its strong axis may buckle out of the plane by deflecting laterally and twisting. This study presents a compact closed-form equation that it can be used for calculating critical lateral torsional-buckling load of beam-columns with monosymmetric sections in the presence of a known axial load. Lateral-torsional buckling behavior of beam-columns subjected to constant axial force and various transverse load cases are investigated by using Ritz method in order to establish proposed equation. Lateral-torsional buckling loads calculated by presented formula are compared to finite element model results. ABAQUS software is utilized to generate finite element models of beam-columns. It is found out that lateral-torsional buckling load of beam-columns with monosymmetric sections can be determined by proposed equation and can be safely used in design.Keywords: lateral-torsional buckling, stability, beam-column, monosymmetric section

Abstract:
Strain sensing seams have been developed by integrating conductive sewing threads in different types of seams design on a fabric typical for sports clothing using sewing technology. The aim is to have a simple integrated textile strain sensor that can be applied to sports clothing to monitor the movements of the upper body parts of the user during sports. Different types of commercially available sewing threads were used as the bobbin thread in the production of different architectural seam sensors. These conductive sewing threads have been integrated into seams in particular designs using specific seam types. Some of the threads are delicate and needed to be laid into the seam with as little friction as possible and less tension; thus, they could only be sewn in as the bobbin thread and not the needle thread. Stitch type 304; 406; 506; 601;602; 605. were produced. The seams were made on a fabric of 80% polyamide 6.6 and 20% elastane. The seams were cycled(stretch-release-stretch) for five cycles and up to 44 cycles following EN ISO 14704-1: 2005 (modified), using a tensile instrument and the changes in the resistance of the seams with time were recorded using Agilent meter U1273A. Both experiments were conducted simultaneously on the same seam sample. Sensing functionality, among which is sensor gauge and reliability, were evaluated on the promising sensor seams. The results show that the sensor seams made from HC Madeira 40 conductive yarns performed better inseam stitch 304 and 602 compared to the other combination of stitch type and conductive sewing threads. These sensing seams 304, 406 and 602 will further be interconnected to our developed processing and communicating unit and further integrated into a sports clothing prototype that can track body posture. Abstract:
The aim of this research was increasing the productivity of solar distillation. In order to reach this aim, a solar distiller was created with three glass sides sloping 30o at the horizontal level, and the experiments were carried out on the solar distillation unit during the period from 24th August, 2016 till 24th May, 2017 at the Agricultural Engineering and Bio Systems Department, Faculty of Agriculture, Menoufia University. Three gap lengths were used between the water level and the inner glass cover, those were 3, 6, and 9 cm. As the result of change the gap length between the water level and the inner glass cover the total volume of basins were changed from 15.5, 13, and 11 L, respectively. The total basin volume was divided to three sections, to investigate the effect of water volume. The three water volumes were 100%, 75%, and 50%. Every section was supplied with one, two, or three heaters. The one heater power was 15 W. The results showed that, by increasing the distance between the basins edge and the inner edge of the glass cover, an increase occurs in the percentage of temperature difference with maximum value was 52% at distance 9 cm from each edge, an increase occurs in the productivity with maximum productivity was 3.3 L/m2 at distance 9 cm from each edge and an increase occurs in the efficiency with maximum efficiency was 70% at distance 9 cm from each edge.Keywords: distillation, solar energy, still productivity, efficiency

Abstract:
Generally, the decision of the higher court is binding on its subordinate courts. As provided in Article 111 of the Constitution, 'the law declared by the Appellate Division (AD) shall be binding on the High Court Division (HCD) and the law declared by either division of the Supreme Court shall be binding on all courts subordinate to it.' This means the judicial discipline requires the HCD to follow the decision of the AD and that it is necessary for the lower tiers of courts to accept the decision of the higher tiers as a binding precedent. Analyzing the application of Article 111 of the Constitution in the criminal justice system as a sentencing guideline, the paper, by examining whether there is any consistency in decision between one HC Bench and another HC Bench, explores whether HCD can per incuriam its previous decision. In doing so, the Death Reference (DR) Cases are contemplated. Furthermore, the paper shall examine whether the Court of Session follows the decision of the HCD while using their discretion to make the choice between death and imprisonment for life under section 302 of PC. The paper argues due to the absence of any specific direction for sentencing and inconsistency in jurisprudence among the HCD; the subordinate courts are in a dilemma.Keywords: death reference, sentencing factor, sentencing guideline, criminal justice system and constitution

Abstract:
This paper presents models for predicting operating speeds on tangent sections of two-lane rural roads developed on continuous speed data. The data corresponds to 20 drivers of different ages and driving experiences, driving their own cars along an 18 km long section of a state road. The data were first used for determination of maximum operating speeds on tangents and their comparison with speeds in the middle of tangents i.e. speed data used in most of operating speed studies. Analysis of continuous speed data indicated that the spot speed data are not reliable indicators of relevant speeds. After that, operating speed models for tangent sections were developed. There was no significant difference between models developed using speed data in the middle of tangent sections and models developed using maximum operating speeds on tangent sections. All developed models have higher coefficient of determination then models developed on spot speed data. Thus, it can be concluded that the method of measuring has more significant impact on the quality of operating speed model than the location of measurement.Keywords: operating speed, continuous speed data, tangent sections, spot speed, consistency
